Procurement of the service: consultancy in the fieldthe management of the execution and for the verification of the execution of the construction and installation works related to the projects will be carried out on two lots, by entering into two separate service contracts, as follows:

Purchase of the service:consulting in the field of execution management and for verifying the execution of the construction and installation works related to the projects will be carried out by the conclusion of the service contract: lot 2 "Rehabilitation of the railway line Brasov-Simeria, component of the Rhine-Danube Corridor, for. max speed movement 160 km / h, section Brașov-Sighișoara, subsection 2 Apața-Cața ", consthe latter carrying out activities of coordination, consultancy and supervision.

Any interested economic operator has the right to request further clarifications / information regarding the documentation of the award 22 days before the deadline set for the submission of tenders.

Any request for clarifications must be sent in SEAP http://sicap-prod.e-licitatie.ro/pub

The contracting entityto respond clearly and completely to all requests for further clarifications / information regarding the award documentation on the 12th day before the deadline for submission of tenders. The contracting entity will not respond to requests for clarifications submitted after the established deadline.

Bidders, third-party backers and subcontractors do not have toie to be found in the situations provided in art. 177, 178, 180 of Law no. 99 / 2016.

The method of fulfillment: the DUAE will be completed in accordance with art. 202 para. (1) of Law 99 / 2016.

The tenderer will submit supporting documents proving the fulfillment of those assumed by completing the DUAE to be presented, at the request of the contracting entity only to the tenderer ranked on the firstplace in the intermediate ranking drawn up at the end of the evaluation of the offers are:

(a) certificates certifying the lack of outstanding debts, regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.) of the territorial administrative unit on the basis of which the company has its registered office, from which it can be seen that the offeror has no debtsand outstanding payments due at the time of submission;

(b) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive act;

- as the case may be, documents forrin which proves that the economic operator can benefit from the derogations provided in art. 179 para. (2), art. 180 paragraph (2), art. 184 of Law 99/2016 on public procurement;

- other supporting documents, as the case may be.

If in the country of origin or the country in which the bidder / third-party supporter / subcontractor is established, no documents of the nature of those provided above are issued.us or the respective documents do not cover all the situations provided in art. 164, 165 and 167, the contracting entity has the obligation to accept a declaration on its own responsibility or if in the country there are no legal provisions regarding the declaration on its own responsibility, an authentic declaration given in front of a notary, an administrative or judicial authority or of an association prOffices that have competences in this regard.

1. An economic operator may participate in the procedureonly if it is registered in SEAP;

2. The correspondence and all documents submitted by the economic operators will be in Romanian or accompanied by an authorized translation into Romanian;

3. The award documentation is posted in full within the participation announcement published on the site http://sicap-prod.e-licitatie.ro/pub

4. Requests for clarification of potential bidders will be addressed iexclusively in SEAP at the section "Requests for clarification / Questions / Communications" within the award procedure carried out by electronic means;

5. The answers to the requests for clarifications will be posted in legal time under the section "Requests for clarification / Questions / Communications "of the participation announcement published on the site: http://sicap-prod.e-licitatie.ro/pub

6. The evaluation commissionre will send the clarification requests regarding the submitted offers, in the SEAP to the section "Requests for clarification / Questions / Communications". The economic operators will send the answers to clarifications and any documents requested during the evaluation of the offers through SEAP (section "Requests for clarification / Questions" / Communications "), fully in the respective sectionthe application form, in the form of one or more separate documents / files signed with the electronic signature;

7. The DUAE declaration is completed directly in the SEAP, and its submission with the offer is mandatory, otherwise, the offer will be rejected as unacceptable, in accordance with art. 143 para. (2) lit. b) of the GD no. 394/2016;

8. If, after applying the award criterione, two offers present equal score, in order to split them, the evaluation commission will make the ranking taking into account the score obtained in the evaluation subfactor "Technical component" point 2 the professional experience of the personnel designated for the execution of the contract (main experts proposed) for the accomplishment of the activities within the contract.

In the situation where equality is methe evaluation commission has the right to request the bidders ranked first, who have equal scores, new financial proposals and the winning bid will be designated the one with the lowest financial proposal.

Requests for a new financial proposal and the new financial offer will be uploaded in the SICAP section "Requests for clarification";

9. Modifications made to the contract sectorsof services without organizing a new award procedure, related to the revision options contained in the contractual clauses are made by additional act in compliance with the legislation in force. The contracting parties have the right, during the performance of the contract, to agree to modify the clauses of the contract without organizing a new award procedure, under the conditions provided in art. 235-243 of Law no. 99/2016 regarding the sectoral acquisitions, with the subsequent modifications and completions, as well as the provisions of art. 158 of the GD no. 394/2016
