The subject of the order is the supply of aluminum sulphate, tri-sodium salt and ammonia water for PGE GiEK S.A. Branch Power Plant Opole. Detailed information about the subject of the contractand they are included in the Specification of Essential Terms of Orders.

Delivery of aluminum sulphate to PGE GiEK S.A. Branch Power Plant Opole in the approximate amount of 4 500.00 mg -1. Contractors, who are not subject to exclusion pursuant to art. 24 sec. 1 (excluding point 13 (d) and paragraph 5 points 1 of the Act

2. In order to pre-confirm the fulfillment of the conditions of participation-in the proceedings and no grounds for exclusion, the Contractor is obliged to submit it electronically, at the latest on the date specified in point 11.2. SIWZ, ie before the deadline for submission of bids, valid as at the day of submitting bids, referred to in art. 25a para. 2, in the form of a Single European Order Document (EAT) according to the Commission Implementing Regulation (EU)2016/7 from 5.1.2016, establishing the standard form of the Single European Order Document (Official Journal of the EU L 3/16). The pattern of the JEDZ statement constitutes Appendix No. 3 to the ToR. The details of how to submit EAT are described in detail in p. 6 SIWZ.

3. In the case of Contractors jointly applying for a contract, each Contractor submits, in accordance with 6.2. SIWZ, Jednolity Europejski Dthe ordinance of the Order in the scope in which it shows compliance with the conditions of participation in the proceedings and in order to demonstrate the lack of grounds for exclusion from the proceedings;

4. The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it relies on their resources, the conditions for participation in the proceedings also consist ofNot from point 6.2. SIWZ, Jednolite Europejskie Dokumenty Zamowienia about these entities;

5. Based on Article. 26 par. 2f of the Act, the Ordering Party in order to demonstrate the absence of grounds for exclusion from the proceedings and fulfillment of conditions for participation in the procedure, call Contractors, whose offers are not subject to rejection, to submit, before sending an invitation to participate in a possible electronic auctionj, the following documents confirming the lack of grounds for excluding the Contractor from participation in the proceedings:

5.1. Information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 of the Act, subject to art. 133 ust. 4 of the Act (concerning: natural persons, members of the management board, members of supervisory boards, proxies, partners of public and partner companies, general partners in the communityce komandytowej or komandytowo-akcyjna) valid as at the day of submission (issued not earlier than 6 months before the deadline for submission of Offers),

5.2. Information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 21 of the Act (information should apply to collective entities) issued not earlier than 6 months before the deadline for submission of Offers;

5.3. Copy fromthe register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to demonstrate the absence of grounds for exclusion based on Art. 24 sec. 5 point 1 of the Act

6. Contractor, within 3 days of posting information on the website referred to in art. 86 par. 5 of the Act, it submits a declaration to the Ordering Partyabout belonging or not belonging to the same capital group, referred to in art. 24 sec. 1 point 23 of the Act. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. The model statement will be made available to the Contractors together with the information referred to in art. 86 par. 5Act.

2. 3. The orderer requires that the shares provided in the framework ofthe ponds of goods originating from the European Union Member States, countries with which the European Union has entered into agreements on the treatment of entrepreneurs or countries to which the provisions of Directive 2014/25 / EU apply by virtue of the Council Decision, exceeded 50% for a given Part of the order.
