At the ground floor level find a semi-Olympic pool that will be used for competitive swimming and recreational swimming. In the annex spaces on the same level are proposed rooms equipped with fitness equipment, sauna, first aid, locker rooms and bathrooms as well as a space provided for a bar dining room. Floorul I hosts a multifunctional gym, its annexes, grandstands for spectators, toilets. The parking lot with an area of ​​2, 383 m2 and which has 102 parking spaces, is located in the northern part of the plot. field and a multifunctional field with the possibility of reconfiguring it for practicing handballfootball and basketball.

In the park area there will be a relaxation area with pedestrian alleys and rest areas, as well as an area for recreational activities, with sports trampolines, climbing tower and fitness equipment.

Timisoara will exclude at any time of the procedure for awarding the works contract, any economic operator who is in one of the situations provided in art. 60, 164, 165 and 167 of Law 98/2016 on public procurement.

Reasons for exclusionwill also be applied in the case of associates / subcontractors / supporting third parties, as the case may be.

Method of fulfillment: under the sanction of rejecting the offer as unacceptable, each economic operator participating in the award procedure ) will present, together with the offer, DUAE completed with the information related to their situation.

The following will be presented:of interests, as they are defined in art. 60 of Law no. 98/2016, by all participants in the procedure and

(b) if applicable, the firm commitment of the supporting third party, accompanied by documents showing the effective manner in which its support will materialize, the subcontracting and / or association agreement.

The supporting documents proving the fulfillment of those assumed by completing the DUAE are to be presented, only at the request of the contracting authority, by the tender.the first place after the application of the award criterion on the admissible tenders.

The requested documents will be presented in Romanian / the language in which they were issued, accompanied by the translation into Romanian, as the case may be.

1. The DUAE related to the award procedure is made available to the interested economic operators, configured by the contracting authority directly in SEAP. The economic operators will fill in the DUAE directly in SEAP, with the information / answers related to the classification / non-compliance in the reasons for exclusion, respectively the fulfillment of thethe qualification procedures requested by the contracting authority, taking into account the quality in which they participate in the award procedure, respectively tenderer, associated tenderer, subcontractor, third party supporter, as the case may be; In order to view the attached documents, the economic operators must have a program necessary to view the electronically signed files;

3. The economic operators have the right to send the offer (DUAE completed, the declaration regarding the non-compliance with the provisions of art.. 98/2016, with the latest additions and modifications, the technical proposal, the financial proposal, the proving document regarding the establishment of the participation guarantee and, if applicable, the commitment to support the third party, the association and / or subcontracting agreements), only in electronic format, signed with extended electronic signature and only until the date and time-limit established for the submission of tenders in the participation notice;

4. Requests for clarification referredschedules to the present award documentation, will be addressed exclusively in SEAP within the award procedure carried out by electronic means, the contracting authority will not comply with the requests addressed by another means of communication than the established one. Any interested economic operator has the right to request clarifications or additional information in connection with the award documentation, in compliance with the deadline specified by the contracting authority in the section.II.1.4) of this document, respectively not later than 20 days before the deadline established for the receipt of tenders. Clarifications submitted after this deadline will no longer be taken into account. According to art. 160-161 of Law 98/2016, with the latest additions and amendments, the contracting authority will respond clearly and completely to all requests for clarifications / additional information, on the 11th day before the deadline for submission of tenders, to the extent andin which they will be addressed within the term provided in the participation announcement. The consolidated answer to the requested clarifications will be published in SEAP within the participation announcement;

5. If the contracting authority requests the presentation of certain clarifications / completions in order to verify the conformity of the offer with the imposed requirements, both the request and the bidder`s response are sent in SEAP, only in electronic format, signed with extended electronic signature. In the situationin which the bidder`s response is posted in SEAP without an extended electronic signature, its bid will be assimilated to the provisions of art. 137 para. (2) lit. j) of GD 395/2016, with the latest additions and modifications, being rejected as unacceptable;

6. If after applying the award criterion "the lowest price" it is found that two or more offers ranked first, contain equal prices, re-bidding will be requested through SEAP. If this is not feasible for reasons imputedto the SEAP operator, bidders will be required to submit a new offline financial proposal. The contract will be awarded to the tenderer whose new financial proposal has the lowest price.
