The subject of the contract are property and civil liability insurance services.SKI Cleanup Enterprise in the Capital City of Warszawy Sp. z o.o., in accordance with the requirements set out in the ToR.

The subject of the contract is property and liability insurance.

I. Property insurance against all risks (all risk).

The subject of insurance is property whose owner or user during the insurance period is the Purchaser (regardless offor age, degree of redemption or technical wear). In particular, the subject of the insurance is adaptation expenditure, increase in the value of property resulting from improvement (modernization, renovation, etc.), as well as revaluation, newly acquired property (including property used under leasing, rental and other contracts of a similar nature) and all investments.

Property is protectede, which the Purchaser declares to be insured.

II. Insurance of electronic equipment against all risks.

The subject of insurance is property whose owner or user is insured during the insurance period (regardless of age, degree of redemption or technical wear, as well as entities / persons using this equipment). Increase in value of insurance sums covered withit is protected by an automatic coverage clause.

III. Liability insurance.

1. Civil liability of the policyholder / insured, if in connection with an event causing personal injury, material or pure financial loss related to conducting business or owned, used, managed or administered property, in accordance with the provisions of the Insurance Lawthe owner is obliged to make good the damage. The protection covers civil liability for tort (tort) and liability for failure to perform or improper performance of the obligation (contract), as well as remaining in the confluence.

2. The subject of insurance will cover liability for losses incurred (damnum emergens) and lost benefits (lucrum cessans). protectiona applies to damage caused by unintentional action, including grossly negligent, subject to the provisions of the clause of representation

3. The insurance will cover liability for damages resulting from all activities that the policyholder may carry out in accordance with the National Court Register, the company`s statute or contract, in their current wording, including social, cultural and educational activitiesj, recreational, sports, charity.

4. The protection will also cover joint and several liability of the policyholder resulting from legal provisions or concluded contracts (including joint and several liability with a subcontractor, collaborator, consortium member).

5. The insurance cover will cover all locations where the insured is active or in which they are locatedthey are owned, used or controlled by the insured. The protection will automatically cover all locations activated in each insurance period, without the obligation to notify the policyholder.

IV. Machine insurance against loss and damage.

Insurance coverage

1. The insurance will cover all accidental, sudden, unforeseen and resulting from independent causesh from the policyholder damages related to the operation and use of machinery and equipment. The policy will cover insurance, among others damages resulting from material defects, design, production and assembly errors, short circuits, overvoltage, overcurrent and other electrical causes, faulty workmanship, lack of experience, water shortage in boilers, physical explosion, breakagedue to centrifugal force, damage to surrounding property.

2. It is not allowed to introduce the requirement for testing machines, it does not apply to the requirements required by the manufacturer.

3. It is not allowed to introduce the requirement to inform the insurer about the planned review.

Detailed requirements and a description of the subject of the order are included in the ToR.

6.2.2. Conditions for participation in the procedure

For those who meet the conditionsparticipation in the procedure. The Employer will recognize Contractors who have the authorization to conduct insurance business in the Republic of Poland in all risk groups to which the subject of the contract relates, in accordance with the Act on insurance and reinsurance activity of 11.9.2015 (consolidated text Of Laws of 2019, item 381, 730 and 2217).

The Contractor is obliged toensuring that the rights referred to in point 6.2.2 above are current. throughout the duration of the contract, including the extension of the duration of the contract.

Entrusting a subcontractor`s part of the contract does not release the Contractor from the obligation to comply with the condition described in point 6.2.2 above (to the extent covered by the obligation to have the abovementioned rights).

6.2. List of statements or documents confirming the lack of grounds for exclusion from the proceedings:

6.2.1. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the Act, issued not earlier than 6 months before the submission deadline.

6.2.2. documents and statements specified in - 5 item 2 6 and 9 and respectively in - 7 para. 1 3 and - 8 para.1 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the Employer may request from the Contractor in the procurement procedure (Journal of Laws of 2016, item 1126 as amended).

7. The Awarding Entity will exclude Contractors from proceedings in relation to which there are premises for exclusion referred to in art. 24 paragraph 1 and paragraph 5 points 1 and 8 of the PPL Act, subject to Art. 24 paragraph8 and 9 of the PPL Act

1. Whenever the term Act or Public Procurement Law is used in this announcement, without specifying which act is concerned, it concerns the Act of 29.1.2004 Public Procurement Law (consolidated text Journal of Laws from 2019, item 1843).

2. Employer in accordance with art. 24 aa paragraph 1 of the Public Procurement Law, will first evaluate the offers, and then examine whether the Contractor whose offer has been evaluatedas the most favorable, it is not subject to exclusion and meets the conditions for participation in the proceedings.

3. Statements and documents required by the Employer to be submitted by each Contractor with the offer:

3.1. a document containing current data as at the date of submitting the offers, confirming that the offer has been signed by a person authorized to represent the Contractor, if the offer has beenwritten off by a person other than authorized in the Contractor`s registration document (e.g. power of attorney, civil partnership agreement);

3.2. Single European Order Document (EAT) with content in accordance with Annex 2 to Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing a standard form, completed in accordance with the guidelines set out in point 9 of the ToR.

4. In addition, offer aftershould consist of:

4.1. completed electronic form available and generated through the Platform;

4.2. of the completed form "A" according to the specimen set out in Part III of the ToR;

4.3. the original tender bond in accordance with the provisions of point 11.4. SIWZ;

4.4. the filled out price form (must be attached to the electronic form on the platform) according to the pattern set out in Part V of the ToR;

4.5 inin the event that the offer contains the trade secret of the evidence referred to in point 12.9.3. Terms of Reference.

5. Documents related to belonging to the same capital group:

Within 3 days from the date of submitting (posting on the platform) information from the opening of tenders, the Contractor is obliged to provide the Employer (without request) with a declaration of belonging or not belonging to the sameof the capital group referred to in art. 24 paragraph 1 point 23 of the Act - according to template set out in Annex 1 to the ToR. Along with the presentation of the statement, the Contractor may provide evidence that links with another Contractor do not lead to a distortion of competition in public procurement proceedings.

6. List of statements or documents to be delivered at the request of the Employerto confirm compliance with the conditions for participation in the procedure and the lack of grounds for exclusion from the procedure:

6.1. List of statements or documents confirming compliance with the conditions for participation in the procedure.

6.1.1. Current authorization to carry out insurance activities issued by the supervision authority in accordance with art. 162 of the Act of 11.9.2015 on insurance activity and reasecurative (consolidated text of the Journal of Laws of 2019, items 381, 730 and 2217) or other document confirming the conduct of insurance activity in the Republic of Poland in the scope not less than that resulting from the subject of the order.

The Contractor is obliged to ensure that it is current the documents referred to in point 6.1.1 above throughout the duration of the contract, including the extension of the durationagreement.
