The object of this public procurement is "construction" within the meaning of Article 3 (1) (1) of the Public Procurement Act (PPL).

Construction of Compostingan installation for separately collected green or biodegradable municipal waste and the incoming infrastructure and the supply of technological equipment for the installation is the main activity under the project "Design and construction of a composting installation for separately collected green waste from the municipality of Berkovitsa and Varshets Municipality", co-financed by OP "Environment" 2014-2020

The selected contractor will be requiredto carry out all activities related to the construction and assembly activities, the construction of the accompanying infrastructure and the delivery of the technological equipment for the composting installation .. The subject of the order includes the following logically bound and consecutive tasks: preparatory works and temporary construction, construction and assembly works according to the approved working project, incl. CMP related tothe provision of an incoming infrastructure, the training of the personnel to be serviced by the installation, the transfer of the site to the contracting authority (including the activities under Articles 175 and 176 of the TDA); supply of technological equipment according to the approved project (diesel generator, fire safety equipment, electronic scales, modular fuel station, professional steam turbine, 20 kV / 1x100 kVA transformer, dry transformer 100 kVA / 20 kV / 0.4 kV).

The subject of the public procurement includes the construction and assembly works of:

- fence and barrier,

- site networks and equipments,

- checkpoints, scales, disinfection traps,

- fuel station, car wash,

- shed for raw material, shed composting first phase,

- site composting, second phase,

- leach tank, PPP tank and technological needs,

- foundation and diesel generator, The implementation of the construction works includes the following: a) execution of the construction in compliance with the issued construction papers and with the requirements of Art. 169, para. 1 and 3 of the TDA, as well as with the rules for execution of construction and assembly works and measures for protection of the life and health of the people on the construction site, b) supply and installation in the construction ofthe necessary construction products, materials, facilities, etc. (c) manufacture and / or delivery of construction parts / elements and their incorporation in the construction works; d) in case of necessity during the construction - carrying out of the construction works in accordance with the basic requirements for the construction works; works on moving / displacement of underground and overground networks(e) implementation and organization of the activities related to the removal of existing infrastructure, trees, shrubs and collection, transport, disposal and utilization of construction and other wastes resulting from the execution of the construction works, in accordance with the requirement of the Bulgarian f) carrying out the necessary tests and laboratory tests;(g) preparation of all necessary building documentation as required by the TDA and Ordinance No. 3 of July 31, 2003 for the preparation of acts and protocols during construction, as well as other documentation required by the laws and normative documents and necessary for the fulfillment of the subject of the contract; h) preparation of the construction documentation; i) preparation of a complete geodetic(k) participation in the procedure for commissioning of the construction; (l) removal of deficiencies in case they are established at the delivery of the construction and (m) warranty maintenance of the construction and removal of defects in warranty(n) all other activities assigned to the contractor under the terms of the contract as well as all other activities necessary for the performance of the subject matter of the public procurement and the guarantee of the maintenance of the construction works

Each participant in the procedure must be entered in the Central Professional Register of Builders (CPSR) and have a certificate issued by the Chamberof the builders for execution of constructions with scope of group four, second category and third group, second category in the sense of art. 5, para. 6, paragraph 4.2.3 and Art. 5, para. 6, item 3.2.1 of the Regulations for the procedure for registration and maintenance of TSPR, issued by the chairman of the CSC, State Gazette, no. 101 of 22.11.2013, or for a higher category of construction works of the same group, and for foreign persons - in analogous registers according tothe legislation of the Member State in which they are established or have the right to pursue such activity under the legislation of a Member State of the European Union or of another State party to the Agreement on the European Economic Area or of the Swiss Confederation and has the power of Entry into the Central Professional Register of Builders for the scope of activities for whichit is issued.- In case of participation of a grouping which is not a legal entity, compliance with the selection criterion shall be evidenced by each of the persons included in it, who will perform the respective construction and assembly works, according to the distribution of the participation of the persons in execution of the activities provided for in the consortium formation document / agreementcontractors, compliance with the selection criterion is also proved by them according to the type and the share of the order they will perform and for them there are no grounds for removal from the procedure.

When submitting the tender the participant declares the fitness for professional activity through Completion of Section A "Fitness" in Part I "Selection Criteria" of Single European Public Documents(EEDOP) with a reference to the authority that issued the document, scope, date of issue and indication of the national databases containing the declared circumstances or the competent authorities which, under the law of the country where the participant is established, are are required to provide information.

