The goal of the task is to increasenot reliability and ensuring trouble-free operation of 6 kV motors of the following devices installed in Gdynia Heat and Power Plant - ONC1 and OPS4 network pumps.

The subject of the order is:

1. Replacement with a new 6kV engine for the ONC1 network water pump at EC Gdynia

2. Replacement with a new 6kV engine for the OPS4 network water pump at EC Gdynia

1 The Contractor may participate in this Procedure, which:

1.1. Noare subject to exclusion, in accordance with points 1.2 - 1.5

1.2. They meet the conditions for participation in the Procedure, in accordance with item III 1.3

2. Contractors may participate in the Proceeding, for which there are no grounds for exclusion from the Procedure under Art. 24 sec. 1 point 12 23 of the Public Procurement Law, subject to art. 133 ust. 4 of the Public Procurement Law, and are not subject to exclusion pursuant to art. 24 sec. 5 points 1 2, 4 and 8 of the PZ ActP. Exclusion takes place in the cases specified in art. 24 sec. 7 of the PPL Act.

3 Contractor who is subject to exclusion pursuant to art. 24 sec. 1 point 13 and 14 and 16 20 or par. 5 point 1 2 and 8 of the Public Procurement Law Act, may submit with the Bid evidence that the measures taken by him are sufficient to demonstrate its fairness, in accordance with art. 24 sec. 8 of the PPL Act.

4 The Contractor is not subject to exclusion, if the Ordering Party, considering the weight and special circumstances of the Contractor's action, deems sufficient evidence provided by the Contractor under item 1.3.

5 In cases referred to in art. 24 sec. 1 point 19 of the Public Procurement Law, before the Contractor is excluded, the Employer will provide the Contractor with the opportunity to prove that his participation in the preparation of the Procurement Procedure will not disrupt• Ordering party prior to the awarding of the Order, will call the Contractor whose Offer has been rated the highest, to submit within the prescribed, not shorter than 10 days, the date of the following documents:

1 Information from the National Criminal Register, to the extent specified in art. 24 sec. 1 point 13 of the Public Procurement Law, subject to art. 133 ust. 4 of the Public Procurement Law (according to point 17.5.1.1 of the ToR), issued not earlier than nthat 6 months before the deadline for submitting Offers - 2 Information from the National Criminal Register, to the extent specified in art. 24 sec. 1 point 21 of the Public Procurement Law (according to point 17.5.1.2 of the ToR), issued not earlier than 6 months before the deadline for submission of Offers - 3. Certificates of the competent head of the Tax Office confirming that the Contractor is not in arrears with paying taxes, issued not in theless than 3 months before the deadline for submission of Offers (according to item 17.5.1.3 of the ToR).

4. The certificate of the relevant organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 monthsd the expiration of the deadline for submission of Offers (according to item 17.5.1.4 of the ToR).

5 A copy from the relevant register or from central records and business information, if separate regulations require an entry in the register or records, to confirm the absence of grounds for exclusion based on art. 24 sec. 5 point 1 of the Public Procurement Law.

6 Contractor's statements about the lack of issuing a final court judgment against him or hera final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of a verdict or decision confirming the payment of such claims together with any interest or fines or a binding agreement on repayment of such claims. Contractors about the lack of oto him as a preventive measure of a prohibition to apply for public orders.

8 Contractor's statements about non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges.

Ordering does not set specific requirements to meet this condition.

1. Proceedings are conducted in the unlimited tender procedureon the basis of art. 39 in conjunction from Article 134 para. 1 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2018, item 1986 as amended), hereinafter referred to as "Pzp".

2. The Employer envisages using, pursuant to Article 24aa of the PPL., the so-called reverse procedure (ie in the first place will evaluate the offers, and then examine whether the Contractor whose offer was evaluated as the most advantageous not forega exclusion and meets the conditions for participation in the Procedure).

4. The Contracting Authority allows the possibility of amending the Agreement on public procurement on the terms specified in the template of the Agreement constituting Annex No. 2 to the ToR.

5. The Contracting Authority informs that in pwhen the Contractor is established or resides outside the territory of the Republic of Poland, instead of the documents referred to in: - a) points 17.5.1.1 - 17.5.1.2. The ToR shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor is established or domiciledor the place of residence has a person who is concerned with information or a document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 PPL, b) paragraphs 17.5.1.3 - 17.5.1.5. The ToR shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that: - it is not in arrears with paying taxes, fees, social security or health insurance contributionsor that it has entered into an agreement with the competent authority regarding the repayment of such claims together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or withholding in full the decision of the competent authority, - its liquidation has not been opened or bankruptcy was announced.

6. Documents referred to in point 17.5.3and point 17.5.4.2 of the ToR, should be issued not earlier than 6 months before the deadline for submission of Offers. The document referred to in point 17.5.4.1 of the ToR should be issued not earlier than 3 months before the deadline. In the scope not specified in points 5-6 above and in the scope of documents (and their form) confirming the fulfillment of the conditions for participation in the application proceduree have the provisions of the Ordinance of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the proceedings for the award of the contract (Journal of Laws item 1126). For values indicated by the Contractor in a currency other than the Polish zloty (PLN), the Employer will accept the conversion rate according to the average exchange rate of the National Bank of Poland (NBP) on the day of publication of the Announcementon the Contract in the Official Journal of the European Union.

9. Before the deadline for submission of tenders, the Contractor may make a local inspection to examine the subject of the Contract and its surroundings and to obtain, on its own and on its own responsibility, all information that may be necessary to prepare the Offer and conclude the Agreement. The costs of the local vision are borne by the Bidder itself
