Initially, DEAU will be completed, according to art. 193 of Law no. 98/2016, by the tenderers to the award procedure, including third-party supporters and subcontractors, with the information relating to their situation as the first proof of non-compliance with the exclusion and the capacity requirements.and / or the subcontractor will submit the F8 form "Statement on non-compliance with the provisions of art. 60 of Law 98/2016 "with the completion of this requirement and in DEAU. The declaration will be submitted by all participants in the procedure (economic operator who submits the offer individually or in association, subcontractor or third party) with DEAU, until date and time limit d- Note: The decision-makers of the contracting authority are:

- Administrative Technical Manager - Ion Gramada. to prove the fulfillment of the undertaken by completing the DEAU at the moment of submitting the tenders, to be submitted at the requestto the contracting authority, only by the tenderer ranked first after applying the award criterion to the admissible tenders. These are: - - Fiscal attestation regarding the fulfillment of the obligations to pay local taxes and fees and other local budget revenues, certifying the absence of overdue debts at the time of presentation, - - Fiscal attestation certificateon the fulfillment of the obligations to pay the taxes, social security taxes and social security contributions to the general consolidated budget, certifying the lack of overdue debts at the moment of presentation,

- The judicial record of the economic operator and, upon request, the members of the management, or oversight of that economic operator or, upon request, of those who-have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document,

- On request, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016,

- Other editing documents, as appropriate.

Will be deposited, -together with the DUAE, the following documents: the firm's firm commitment to the third party, resulting in the effective manner in which its support, subcontracting agreement and / or association agreement will materialize, as the case may be. Failure to do so with the DUAE is a basis for requesting clarification of any inaccurate form of information contained in the DUAE sections, t of the tenderer / candidate and of the subcontractor / third party, this being necessary to ensure the proper conduct of the award procedure.

We are looking for economic operators: they will use the editable version of DEAU, made available by I.N.C.D. ECOIND and will have the right to fill in the required information, not having the right to intervene on the format of the document and on the requirements checked by the contracting authority. We warn the economic operators of the obligation to deposit DEAU with the offer, under the sanction of its rejection as unacceptable, according to art. 137 par. (2) lit. b) from H.G. no. 395 / 2016.
