The term of validity of the guarantee for participation: 90 days from the deadline for receipt of tenders, including the form of the guarantee of participation to be accepted. Guarantee instrument issued under the terms and conditions lby a bank or an insurance company.

1) The guarantee for participation constituted by the tenderer whose bid has been established as winning is returned by AC within 3 days at most2) The participation guarantee constituted by the tenderers whose offer has not been established the winner is returned by CA after the signing of the public procurement contract with the bidder / tenderers whose offers have been nominated winners, but not later than 3 business days from the date of signing the public acquisition contracta) 3) If the AC is, according to the provisions of art. 212 paragraph (1) or Art. 213 of the law, in the event of canceling the award procedure, the participation guarantee shall be restituted after the expiry date of the deadline for filing an appeal against this decision, but no later than 3 working days from that date; receiving the communication provided in art. 215 of the Law, Offeringthose whose offers have been declared unsuccessful have the right to obtain the issuance of the participation guarantee before the expiry of the period stipulated in paragraph (2) or paragraph (3) if they transmit a request to that effect. The RON-denomination equivalence at the NBR exchange rate will be 4 (four) days before the deadline for submitting bids.
The good execution guarantee is 10% of the valueof the subsequent contract for each lot, excluding VAT. The guarantee of good execution is made within 5 working days from the date of signing the public acquisition contract, according to art. 39 par. (3) of H.G. 395 / 2016.
The constitution of the participation guarantee is made according to art. 40 par. (1) of H.G. 395/2016:
(a) guarantee instrument issued under the law of a banking corporation,
(b)-or guarantee instrument issued under the law of an insurance company, (c) or successive payments in an account at the disposal of the purchaser, bank transfer. In this case, the performer has the obligation to open an account at the purchaser's disposal, at a bank agreed by both parties. Where the procurer has the status of public authority, public institution or economic operatorwith the full or majority state capital, the executor has the obligation to open to the State Treasury unit within the competent fiscal body in its administration a separate disposable account available to the purchaser. The initial amount to be deposited by the performer in the open balance account shall not be less than 0.5% of the contract price. During-the purchaser is to feed this available balance by successive deductions from the amounts owed and due to the contractor up to the amount set as a performance guarantee in the awarding documentation, (d) or bank transfer.
The bidders have the obligation to specify in the offer of the way of establishing the good execution guarantee
Local budget
1) The bidders, -third parties and subcontractors should not be found in the situations provided for in art. 164, 165 and 167 of Law no. 98/2016. The way to demonstrate compliance: the DUAE will be completed by the economic operators participating in the award procedure (including any third parties and subcontractors) with the information related to their situation. Documents justifThe documents that prove the fulfillment of the undertaken by completing the DUAE are to be presented, at the request of the contracting authority, only by the tenderer ranked in the first rank in the interim ranking made at the completion of the evaluation of the tenders.

DUAE can be accessed at the web address : https://ec.europa.eu/growth/tools-databases/espd/filterlang=en, where operators will load the xml document availablein SEAP for completion. Upon completion, it will be exported and uploaded to SEAP as part of its offer.
The DUAE document will be completed by each member of the association, including third parties or subcontractors. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, showing that the economic operator is a legal entitythat he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities that are the subject of the contract
Mode of accomplishment: the DUAE will be filled by the economic operators participating in the award procedure with information about their situation. The supporting documents proving the fulfillment of asummoned by the completion of the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be submitted, at the request of the Contracting Authority, only by the tenderer ranked 1st in the interim ranking evaluation of tenders.
The object of the contract must have a correspondent in cthe CAEN from the certificate issued by the Trade Register Office. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be presented, at the request of the contracting authority, only by the tenderer ranked on the 1st place in the intermediate rankings drawn up at the completion of the evaluation of the offers.
