Selection of contractor for construction and assembly works for site: "Replacement of water supply network of Nanovitsa village, Momchilgrad Municipality
The envisaged construction works will be carried out according to the approved investment project for the internal water supply network of the village of Nanovitsa, Momchilgrad.
Main Site: The territory of the municipality of Momchilgrad.are carried out according to the approved investment project for the inland water supply network of the village of Nanovitsa, Momchilgrad municipality
The execution of the construction works includes the following types of activities: earthworks including excavations and embankments, plumbing and road works. According to Article 137 (1) (2) (b) of the Territory Arrangement, the site is the fourth group, the second category.the swimmers in the village of Nanovitsa in the municipality of Momchilgrad have a total length of 5318 m. These sections are localized as particularly problematic
The existing plumbing on these sections is made of eternit pipes with expired operating time
It was found that there are not enough stop valves, allowing the isolation of individual branches and parts of the network in the event of an accidentwater pipeline hydrants are few and far apart - The types of construction works to be executed and their quantities are described in detail in the sample number 5 attached to this documentation for participation in the procurement documentation. Descriptions and requirements for the planned types of construction works are described in the technical specification, AppendixIssue No 1 to the Procurement Document
Application for Entry in a Professional Register:
Procurers must be listed in the Central Professional Register of Builders (TSRC) at the Chamber of Builders in Bulgaria (CCB) and for foreign persons in a similar register under the law of a Member State of the European Union in which they are established, orof the other country party to the Agreement on the European Economic Area
Minimum level: the participant should have the capacity to execute constructions of the category of construction in which the object of the contract belongs to the fourth group, the second category
Authentication: The fact is certified by reference in the enEEDOP part IV: "Selection Criteria", Section A "Fitness" by writing a datafor the registration in the CPSA, respectively. in a similar register, whether the relevant documents are available in electronic format; specify the web address, authority or service issuing the registration document and the exact reference to the document (registration number and period of validity) and the scope of the registration (the group and construction category described therein). 67, para. 5 of the PPA, the contracting authority may proceedrequests the Participants at any time to submit all or part of the documents proving the information specified in the EDEDOP
Demonstration:
At the conclusion of the contract, the participant selected for the contractor shall submit a certificate for registration in the TSRC to the Building Chamber for execution of construction works of the construction category in which the object of the contract falls.When the selected contractor is a foreign person, he must provide a document proving that he is entitled to a national database in the Member States, the contracting authority shall not require such a document upon conclusion of the contract. to perform the assigned activity in the Republic of Bulgaria for the execution of constructions of the category of constructions in which it fallsthe order of the order, including that he has carried out the relevant registration, as necessary, according to Art. 112, para. 1, item 4 of the Public Procurement Act. Minimum Total Turnover Required:
Participants must have achieved a minimum total turnover calculated on the basis of annual turnover.
Note: According to - 2, item 66 of the Supplementary Provisions of the Public Procurement Act, "Annual Total Turnover" is the sum of net sales revenue.
Authentication:
At nsubmitting the tender the participant fills in the ECEDOP part IV: "Selection criteria", section B: "Economic and financial status" data for its "total annual turnover" for the last three financial years, depending on the date on which it was created or is activity under its annual financial statements.
In the case of Article 67, paragraph 5 of the PPA, the contracting authority may require the participantsREFERENCES:
When signing the contract, the participant selected for the contractor shall provide certified copies of the annual financial statements for the last completed 3 (three) financial years. years, depending on the date on which it was established or started its activity, or their constituent parts, when-their publication is required. Requirement for Insurance:
Participants in the public procurement should have professional liability insurance for "builder" under Art. 171, para. 1 of the Spatial Development Act. For a participant established / registered outside the Republic of Bulgaria, professional indemnity insurance should be equivalent to the one under Art. 171. par. 1 of H.TU under the legislation of the country where the participant is established / registered. The insurance coverage should correspond to the volume and nature of the order deriving from a normative act.
Verification:
When submitting the tender, the fact is declared in the ECEDOP part IV: "Selection criteria", section B "Economic and financial condition" data (sum insured, web site, authority or service issuing the document, exact reference to document No., date of issue, insured person, type of business insured, and period of validity) for the existence of a valid professional liability insurance under Article 171, paragraph 1 of the TDA for "builder" at the limit of liability according to art. 5, para. 2, item 2 of the Ordinance on the terms and procedure for compulsory insurance in projectconstruction and construction or an equivalent document (for non-residents). The professional activity of the insurance policies must correspond to the subject of the order. 67, para. 5 of the PPA, the contracting authority may require the participants at any time to submit all or part of the documents, to which the participant refers in the EDEDOP
Demonstration:
At the conclusion of the contract, the contractor selected shall be required to produce a certified copy of a valid insurance policy or equivalent professional indemnity insurance or guarantee if the participant is established in another Member State of the European Union or in a Party to the Agreement on the European Economic Area non-residents), as stated in the EDEPD, the validity of the policy expires by the date of signature of the contract and a certified copy of the new insurance policy.
If the data can be secured through direct and free access to a national database in the Member States, the contracting authority does not require such a document upon conclusion of the contract the contract. The assignor removes from participation in the procedure participants in respect of which he is-there is any of the circumstances under Art. 54, para. 1 and Art. 55, para. 1 of the Public Procurement Act. Other specific grounds for removal that should not be available for the participants are: - - convictions for crimes under Art. 194 208, Art. 213a 217, Art. 219 252 and Art. 254a 255a and Art. 256-260 of the Penal Code (Article 54, paragraph 1, item 1 of the Public Procurement Act), - violations under Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 228, para. 3 of the Code(Art.54, para 1, item 6 of the Public Procurement Act), - violations under Art. 13 para. 1 of the Law on Labor Migration and Labor Mobility (Article 54 (1) (6) of the PPA), - existence of connectivity within the meaning of par. 2, item 44 of the PP of the PPA between the candidates / participants in a particular procedure (Article 107, item 4 of the Public Procurement Act), - presence of circumstance under Art. 3, item 8 of the Economic and Financial Relations with Companies Act, reftaxable persons in jurisdictions with preferential tax regime, the persons controlled by them and their actual owners (ZIFODPRIDKLTTDS), unless the exceptions under Art. 4 of ЗИФОДРУПДРКЛТДС,
- circumstances under Art. 69 of the Law on Counteracting Corruption and for Removal of the Acquired Property. In the case of a consortium which is not a separate legal entity, the participant shouldtake a copy of a document showing the legal basis for creating the grouping, as well as the following information in relation to the particular community. contract: the rights and obligations of the participants in the grouping; a clause of joint and several liability of the parties to the grouping for the obligations under the public procurement contract; the type and proportion of the activities that each member will performof unification. The document should be signed by the persons in the grouping, indicating the representative of the grouping. Where the person who represents the members of the grouping is not mentioned in the contract, a document signed by the persons in the consortium in which the representative is indicated shall be submitted. The Contracting Authority does not avail itself of the opportunity under Art. 10, para. 2 of the Public Procurement Actand does not require the establishment of a legal entity where the designated performer is a grouping of natural and / or legal persons. If, prior to the conclusion of the public procurement contract, the appointed contractor unions voluntarily establish and register a legal person, according to the requirements of the applicable legal framework, the contracting authority will accept the newly created legal entitycontractor's form. The performance guarantee for the contract amounts to 1% of the total price of the public procurement contract excluding VAT.
