1) The contract covers comprehensive property and civil liability insurance for the City of Koszalin, its units organizational, cultural institutions and the Board of Sports Facilities two parts:

Part IInsurance of property, electronic equipment, civil liability and medical expenses abroad:

A. Property insurance against all risks;

B. Insurance of electronic equipment against all risks;

C. Liability insurance;

D. Compulsory insurance of the property manager`s liability;

E. Insurance of medical expenses abroad.

Detailed definitionsThe subject of the order is included in Chapter II of the ToR and in annexes to Chapter II.

1. Contractors may apply for the contract, who: applies to Part I and Part II:

1) are not subject to exclusion pursuant to art. 24 paragraph 1 point 12 23 of the PZP Act; The Awarding Entity does not provide for exclusion under Article 24 paragraph 5 of the PZP Act;

2) meet the conditions for participation in the proceedings regardingh):

2.1) competence or entitlements to conduct specific professional activity applies to Part I and Part II:

The Contractor meets the condition if he demonstrates that he has the authorization to conduct insurance activity in the following risk groups, which the subject of the contract relates to, in accordance with the Act of 11 September 2015 on insurance and reinsurance activities(i.e. Journal of Laws of 2019, item 381 as amended).

Part I for the following groups of Section II of the Act:

Group 1. Accident insurance, in this case at work and occupational disease:

1) one-off benefits;

2) recurring benefits;

3) combined benefits referred to in points 1 and 2;

4) passenger transport

Group 2. Sickness insurance:

1) one-off benefits;

2) recurring benefits ;

3) combined benefits.

Group 7. Insurance of items in transport, covering damage to transported items, irrespective of the means of transport used each time.

Group 8. Insurance of damage caused by natural elements, including damage to property not included in groups 3 7, caused by:

1) fire;

2) explosion;

3) storm;

4) other elements;

5) nuclear energy;

6) landslidesland or crumps.

Group 9. Insurance of other damage to property (if not included in groups 3, 4, 5, 6 or 7), caused by hail or frost and other causes (such as theft), if these reasons are not included in group 8.

Group 13. Liability insurance (general liability insurance) not included in groups 10 12.

Group 18. Insuranceproviding assistance for the benefit of people who have difficulties during travel or while away from home.

Part II for the following groups of Section II of the Act:

Group 1. Accident insurance, in this case at work and occupational disease:

1) benefits one-off;

2) repetitive benefits;

3) combined benefits referred to in points 1 and 2;

4) passenger transport

Group 3. Ubautocasco insurance for land vehicles, with the exception of rail vehicles, including damage to:

1) motor vehicles;

2) land vehicles without self-propulsion. Group 10. Civil liability insurance of all kinds arising from the possession and use of self-propelled land vehicles, including carrier liability insurance.

Group 18. Provision insuranceassistance for the benefit of persons who have difficulties during travel or while away from home.

2.2) technical or professional capacity applies to Part I and Part II:

The Contractor will meet the condition if he shows that he has at least two persons responsible for services arising from the subject of the contract.

2. RELEASING ABILITY OR SITUATIONS OF OTHER SUBJECTSOTOW TO CONFIRM THE FULFILLMENT OF CONDITIONS FOR PARTICIPATION IN THE PROCEEDING applies to Part I and Part II

1) The Contractor, in order to confirm compliance with the conditions referred to in point 5 point 2.2 of the Terms of Reference, may, if appropriate, rely on technical or professional skills or a financial situation or economic activity of other entities, regardless of the legal nature of the relations between him and him

2) The Contractor, which relies on the abilities or situation of other entities, must prove to the Employer that in carrying out the contract, he will have the necessary resources of these entities, in particular presenting the OBLIGATION * of these entities to be submittedhe has at his disposal the necessary resources for the implementation of the contract. The undertaking must be submitted together with the offer in electronic form, accompanied by a qualified electronic signature, and then together with the files constituting the offer should be compressed into one archive file (ZIP).

3) With respect to conditions regarding education, professional qualifications or experience, Contractors mayrely on the abilities of other entities, if these entities provide services for the implementation of which these abilities are required.

4) The Contractor, which relies on the financial or economic situation of other entities, is jointly and severally liable with the entity that has undertaken to make resources available for damage suffered by the Employer arising out of the lack of access to these resources, unless for unauthorizedstockpiling is not at fault.

5) Contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion referred to in art. 24 paragraph 1 item 13 22 of the PPL Act and compliance with the extent to which their resources are referred to, the conditions for participation in the procedure are submitted by UNIFORM EUROPEAN CONTRACT DOCUMENTS regarding these entities.

6) Employerit requests from the Contractor, which relies on the abilities or situation of other entities on the principles set out in art. 22a of the PZP Act, presenting in relation to these entities the documents listed in item 6b of the ToR.

7) If the technical or professional capacity or economic or financial situation of the entity referred to in item 1 does not confirm that the Contractor has met the conditions for participation in the progressiveor there are grounds for exclusion for these entities, the Employer will request that the Contractor within the time limit specified by the Employer:

7.1) replaced this entity with another entity or entities, or

7.2) undertook to personally perform the relevant part of the contract, if it demonstrates technical or professional capacity, or financial or economic situation referred to in item 1.

* CONTENTSTHIRD PARTY`S OBLIGATIONS should specify:

- who is the entity receiving the resources,

- the scope of resources available to the Contractor of another entity`s resources,

- the method of using the resources of another entity by the Contractor when performing the contract,

- the scope and duration of the participation of another entity in the performance of the public contract,

- is the entity whose capacity the Contractor relies in relation to the conditions of participationin the proceedings regarding education, professional qualifications or experience, will perform services to which the abilities relate.

3. LIST OF REPRESENTATIONS OR DOCUMENTS CONFIRMING MEETING THE CONDITIONS FOR PARTICIPATION IN THE PROCEEDINGS AND LACK OF GROUNDS FOR EXCLUSION applies to Parts I and Part II.

1) The Bidder must attach to the offer a valid statementpreliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure in the form of a SINGLE EUROPEAN CONTRACT DOCUMENT, hereinafter referred to as "EAT", prepared in accordance with the template of the standard form set out in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU. The contractor is obliged to submit EAT withthe scope indicated in Chapter III item 1 of the ToR, i.e. to the extent that the Employer is able to verify that the Contractor meets the conditions for participation in the procedure and is not subject to exclusion to the extent described in the ToR.

5) In the case of joint application for the contract by the JEDZ Contractors, referred to in point 6 item 1 of the Terms of Reference, each of the Contractors jointly applying for the contract shall submit. This document is to confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and no grounds for exclusion.ADDITIONAL INFORMATION:

1. Specification of the Essential Terms of the Order will be published at: www.bip.koszalin.pl.

2. The procedure is conducted in an open tender.

3. The awarding entity does not envisage the award of the contract referred to in art. 67 section 1 item 6 of the PPL Act

4. The contracting authority provides for the possibility of using the procedure specified in the disposition of Art. 24aa PZP, the so-called "Mr.reverse procedure ".

5. SUBCONTRACTORS

1) The contracting authority, in accordance with Article 36b (1) of the PZP Act, requires the Economic Operator to indicate in EARTH the part of the contract which it intends to entrust to subcontractors and to provide subcontractors by the Contractor. In the event that the Contractor does not intend to entrust part of the subcontractor`s order, information about this point should be omitted or marked "not applicable".

2If the change or resignation from the subcontractor concerns the entity on whose resources the Contractor relied, in accordance with the principles set out in point 5.1 of the ToR, in order to demonstrate compliance with the conditions for participation in the procedure, the Contractor is obliged to demonstrate to the Employer that the proposed other subcontractor or Contractor independently fulfills them in no less than a subcontractor, for which the Contractor resourcescited during the procurement procedure.

6. DEPOSIT REQUIREMENTS

1) The Contractor entering the tender is required to submit a deposit in the amount of:

1.1) Part I Insurance of property, electronic equipment, civil liability and medical expenses abroad PLN 50, 000.00 (in words: fifty thousand zlotys 00/100) ;

1.2) Part II Motor insuranceOC, AC, NNW and ASS PLN 4, 000.00 (in words: four thousand zlotys 00/100).

2) The bid bond must cover the entire period of the bid and can be lodged in one or several of the following forms:

2.1) in cash;

2.2) bank guarantees or cooperative guarantees of a savings and credit union, except that guaranteeing a cash register is always a monetary guarantee;

2.3) bank guarantees;

2.4) guaranteesinsurance operations;

2.5) sureties granted by entities referred to in art. 6b paragraph 5 point 2 of the Act of November 9, 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2019, item 310 as amended).
