35 par. (3) lit. a) from H.G. 395/2016 in a maximum of 1% per each product for which the tender is submitted (according to the eighth chapter of the tender specifications). The participation guarantee can be lodged:
- by bank transfer,
- pria guarantee instrument issued by an insurance company, - at the headquarters of the cash contracting authority, - in the treasury account IBAN RO11TREZ7015005X000195, Treasury Sector 1 Bucharest,
- by bank guarantee letter.
The period of validity of the participation guarantee is 90 days from the deadline for receipt of tenders. The contracting authority has the obligation-to retain the participation guarantee when the bidder is in any of the situations provided for in art. 37 of HG395 / 2016. The participation guarantee, constituted by the tenderers whose bid has not been established, shall be returned by the contracting authority after the signature of the public procurement / framework agreement with the tenderer / tenderers whose offers were frequentwinning but not later than three working days from the date of signing the public procurement / framework agreement with the winning bidder.
The participation guarantee, constituted by the bidder whose bid has been established as winning, is returned by the winning bidder. to the contracting authority within a maximum of three working days from the date of signature of the framework agreement / contractIU. cf art. 38 para. 2 of HG395 / 2016.
How to create and express the guarantee of good execution, according to art. 40 of H.G. 395/2016 in the amount of maximum 10% of the value of the contract in RON, without VAT. The guarantee of good execution is constituted by a guarantee instrument issued under the conditions of the law by a bank or an insurance company or by depositing at the cash desk of the co-ntractante. The guarantee of good execution is made within five working days from the date of signing the public procurement contract / the subsequent contract. This will be valid for the entire duration of the contract, plus 14 days from the expiration date of the contract. The guarantee will be released within 14 days of payment of the final invoice, cf. art. 42 of HG 395/2016. If, on the hairthe course of performance of the public procurement contract is supplemented by the value of the contract, the contractor has the obligation to complete the performance guarantee in correlation with the new value of the public acquisition contact.
The state budget
1) The bidders, the supporting third parties and the subcontractors must not finds in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016;

(2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be.
2) Statement regarding the non-compliance in the situations stipulated in art. 60 par. (1) of the Law no. 98/2016 on public procurement (avoidance of conflict of interest).
The declaration will be submitted by the participants to the procedure (tenderer, associate, subcontractor, third party) with DUAE by the deadline for submission of tenders.
For this statement, the persons holding decision-making positions within the authority regarding the organization, conduct and completion of the awarding procedure within the meaning of the article are the following:

Qualify for the procedureeconomic operators who prove that they have in the field of activity the production or marketing of agri-food products.
The certificate of the issued by the National Trade Register Office shall show the object of activity of the respective economic operator. The subject of the contract must have a correspondent in the CAEN code of the certifying certificate issued by the ONRC.-could present in original, legible copy or legalized copy at the request of AC by the tenderers placed on the first three places after the final stage of the electronic auction. AC accepts at the time of submission of the participation requests or offers of the DUAE, and before the conclusion of the framework agreement, the bidders placed on the first three places after the final tender stage(the certificate issued by the ONRC or foreign economic operators, equivalent documents) demonstrating that all the qualification criteria are met, according to the information contained in the DUAE.
