The subject of the contract is the preparation of project-estimate documentationand technical specifications for the performance and acceptance of construction works for "Construction of a road section in Topolowa Street in Myszk-w together with the construction of a rainwater drainage system" as part of the investment task: "Completing the construction of the Topolowa and Ceramic Road (from No. 12E to Malinowa Street)" and Copyright supervision.

1. The subject of the order is execution ddesign-cost documentation and technical specifications for the performance and acceptance of construction works for "Construction of a road section in Topolowa Street in Myszk-w together with the construction of a rainwater drainage system" as part of the investment task: "Completing the construction of the Topolowa and Ceramic Road (from No. 12E to Malinowa St. ) "and exercising author's supervision.
2. The subject of the order consists of:
1) Performnot complete design and cost documentation, as well as technical specifications for the performance and acceptance of construction works;
2) Obtaining all industry agreements, permits, opinions and administrative decisions necessary to obtain the building permit and building permit pursuant to the Act of 7.7. 1994 Construction Law (Journal of Laws of 2019, item 1186, laterd) The subject of the order is described in detail in Annex 1 to the ToR, detailed description of the subject of the order.
4. In connection with art. 30 paragraph 9 of the Public Procurement LawThe Contractor requires the Contractor to develop design documentation and technical specifications for the performance of the acceptance of construction works, taking into account the needs of all users of the designed road, while ensuring accessibility of the road for disabled persons, in accordance with applicable provisions, in particular the Building Law and the Act on public roads, and implementing regulationsissued on the basis of these settings.

7. The Awarding Entity does not allow:
1) submission of variants,
2) submission of offerst partial.
8. The contracting authority does not provide:
1) conclusion of a framework agreement;
2) establishment of a dynamic purchasing system;
3) selection of the best bid using electronic auction;
4) settlement in a currency other than PLN.
9. The Employer does not reserve the Contractor's personal performance of key parts of the contract.
10. The Employer requests the Contractor to indicate parts of the contractwhich it intends to entrust to subcontractors and the submission of subcontractors by the Contractor.
11. The contracting authority requires that the offer indicate the person / persons designated to perform the contract, possessing building qualifications to design in the road engineering specialty without restrictions or to a limited extent within the meaning of the Act of 7.7.1994 Construction Law (i.e.019 item 1186 from late as amended) and the Ordinance of the Minister of Investment and Development of 29.4.2019 on professional preparation for performing independent technical functions in construction (Journal of Laws of 2019, item 831) or corresponding rights acquired on the basis of previously binding provisions, if the newer provisions have not repealed the validity of these rights, or corresponding to urights acquired outside of Poland and recognized on the basis of the provisions of the Act of 22.12.2015 on the principles of recognition of professional qualifications acquired in the Member States of the European Union (i.e. Journal of Laws of 2018, item 2272, as amended), which will personally carry out the construction project and demonstrate their experience on offer.
12. Required data regarding the indicated persons / persons andtheir experience, the Contractor provides in the offer form Annex 2 to the ToR.
1. By entering this procedure, each Contractor is obliged to lodge a security deposit of PLN 1, 000.00 (say: one thousand zlotys 00/100).
2. The Contractor is obliged to make a deposit before the deadline for submission of bids for the period of at least being bound by the offer referred to in Chapter 9 of the SETC.
3. Contractor mmay lodge a security in one or more of the forms provided for in Article 45 item 6 of the Public Procurement Law, i.e. ) sureties granted by entities referred to in art. 6 b paragraph 5 pkt 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development
(i.e., Journal of Laws of 2019, item 310, as amended).
4. From the content of the guarantees and sureties referred to in art. 45 item 6 item 2 5 of the Public Procurement Law, must result from:
1) securing the offer of the Contractor submitted in the procedure for awarding a public contract in an open tender for the preparation of project documentationcost estimate and technical specifications for the performance and acceptance of construction works for "Construction of a road section in Topolowa Street in Myszk-w together with the construction of a rainwater drainage system" as part of the investment task: "Completion of the construction of Topolowa and Ceramiczna Road (from No. 12E to Malinowa Street) "and exercising author's supervision reference number of the procedure: ZP.271.43.2019.JG,
2) designation withassociated as the Contractor (requesting the issue of a bid bond),
3) designation of the Employer as the beneficiary of the bid security,
4) designation of the guarantor as the entity granting the bid security,
5) name of the public procurement procedure,
6) guarantee sum,
7 ) the duration of the deposit guarantee,
8) unconditional, irrevocable and at the first written requestPurchaser, the guarantor's obligation to pay the Purchaser the amount specified in the guarantee or sureties:
a) if the Contractor whose offer was selected:
refusing to sign the public procurement contract on the terms specified in the offer,
concluding the public procurement becomes impossible for reasons attributable to the Contractor;
b) if the Contractor inreply to the call referred to in art. 26 section 3 and 3a of the PPL, for reasons attributable to him, will not submit declarations or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Public Procurement Law, statements referred to in art. 25a section 1 of the Public Procurement Law, powers of attorney or will not agree to correct a mistake referred to in art. 87 paragraph 2 point 3 of the PPL, which will result in bit is not possible to select the offer submitted by the Contractor as the most advantageous,
9) conditions for the payment of the guarantee sum, which should specify the form of the beneficiary's request and the place and date of its delivery in such a way that they do not impede the payment of the guarantee sum for the Employer,
10) provisions regarding the title warranty, place and date of issue.
5. The bid bond in non-monetary forms shouldbe submitted in the original, in electronic form (i.e. in such form and in the form in which the document was issued by the guarantor).
6. The bid bond in non-monetary forms is sent to the Employer only
