The supplier will deliver the products in the quantities requested tocontracting authority and having the minimum characteristics / specifications specified in the specifications. The delivery will be made according to the requirements included in the specifications.

The supplier will deliver the products that are the subject of the lot in the quantities and at the requested time within the specifications.

Requirement no. 1.

Bidders, third parties supportedcountries and subcontractors must not be found in the situations provided in art. 164, 165, 167 of Law no. 98 / 2016.

The method of fulfillment: the DUAE will be completed in accordance with art. 193 para. (1) of Law no. 98 / 2016.

For demonstrating the non-classification in the situations provided in art. 164, 165, 167 of Law no. 98/2016, the bidder ranked in the first place in the intermediate ranking prepared at fthe analysis of the evaluation of the offers and, as the case may be, the third supporters and the subcontractors, will present, only at the request of the contracting authority, the following documents:

- certificates confirming the lack of outstanding debts, regarding the payment of taxes, taxes or contributions to the general consolidated budget (budget local, state budget, etc.) at the time of presentation;

- criminal recordr of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document ;

- as appropriate, documents proving that the economic operator can benefit fromthe derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement;

- other supporting documents, as the case may be.

In the case of the country of origin or the country in which the tenderer / supporting third party / subcontractor is established, no documents of the nature mentioned above are issued or those documents do not cover all the situations provided for in art. 164, 165 and 167, the contracting authority will accept a declaration on its own responsibility or, if there is no legal provision in the respective country regarding the declaration on its own responsibility, an authentic declaration given in front of a notary, an administrative or judicial authority or of a professional association that has competence in this regard.

Requirement no. 2.

The bidders / association leadersyesterday or associates, the subcontractors or third parties supporting the bidder do not have as members in the board of directors / management or supervisory body and / or shareholders or associates persons who are husband / wife, relative or affiliate up to the fourth degree including in the framework of the contracting authority or which is in commercial relations, as provided in art. 60 (a) of Law 98/2016, with persons holding decision-making functions within the contracting authority.

Inin case the tenderer represents an association, his offer being ranked on the first place in the intermediate ranking, the agreement or a letter of association will be presented, in the legalized form in which it is mentioned that all the associates assume the responsibility according to the implication quota for the fulfillment of the contract and that the leader of the association is empowered to undertake and receive instructions ion behalf of all the associates and is responsible on its own behalf and on behalf of the association for the performance of the contract.

In the case of subcontracting, the tenderer must declare within the offer the part / parts of the contract to be subcontracted and the identification data of the proposed subcontractors. The proposed subcontractors must comply with the same obligations as the bidders, in the field of environment, social and labor relations, established by the legislation adopted at the level of the European Union, the national legislation, by collective agreements or by international treaties and agreements in these fields, provided in the award documentation.

The established participation requirements are not applicable subcontractors proposed by the tenderer within the tender, but capacitythe technical and professional nature of the proposed subcontractors will be considered for their part of involvement in the contract to be fulfilled, if the documents presented by the tenderer are relevant in this regard.

The method of fulfillment: within the deadline for submission of tenders the DUAE will be submitted.

The supporting document proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by ONRC or, in the case of the foreign legal / natural persons bidders, the equivalent documents issued in the country ofresidence, translated into Romanian, will be presented, at the request of the contracting authority, only by the bidder ranked on the first place in the intermediate ranking drawn up at the end of the evaluation of the bids.

In case parts of the contract will be executed by the subcontractors, registration and correspondence of the main / secondary activities within it with obthe contract will be submitted by the subcontractors, for the part of the contract that they will perform. bidders ranked on the first place to submit new financial proposals in SEAP.

Bidders / sand the contracting parties / third parties will complete and sign with the extended electronic signature based on a qualified certificate issued by an accredited certification service provider, all the documents transmitted in SEAP, including the clarification requests or the answers to the clarification requests. The correspondence and identification data of the economic operators (address, telephone, fax, e-mail, fiscal identification code) will be recorded in the DUAE. In case the bidder cannot be contacted for completing the formalitylegal rules regarding the conduct of the public procurement procedure, the responsibility for the consequences that derive from it belongs entirely to it. section of the financial proposal because they will not be evaluated.

In preparationof the present procedure, the contracting authority made an estimate of the type and quantities of consumables and reagents needed in the high performance scientific research activities carried out within the Diabeter project. However, it is well-known that during the course of the research, depending on the preliminary results obtained, it may be necessary to change the strategyi / approach of the researcher with regard to the direction of action, this change being able to help the researcher in the implementation of the next stage of the research. the contract, the possible changes generated by the change of strategy / approach in the activity of earringsstrongly developed represent circumstances that cannot be anticipated / foreseen at this moment by the contracting authority due to the unpredictable nature of the evolution / course of the research stages to be performed, but these will not affect the general character of the contract.

Given the above, the contracting authority estimates a possible supplement to the quantities contained in cthe order of the lots of products that are the subject of the present procedure. Supplementation of the quantities of products included in the contract awarded will be made pursuant to art. 221 of Law no. 98/2016, only if the respective products prove to be strictly necessary to ensure the continuity of the scientific experiments in the desired direction and to maximize the results of the scientific research and conthe statement of the existence of the financial resources allocated to this destination. The unit price of the supplemented products is the one included in the offer of the supplier to whom the contract was awarded. The unit price cannot be modified during the contract.
