Purchase of 110 kV single-phase oil pressure electric cables for E-Distribuţie Muntenia SA, E-Distribuție Dobrogea SA

Main Site: Warehouse Muntenia, Dobrogea: Ilfov county, Soseaua de Centura no. 220, North East Logistics Park.

Single-phase electric cables with oil pressure for 110 kV for E-Distributie Muntenia S.A., E-Distributie Dobrogea S.A.

Framework agreement: cant. min. 1 700 pcs., Quantity maximum 6, 600 pcs.

Quantities that could be subject to a single subsequent contract: cant. min. 450 pcs .; edge. maximum 2, 450 pcs.

The estimated value of the largest subsequent contract is 1 911 196, 00 RON excluding VAT.

A. The bidders (including the associations, the third party supporters and the declared subcontractors) must not find themselves in the situations provided in art. 177, 178, 180 of Law no. 99/2016 regarding sectoral acquisitions;

B. Bidders (including associations, third party supporters and declared subcontractors) should not find themselves in potentially conflict-of-interest situations.that provided in art. 73 of Law 99/2016, regarding the sectoral acquisitions.

The way in which the above requirements can be demonstrated: the DUAE will be required to be completed by the participating economic operators in the present award procedure (bidders / associates / third-party supporters / subcontractors declare each one of you must complete a separate DUAE) with inf

the DUAE will be transmitted in electronic format until the date and time of submission of the offers stipulated in the participation announcement. contracting [according to art. 205 para. (1) of Law 99/2016, ANAP Notification 245 of 1.9.2016)

These documents can be:

1) certificates certifying the lack of outstanding debts, regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.), at the time of presentation; 2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective operationor those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

3) as the case may be, documents demonstrating that the economic operator can benefit of the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on sectoral procurement;

4)other documents, as the case may be;

5) for point B, a declaration will be presented on its own responsibility, which will be completed by bidders / associates / third-party supporters / subcontractors, each according to the related situation, model that can be used, in the section " Documents, Forms "Form F7, to be submitted with the DUAE.

Foreign legal / natural persons wishing to participate in the presentthe procedure, will present any documents considered edifying in the country in which they are resident, such as certifying certificates, judicial records or other equivalent documents issued by the competent authorities of the country in which they are resident, accompanied by an authorized translation into Romanian.

Documents must prove that the above requirements are met at the timeduring their presentation.

The DUAE will be compulsorily completed by the economic operators participating in the present award procedure (bidders / associates / third party supporters / subcontractors declared each will compulsorily complete a separate DUAE), with the information related to their situation.

The supporting documents proving the fulfillment of those assumed by completing the DUAE, tracesaza to be presented, only at the request of the contracting entity [according to art. 205 para. (1) of Law 99/2016, in conjunction with art. 138 paragraph (2) of GD 394/2016, ANAP Notifications 245 of 1.9.2016].

Exception: documents to be submitted with DUAE:

- if applicable, those mentioned in section III.1.3.a). "Technical and / or professional capacity" and section III.1.4) "Rules and criteria of objective participation ", of this document, the firm commitment of the supporting third party from which results the effective way in which its support will materialize, the subcontracting agreement and / or the association agreement, as the case may be,

- the document mentioned in section III.1.6. a) "Guarantee of participation in the auction".

Specify the average annual turnover. The average of the global turnover for the last 3 years (2016, 2017, 2018), to the extent that the respective information is available, must be at least 1 000 000 RON. It is left to the economic operator to choose the documents that will be presented in support of fulfilling the qualification requirement mentioned above.tea, according to art. 190 of Law no. 99 / 2016.

Annual average turnover. The average global turnover for the last 3 years (2016, 2017, 2018) as far as the respective information is available, must be at least 1 000 000 RON. It is left to the economic operator to choose the documents that will be presented in support of meeting the above mentioned qualification requirementand, pursuant to art. 190 of Law no. 99 / 2016.

All the award documentation is available in the new SICAP system https://sicap-prod.e-licitatie.ro/pub and is attached to the participation announcement.

To view the award documentation uploaded in SICAP, the economic operators must to have installed a program necessary to view the electronically signed files, this program being availableon the websites of electronic signature providers.

Possible clarifications to the award documentation are submitted online in SICAP.

Responses to any clarifications to the award documentation will be attached to the participation announcement. 22 paragraph (6) of the GD 394/2016 the way of completing the DUAE will be done according to the notification of ANAP no. 240/2016. An economic operator that participates on its own and does not rely on the capabilities of other entities to meet the criteria of qualification and selection, will complete a single DUAE.

An econo operatorA small participant who participates on his own, but is based on the capacities of one or more other entities (third party supporters / subcontractors) is responsible for submitting his / her own DUAE within the procedure, as well as a separate DUAE for each of the entities on which it is Also, if the groups of economic operators, including temporary associations, ptogether with the sectoral procurement procedure, a separate DUAE containing the information required in parts II-V must be presented, for each of the economic operators participating in the group.

The contracting entity has the right to exclude from the procedure for awarding any contracts bidder who did not fulfill or defective athe contractual relations with ENEL, for reasons attributable to the tenderer in question, which produced or is likely to cause serious harm to its beneficiaries [Law 99/2016 art. 180 lit. g)].

The economic operators, when submitting the offer in the procedure, will take into account the provisions of art. 53, 54 of the GD no. 394 / 2016.

According to ANAP Notification 240/2016, the minimum period during whichthe bidder must keep his bid: 120 days from the deadline for submission of bids. All documents issued in a language other than Romanian will be accompanied by their authorized translation into Romanian.
