Declaration regarding non-compliance with the provisions of art. 164, reported over the 5 year period (art. 171 par. Required confirmation documents:

(a) the criminal record of the economic operator and members of the management, management or supervisory body of that economic operator or of those having the power to represent, decide orcontrol, as it results from the certifying certificate issued by the ONRC / constitutive act. The information contained therein must be actual / current at the time of submission. The certified statement shall be presented in original, legalized copy or copy according to the original,

(b) Fiscal attestation certificate, certified copy "according to the original", signed and stamped by-the legal representative, issued by the tax administration body of the territorial administrative unit within the range of which the economic operator has its registered office, showing the lack of outstanding payment obligations to the consolidated general budget existing at the date of presentation of the certificate; tax for legal persons, on local taxes and fees and alocal budget revenues certified copy "according to the original", signed and stamped by the legal representative, resulting in the lack of outstanding local budget payments existing at the date of presentation of the certificate.

Specifications: The DUAE Form is made available to bidders to the Documentation and clarification section - Forms. This statement is also requiredsubcontracting enthusiasts. When submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. Applying in one or more of the situations provided-to art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement entails the exclusion of the tenderer from the procedure for awarding the contract.

Values will be expressed in RON. Tenderers who need to convert currencies other than RON will use the average annual RON / currency exchange rate announced by the National Bank of Romania for each year.

Answers to the clarifications requested by economic operators - accompanied by questions, will be published on SICAP (www.e -licitatie.ro), in a doattached to the contract notice. The contract terms are presented in the supply contract model. By submitting bids, economic operators assume their content, including answers to clarification requests, attached to the participation notice, if applicable.

Way of awarding bids with equal prices: if the evaluation committeeas the lowest price offers with equal prices, a new financial proposal will be required, which will be submitted in the same conditions as the offer.

Information on the association: Economic operators have the right to associate with the purpose of to submit a joint offer. In such a case, the association agreement will be presented, resulting in at least the following: faptuas associates are jointly and severally liable for the performance of the contract; nomination of the association leader; communications will be made with the association's leader; payments will be made to the association's leader; the part / s of the contract (which) is to be fulfilled / fulfilled by each individual partner. Each associate will complete the DUAE. Also, the qualification documents under III.2.1.a) and III.2.1.b) will be presented by each of the members of the association and the other qualification documents will be presented for the whole group-associate. If a joint bid will be declared winner, group members have the obligation to legalize their association before signing the contract.