If the participant is a foreign person, he / she may present a valid equivalenta document or a declaration or a certificate issued by a competent authority of the Member State of the European Union or of another State Party to the Agreement on the European Economic Area or the Swiss Confederation in which it is established or of registration in an equivalent professional register of the country in which it is established or of such registration by the competent authoritiesin accordance with its national law proving the entry of the participant in a relevant register of that State, or that he may carry out the activity of carrying out the works subject to this contract, accompanied by a translation into Bulgarian, proving, on the basis of Art. 112, para. 1, item 4 of the Public Procurement Act in relation to Art. 3 and Art. 25a of the Law of the Chamber of Builders that there is pto carry out the assigned construction in the Republic of Bulgaria, incl. that it did the appropriate registration when necessary. The participants in the procedure for the last 3 completed financial years should have achieved an annual total turnover of at least the estimated value of the contract for the last 3 financial years closed - "Annual total turnover" for the needs of thethe current public procurement is within the meaning of -2, item 66 of the Supplementary Provisions of the Public Procurement Act ..

Where the insurance or guarantee provided only partially covers the risks, the contracting authority may require additional insurance or a guarantee to cover uncovered risks, in accordance with Art. 173, para. 2 and Art. 174, para. 1 of the TDA and in compliance with the requirements of Art. 27, para. 3 ofLaw on Service Activities

Requirements for the participants:

1. A participant who meets the conditions under Art. 10, para. 1 of the PPA and the requirements of the contracting authority. The assignor removes from participationis in the procedure, participant for whom there are or have arisen before or during the procedure the grounds for removal under Art. 54, para. 1, items 1-7 and Art. 55, para. 1, item 1, item 3, item 4 and item 5 of the Public Procurement Act, the conditions under Art. 107 of the Public Procurement Act, the circumstances under Art. 3, item 8 of ЗИФОДЮПРСРС, as well as participants, for whom there are restrictions under Art. Article 69 of the PCA. Related parties within the meaning of -2, item 45 of the PPA of the Public Procurement Actin - 1, item 13 and item 14 of the Supplementary Provisions of the Public Offering of Securities Act, can not be independent participants in the procedure.

The guarantee for execution of the project is submitted by the participant designated as contractor, upon signing it in the amount of 5 % of the value of VAT without VAT. The guarantee is in one of the following forms: cash, bank guarantee, insurance, contractor's choice.

Employert provides for an advance payment for the execution of the contract up to 10% of the total amount under the contract for performance of the contract. In connection with the foreseen advance payment, the contracting authority, on the grounds of Art. 111, para. 1 of the PPL requires the designated contractor to provide a guarantee to secure the advance funds provided. The guarantee that provides advance funds is up tothe amount of these funds and shall be released within 3 days after repayment or utilization of the anticipated advance. If the contractor does not avail himself of the opportunity given to him to receive an advance payment, the unpaid and due payments under the contract for actually performed activities will be paid to the interim and / or final payments under the contract. The warranty is provided in one of the following formsand: cash amount; bank guarantee, insurance, contractor's choice. The guarantee in the form of a sum of money or a bank guarantee may be provided on behalf of the contractor on behalf of a third party guarantor. The participant designated as a contractor shall choose the form of the guarantee for performance of the contract and for the advance. Conditions for detention and release of the performance bondand the advance funds provided are covered by the contract for the award of the contract.

Payment plan:

1. Advance payment: An advance payment of 10% (ten per cent) of the total contract execution contract is foreseen without the cost of the unforeseen costs. Payment shall be made within 30 (thirty) days of the conclusion of the performance contractthe order, the guarantee that provides the advance funds and the invoice in original. Interim payments up to 80% (eighty per cent) of the contract value determined on the basis of actual performance of construction works at a value of at least 10% of the value of the contract without unforeseen costs according to the CCC - former act 19 of the project for the site and invoice - original, within e30 (thirty) calendar days. Final payment for the activities actually carried out under the CCC - Former Act 19 of the project, after deduction of the advance and the interim payment, determined on the basis of the actual construction works performed under former Act 19 of the project and its stages within 30 (thirty) calendar days following the submission of the document certifying the introduction of the site inoperation, and invoice delivery in original
