The Contracting Authority will respond to clarifications on the 10th day before the deadline for submission of tenders.
The participation guarantee is 146 571 RON, as follows:
- lot 1 - 13 170 RON,
- lot 2 - 1 126 RON,
- lot 3 - 13 339 RON,
- lot 4 - 16 540 RON,
- lot 5 - 102 396 RON.
Validity period of the guarantee for participation: 120 days from termthe limit for receiving the offer. How to set up the participation guarantee: The guarantee for participation is constituted according to the provisions of art. 36 of HG 395/2016. Other legal settlement documents are accepted, which ensure the collection of the guarantee for participation, respectively the receipt issued by U.P.B. "Polytechnic University of Bucharest", where the value of the guarantee-participation is less than RON 5, 000.00. U.P.B. "Politehnica University of Bucharest", where the guarantee for participation is filed: RO36TREZ7065005X000114, opened at the Treasury Sector 6. Proof of the constitution shall be submitted in SEAP, electronically signed no later than the deadline / date set for submitting tenders, point 7 of GD No. 395/2016, with clarificationthe possible inconsistencies regarding the form, the amount and the validity of the participation guarantee, within 3 working days from the deadline for submitting the offers, according to art. 132, paragraph 3 of H.G. no. 395/2016. The performance guarantee for the contract is 10% of the value of the contract, without VAT and is constituted by any of the forms of art. 40 of the Decision no. 395/2016 of 2 June 2016 for the approval of the Methodological Norms for the application of the provisions regarding the award of the public procurement contract / the framework agreement of Law no. 98/2016 on public procurement. The guarantee of good execution is within a maximum of 5 working days from signing the contract by both parties

1) Bidders, third parties and subcontractors should not find themselves in the situations provided by art. 164, 165, 167 of Law no. 98/2016. The way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of cassumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer ranked 1st in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be: certificates of absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (budgetlocal, state budget, etc.), valid at the time of presentation. The following documents will be filed together with the DUAE: the firm's firm commitment of the third party to support the manner in which its sustainability, subcontracting agreement and / or association agreement will materialize, as the case may be. Failure to do so with the DUAE is the basis for requesting clarifications for-any inadvertent form of information contained in the DUAE sections of both the bidder and the subcontractor / third party, which is necessary to ensure the proper conduct of the award procedure; 2) the judicial record of the economic operator and the members the management, management or supervisory body concernedhis economic operator, or those who have power of representation, decision or control within him, as it results from the certifying certificate issued by the ONRC / memorandum of association, valid at the time of presentation. The DUAE will be completed and the supporting documents demonstrating the assumed by the DUAE will be submitted only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the tender evaluation at the request of the authority contractante. When submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. Documents issued in a language other than Romanian must be accompanied by an authorized translation into Romanian.
