Delivery, configuration and installation of 4 portable computers, under the conditions stipulated in the specifications. 1: Non-compliance with the situations stipulated in art. 164, 165 and 167 of Law 98/2016 on Public Procurement. The bidders / members of the association / subcontractors / third parties should not be foundin the situations stipulated in art. 164, 165 and 167 of Law 98/2016 on Public Procurement. The way to demonstrate the fulfillment of the requirement: The bidders / members of the association / subcontractors / supporters will complete the DUAE with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, valid at the timethe presentation (such as certificates attesting to the lack of overdue debts regarding the payment of taxes, taxes or contributions to the consolidated general budget (local budget, state budget, etc.), equivalent documents, for foreign economic operators, the criminal record of the economic operator and the members of the management, management or supervisory body of that bodyeconomic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on public procurement, precum and any other editorial documents, as the case may be) shall be submitted, at the request of the contracting authority, only by the tenderer ranked on the 1st rank in the interim ranking made when the tender evaluation is completed. 2: The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 58 63 of the Law no. 98/2016. Statement on-own responsibility for the lack of conflict of interest, completed in accordance with the model provided by the contracting authority in the Forms section, will be submitted by all tenderers with the DUAE. The offer is binding in content terms for the entire period of validity set by AC and assumed by bidder. The winning bid set by the eva commissionmaking will be the lowest price offer. If, following the establishment of the final ranking according to the award criterion, the evaluation commission finds that there are two or more offers with the same price, ranked first, the contracting authority will request clarifications through SEAP, for electronic loading by the respective economic operators of documentsthey have new prices. As part of the SEAP referral process, bidders have an obligation to improve or maintain the initial offer submitted to SEAP. During the rescheduling process, the contracting authority may request clarification of the documents received from the bidders, with the provisions of par. (1) art. 136 of H.G. 395/2016.
