1) The fulfillment of the obligations due for payment to the state consolidated budget:

- establishing certificates regarding the lack of overdue debts regarding the payment of taxes, taxes or contributions to the consolidated general budget (local budget, state, etc.) at the moment of the presentation,

the criminal record of the economic operator and the members of the administrative bodymanagement, or supervision of that economic operator or those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / instrument of incorporation, - as the case may be, documents by which it is demonstrated that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be.

Non-resident economic operators (foreigners) have the right to present any editorial documents issued by the authorities of the country where they are residents, proving the fulfillment of the due taxes due to the state budget and the local budget, in accordance withwith the legislation of your country of residence. Documents will be accompanied by their authorized translation into Romanian.

The way to prove the fulfillment of the requirement: the economic operators participating in the award procedure will be filled in with the information related to their situation. The supporting documents proving the fulfillment of the assumed by cothe DUAE filing shall be submitted, at the request of the contracting authority, only by the tenderer ranked first in the intermediate rankings drawn up at the end of the evaluation of the tenders, after the final tender stage; 2) The bidders, the supporting third parties and the subcontractors shall not be present in the situations stipulated in art. 59 60, 164, 165, 167 of Law no. 98/2016.

The way in which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure, with information related to their situation. The supporting documents proving the fulfillment of the assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked 1st inthe intermediary stamped at the completion of the evaluation of the tenders, after the final stage of the electronic auction.
