(a) The bidders, third parties and subcontractors should not be found in the situations referred to in art. 177, 178 and 180 of Law no. 99/2016 on acquisitions

Mode by which the fulfillment of the requirement can be demonstrated: DUAE will be completed, in accordance with the ANAP Notification No. 240/2016, by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the Contracting EntityOnly those tenderers who meet the requirements for participation / qualification whose offer is technically satisfactory following the mid-term review of the bid evaluation (online procedure).

These documents may be:

1) outstanding taxes on taxes, duties or contributions to the general budget co(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those having the power of representation, decision-making (local budget, state budget, etc.) or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. The economic operators submitting the tender mustto prove a form of registration under the law of the country of residence from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, and that he has the professional capacity to carry out the activities that do subject of the contract.

Way of accomplishment: DUAE will be completed according to the Notificationof ANAP no. 240/2016, by the economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country residence, are to be submitted at the Entita's requestcontracting parties, only by the tenderers who meet the requirements for participation / qualification whose offer corresponds technically with the intermediary analysis drawn up at the completion of the tender evaluation (online procedure).

The contracting entity does not want to limit the number of candidates and does not use Pre-selection criteria.
