the purchase is the purchase of various foods, from the supplier's warehouses, with payment within the term stipulated by the acquisition contract:

The bidders must not find themselves in the situations stipulated in art. 164, 165 and 167 of Law no. 98/2016 on public procurement.

The economic operator (leader, associate, third party, subcontractor) will fill in the corresponding requirement in the formDUAE, with information related to their situation, from the awarding documentation.

Incorporating the situation stipulated in art. 164, 165, 167 of Law no. 98/2016 regarding the public acquisitions attracts the exclusion of the bidder from the procedure applied for awarding the public procurement contract.

The supporting documents proving the fulfillment of the assumed by completing the DUAE form must beonly those of the tenderers placed on the first three places at the completion of the evaluation of the tenders.

These documents may be:

Romanian legal / natural persons:

- Certificate of fiscal attestation for legal persons, issued by MFP or subordinated subunits who have the capacity of a budget lender (this certificate must show that the bidder does not- the tax certificate for local taxes and fees in the case of legal persons, issued by the Local Council (this certificate must show that the tenderer has no overdue debts at the moment of their submission),

The criminal record of the economic operator and the members of the management, management or soversight of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act.

Foreign legal / natural persons:

editorial documents, issued by the authorities competent in the country where they are resident, to prove the fulfillment of respayment of taxes to the state budget and the local budget, according to the legislation of the country of residence.
