1) The bidders, third parties and subcontractors must not find themselves in the situations stipulated in art. 58 60 of Law no. 98/2016. The contracting authority has the obligation to exclude from the award procedure the tenderers, the supporting third parties and the subcontractors who find themselves in the situations stipulated in art. 58 60of Law no. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: it will be completed by all economic operators participating in the award procedure with the information related to their situation. Tenders submitted by all economic operators have the obligation to be accompanied by the DUAE form, under the sanction of rejection of the latter, as unacceptable.m art. 137 par. (2) lit. b) from H.G. 395/2016. The bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 164, 165 and 167 of Law no. 98/2016. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the bidder ranked first in theintermediate brochure prepared to complete bid evaluation. These documents may be: certificates of absence of overdue debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of submission.

The judicial record of the economic operator and the members of the body administration, leadershipsurveillance or control of the economic operator, or those having the power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act. Where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Art. 166 paragraph (2), art. 167 par. (2), art. 171 of the Law98/2016 regarding the public procurement.

The winning bid will be awarded with the highest number of points achieved by adding the points for each evaluation factor.

In the case of 2 or more offers with equal score, but different price, it will be declared the winner with the lowest price.

In the existing casethey have 2 or more offers with equal scoring and offers of equal price, the tender will be chosen with the shorter delivery period.

In the case of 2 or more equal-ranked offers, equal offers and equal delivery queues, the tender with the longest warranty period will be chosen.
