The National House of Public Pensions through the Payment Documents Directorate ensures the management of the data on which they are prepared payment documentation, data processing for printing, printing, processing and transmissionof these documents to the rights payers, to the territorial pension houses and the county agencies for social benefits.

The bidder / third party / subcontractor must not be in the situations provided by art. 164, 165 and 167 of Law no. 98 / 2016.

The way by which-it is possible to prove the fulfillment of the requirement:

The DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting authority, the economic / economic operator / operators ranked in positions-which would allow them to be part of the framework agreement awarded according to the intermediary ranking list drawn up at the completion of the tender evaluation:

- the fiscal attestation issued for legal entities issued by MFP or subordinated subunits (this certificate must show that the tenderer has no debts outstanding at the time of submission of the certificates),

- certificate of attestation fthe local taxes and fees for legal persons issued by local public authorities - this certificate must show that the tenderer has no overdue debts at the time of the submission of the certificates), - the criminal record of the economic operator and the members of the management body or oversight of that economic operator or those whohave power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive document, - documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, - other editorial documents, as the case may be.

Tenderers, third parties and subcontractors must comply with the conflict-of-interest rules provided for in Art. 59 60 of the Law no. 98/2016 on public procurement and will complete a declaration according to art. 60 of Law no. 98/2016, which will be presented by all participants with the filing of the DUAE.

In the case of non-resident tenderers, the provisions of art. 168par. (3) of the Law no. 98 / 2016.

1) The failure of the DUAE with the offer (including the associate / third party / subcontractor, if any) together with the DUAE, the following documents: the firm commitment of the supporting third party to show the way in which its support, the agreement-subcontracting and / or association agreement, as appropriate.

The failure to submit them together with the DUAE is the basis for requesting clarifications for possible formal inaccuracy of the information contained in the DUAE sections of both the tenderer / candidate and the subcontractor / third party, this being necessary to ensure proper deployment* Required information and formalities necessary for evaluating if requirements are met:

(a) The tenderer must provide evidence of a registration in accordance with the law of the country of residence, from which it appears to be lawful, that he is not in any of the the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities-which are the subject of the contract.
