1. The subject of the order is the preparation of project-estimate documentation and specificstechnical implementation and acceptance of construction works for "Road construction in Rymarska Street" as part of the investment task: "Hardening the road in Rymarska Street" and exercising author's supervision.
2. The subject of the order consists of:
1) Preparation of complete project documentation - cost estimate and technical specifications for the execution and acceptance of construction works;
2) Preparation of completeego application for a decision on the permission to implement a road investment (ZRID) on the basis of the Act of 10 April 2003. on specific rules for the preparation and implementation of investments in the field of public roads
(i.e. Journal of Laws of 2018, item 1474, as amended), including obtaining all industry agreements, permits, opinions and administrative decisions necessary to obtain
Ww. decision;
3)Exercising author's supervision over the project documentation - cost estimate and technical specifications for the performance and acceptance of construction works during the implementation of construction works in the scope covered by these studies.
3. The subject of the order is described in detail in Annex 1 to the ToR, detailed description of the subject of the order.
4. In connection with art. 30 paragraph 9 of the Public Procurement Law, the Awarding Entity inrequires the Contractor to develop project documentation and technical specifications for the performance of the acceptance of construction works, taking into account the needs of all users of the designed road, while ensuring accessibility of the road for disabled persons, in accordance with applicable regulations, in particular the Building Law and the Act on public roads,
and implementing regulations issuedbased on these settings

7. The Awarding Entity does not allow:
1) submission of variant offers,
2) submission of tenders partiowych.
8. The contracting authority does not provide:
1) conclusion of a framework agreement;
2) establishment of a dynamic purchasing system;
3) selection of the best bid using electronic auction;
4) settlement in a currency other than Polish new zloty (PLN).
9. The Employer does not reserve the Contractor's personal performance of key parts of the contract.
10. The Employer requests an indication by the Contractorparts of the contract which it intends to entrust to subcontractors and the submission of subcontractors by the Contractor.
11. The Employer requests that the offer indicate the person / persons designated to carry out the contract, possessing building qualifications to design in the road engineering specialty without restrictions within the meaning of the Act of 7 July 1994
- Construction Law (Journal of Laws of 2019, item1186 from late as amended) and the Ordinance of the Minister of Investment and Development on professional preparation for performing independent technical functions in construction of 29 April 2019 (Journal of Laws of 2019, item 831) or the corresponding rights acquired on the basis of previously binding provisions, if the newer provisions have not repealed the validity of these rights, or the corresponding cropsproperty acquired outside of Poland and recognized on the basis of the provisions of the Act of 22 December 2015 on the principles of recognition of professional qualifications acquired in the Member States of the European Union (i.e. Journal of Laws of 2018, item 2272, as amended), which will personally carry out the construction project and demonstrate their experience on offer.
12. Required data regarding the indicated persons / persons andtheir experience, the Contractor provides in the offer form Annex 2 to the ToR.
1. By entering this procedure, each Contractor is obliged to lodge a security deposit of PLN 800.00 (in words: eight hundred 00/100).
2. The Contractor is obliged to lodge a security deposit before the submission deadline
For at least the offer binding period referred to in chapter 9 of the SETC.
3. The contractor mayTo carry the bid bond in one or several forms provided for in art. 45 item 6 of the Public Procurement Law, i.e. ) sureties granted by entities referred to in art. 6 b paragraph 5 point 2tawy

4. From the content of the guarantees and sureties referred to in art. 45 item 6 items 2-5 of the Public Procurement Law, must result from:
1) securing the offer of the Contractor submitted in the procedure for awarding a public contract in an open tender to prepare project documentationo
- cost estimate and technical specifications for the performance and acceptance of construction works for "Road construction in Rymarska street" as part of the investment task

8) unconditional, irrevocable and for the first time written request of the Ordering Party, undertaking of the guarantor to pay to the Ordering Party the amount specified in the warrantyoption or sureties:
a) if the Contractor whose offer was selected:
- refusal to sign the public procurement contract on the terms specified in the offer,
- the conclusion of the public procurement contract becomes impossible for reasons attributable to the Contractor;
b ) if the Contractor in response to the call referred to in art. 26 section 3 and 3a of the Public Procurement Law, for reasons attributable toabout his side, he will not make statements or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Public Procurement Law, statements referred to in art. 25a section 1 of the Public Procurement Law, power of attorney or will not agree
To correct the mistake referred to in art. 87 paragraph 2 point 3 of the PPL, which will make it impossible to select the bid submitted by the contractor as the most advantageous;
9) conditionspayments of the guarantee sum, which should specify the form of the beneficiary's request and the place and date of its delivery in such a way that they do not impede the payment of the guarantee sum for the Ordering Party;
10) records regarding the title of the guarantee, place and date of issue.
5. The bid bond in non-monetary forms should be brought in the original in an electronic form (i.e. in such form and form ash the document was issued by the guarantor).
6. The bid bond in non-monetary forms is sent to the Employer only
