Free admission for preschoolers in kindergartens with a normal 4 hours authorized / accredited and private accredited state program and for students from primary and secondary state and private secondary schools bakery products within the limits of a daily / preschool / student value in the school years 2019-2020, 2020-2021, 2021-2022, 2022-2023.

The daily value limit includes the full purchase price of the products, including value added tax, their transportation, distribution and storage costs, as the case may be.

Estimates of the minimum and maximum quantities that would could be requested during the entire framework agreement:

Minimum quantity = 23, 874, 072 pieces;

Maximum quantity = 24, 290, 592 pieces

Wave. estimated without VAT of the framework agreement:

Val. minimum = RON 12, 383, 481;

Val. maximum = 12, 599, 530 lei

Frequency and wave. Subsequent contracts to be awarded:

The framework agreement will include 1 (one) sub-contract per school year, and for the entire 4-year framework agreement 4 sub-contracts will be awarded.

Estimates of minimum and maximum quantities which could be objectionablethe ect of a single subsequent contract of the following to be awarded during the framework agreement:

Minimum quantity = 5, 968, 518 pieces;

Maximum quantity = 6, 072, 648 pieces

Val. estimated without VAT which could be the subject of a single subsequent contract of the following to be awarded during the framework agreement:

Maximum value = 3, 149, 883 RON.

Cthe antities will be updated according to the presence at the courses of the beneficiaries of products by category of students from schools and kindergartens. 164 of Law 98 / 2016.

The bidder (associations in the case of joint bids, subcontractors in the case of subcontracting and third parties in the case of support), must demonstrate thatdoes not fall within the provisions of art. 164 of Law 98/2016. The aforementioned obligation also applies to the members of the administrative, management or supervisory bodies of the respective economic operators or to the persons who have power of representation, decision or control within them.

Confirmation documents

D.U.A.E. of which it must result framedit in the provisions of art. 164 of Law 98/2016. In this respect, the tenderer (associations in the case of joint tenders, subcontractors in the case of subcontracting and third parties in the case of support), will complete the D.U.A.E. appropriately.

According to the provisions of art. 196 paragraph (2) of Law 98/2016, before awarding the contract, the buyer will request the tenderer ranked first, for the application of the award criterion, to present updated supporting documents demonstrating that it does not comply with the provisions of art. 164 of Law 98/2016. Thus, updated supporting documents will be submitted as: Certificates confirming issued by O.R.C.; Legal cases of the bidders and of the persons mentioned in art. 164 para. (2) of Law 98/2016; Anything elseit is equivalent edifying documents.

Exceptions from the application of art. 164 of Law 98 / 2016.

According to art. 171 para. (1) - (2) of Law 98/2016, any economic operator in any of the situations provided in art. 164 may provide evidence to demonstrate its credibility in concrete terms with regard to the reasons for exclusion. If the evidence presented is sufficient for the demonstration in coIn the absence of credibility, the purchaser will not exclude him from the procedure. 165 of Law 98 / 2016.

According to the provisions of art. 196 paragraph (2) of Law 98/2016, before awarding the contract, the buyer will ask the tendererranked first after applying the award criterion to present updated supporting documents demonstrating the fulfillment of the requirement. Thus, updated supporting documents will be submitted such as: Certificates of fiscal attestation regarding the fulfillment of the obligations of payment of taxes, taxes or contributions to the general budget; Certificates of attestation regarding the paymentlocal taxes and fees; Any other equivalent edifying documents.

Exceptions from the application of art. 165 of Law 98 / 2016.

According to the provisions of art. 165 para. (3) of Law 98/2016, the economic operator is not excluded from the procedure if, before the exclusion decision, he fulfills his obligations by paying taxes, taxes or contributions to the general consolidated budget due orby other means of extinguishing them or they benefit, according to the law, from their staggering or other facilities for their payment, including, as the case may be, any accrued interest or late payment penalties or fines.

Given that the contracting authority will sign the framework agreement only with the economic operators place on the I, II, III place, as the case may be, the way of dividing the offers with equal scores will be done as follows:

1. In case the commission finds that they were filed / intrSEUS more than 2 admissible offers with equal scores to the bidders ranked on the 1st place, the contracting authority will request the submission of new improved financial proposals (by 2 decimal places), and the

Economic operators will send their answer in a closed envelope, in which case the framework agreement will be awarded to the first 3 bidders who have the highest scores.

2. If the commission coonce more than 2 admissible offers with equal scores have been submitted by the bidders ranked on the second place, the way of dividing them will be done by requesting the submission in closed envelope of new improved financial proposals (by 2 decimal places), and the economic operators will send their answer, so that the bidder ranked in the first place is not affected, respectively the new proposal fnot to be equal to or lower than the offer ranked in the first place. If the new improved financial proposal following the request of the contracting authority, will influence the ranking of the higher places, this will not be taken into account, keeping the initial bid submitted in SEAP, at the procedure.

3. If the commission finds that more than 2 bids have been submitted admisibles with equal scores by the bidders ranked on the third place, the way of dividing them will be done by requesting the submission in closed envelope, of a new improved financial proposal (by 2

Decimals), and the economic operators will send their answer, so that the bidders ranked on the 1st and 2nd place will not be affected, respectively the new financial proposal will not be equal or morelower than the offer ranked on the first place, respectively II. Improved presented as a result of the request of the contracting authority will influence the ranking of places I and II, this will not be considered, keeping the initial offer submitted in SEAP, at the procedure. Without prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information, with subsequent amendments and completions, the economic operator will specify in the submitted offer those information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by a property right intelection to the extent that, objectively, the disclosure of this information would harm the legitimate interests of the economic operator, especially with regard to trade secret and intellectual property.
