The object of the contract is the supply of liquid fuelsand lubricants, for the movement of vehicles and work equipment and the supply of heating oil, to meet the needs of the Municipality of Thermaikos and its legal persons (Primary and Secondary Schools, DIPAPA And 2 years from the signing of the contract or until the contractual amount has been used, according to the study No. 3/2018, of the Clean and Recycle Directorate

Participation guarantee:

Each tender will be accompanied by a participation guarantee in favor of the participant for an amount that will cover 1% of the procurement budget excluding VAT, separately for each team in the competition for which the offer is given. The letters of guarantee on the blocking penalty will beonly a minimum of 270 days, ie at least 1 additional month, from the validity of the tenders, counted from the day following the closing date for the submission of tenders. Tenders without warranty or without the appropriate warranty, are rejected as unacceptable and are disregarded. In particular, for each competition team, the participation guarantee has-as follows:

A1 Guarantee amount: EUR 5 645, 73

A2 Guarantee amount: EUR 2 285, 20 B1 Guarantee amount: EUR 96, 56 B2 Guarantee amount: EUR 63, 04.

C amount of the guarantee: EUR 220, 64.

D amount of the guarantee: EUR 3 152, 00.- Guarantee amount: EUR 2 679, 20.

Guarantee amount: EUR 588, 93.

The amount of the guarantee: 18, 80 EUR.

Performance guarantee:

For the signing of the contract, in accordance with Article 72 (1) (b) of Law 4412/2016, amounting to 5% of the value of the contract of each group, excluding VAT, and deposited before or at the signing of the contract. The performance guarantee for the contract shall cover in its entirety and on a non-discriminatory basis the application of all the terms of the contract and any claim by the contracting authority against the contractof this kind. The performance guarantee is repaid in its entirety after definitive quantitative and qualitative acceptance of the subject matter of the contract.

Good quality guarantee:

The supplier, upon signing the contract, is required to guarantee the good quality of the delivered fuels and lubricants for 6 months, ie it will guarantee that the fuel or lubricants it supplies will be all-of high quality, free from any hidden defect, which concerns their adulteration. They will be ready for the use and operation for which they are intended.

The time for the guarantee of the materials to be procured will be determined in the tenders of the tenderers (Annex III) of the declaration. This time may not be less than 6 months and will begin on the day of signing-of the contract. The contractor, with the submission of his offer, declares for the good quality of the supplied species, for at least 6 months.

The financing for the above supply will be from the own resources of D. Thermaikos. The contractor's payment will be made in the following way:

a) 100% of the contractual value after the final delivery of the materials of the parcel delivery.the value of the item will be divided in proportion to the deliveries and the presentation of the legal documents (invoices) and supporting documents provided by the provisions of article 200 par. 4 of law 4412/2016, as well as any other supporting documents requested by the competent departments carrying out the check and payment and after the relevant protocol has been signedThe contractor is subject to all - according to the provisions in force - taxes, fees and deductions, which will be in force on the day of the competition

Accidents, damages, reservations, taxes are borne by the contractor and only by him, without any liability or liabilityThe discount rate of the offer will be fixed and unchanged throughout the term of the contract and will not be subject to any revision for any reason 5.1.2. The Contractor shall be liable for the third-party bookings, as well as any other charges, in accordance with the applicable legislation, excluding VAT, for the delivery of the material at the place and the manner in whichforeseen in the contract documents. In particular, it is charged with the following deductions: (a) a 0.06% reservation, calculated on the value of each pre-tax and deduction payment of the original, as well as any supplementary contract in favor of the Unified Independent Public Procurement Authority (Article 4 of Law 4013 / 2011 as applicable).

(B) a 0.02% holding in favor of the State, calculated on aVAT, the original, as well as any supplementary contract. This amount shall be deducted in respect of each payment by the contracting authority in the name and on behalf of the Directorate-General for Public Procurement and Procurement in accordance with paragraph 6 of Article 36 of Law 4412/2016.

(c) 0.06% is calculated on the value of each payment before taxes and deductions of the original, (Article 350 (3) of Law 4412/2016)

Pro-terrestrial bookings are subject to the applicable proportional stamp duty and to the OGA contribution in that case. the deduction provided for by the applicable legislation, with a value of 1% of the net amount.the process of concluding this contract, are required to engage in commercial, industrial or craft activity related to the subject matter of the procurement. Economic operators established in a Member State of the European Union are required to be registered in one of the professional or trade registers kept in their State of establishment or to satisfy any otherthe requirement is set out in Annex XI of Appendix A to Law 4412/2016. In the case of economic operators established in a Member State of the European Economic Area (EEA) or in third countries which have acceded to the SBS or in third countries not covered by the previous case and having concluded bilateral or multilateral agreements with the Union on procurement procedurescontracts are required to be registered in appropriate professional or trade registers. The economic operators established in Greece are required to be registered with the Chamber of Craftsmen or the Chamber of Commerce or Industry.

In order to save time and costs, it is imperative that the concessionaire of the teams containing motor fuels have a service station, which will not be more than 15 km from the seat of the Municipality of Thermaikos (Peraia Municipal Hall, 2 Alexander Alexandrou Street) according to study No. 03/2018 of the Department of Cleaning and Recycling, for. The reference to the distance of the service station from the seat of the Municipality of Thermaikos (Peraia Town Hall, Alexander 2, 570 19), refers to a radius and not a real distancewhich may be greater. It is stressed that since the Municipality of Thermaikou, during the period of the contract, acquires its own facilities with pumps and tanks in its own space, the supplier or suppliers are obliged to comply with the new situation and to supply the Municipality with the above installations, irrespective of the location in which they will beand without any additional financial burden or claim against the Municipality. Also, with regard to heating oil, it is stressed that, since the municipal buildings or the school buildings or the buildings of the NP. to the gas distribution network, then the above entities, without any charge or sanction at their expense, have the absolute right to absorb less or even zeroand the supplier or suppliers will not be entitled to claim any compensation to the municipality or its legal persons.
