1. The subject of the contract is construction works consisting in the design and construction of fermentation installations as well as sheds and storage boxes in the area of ZUOK "Orli Staw".

Main Site: Municipal Waste Treatment Plant "Orli Staw", Orli Staw 2, 62-834 Cekow, POLAND

1. The material scope of this proceeding includes in particular:

1) implementation of the Technological Project Section I;

2) pre-design works, design, obtaining a building permit Episode II;

3) construction of a fermentation plant with a shelter Episode III;

4) buinstallation of biogas installations with cogeneration Episode No. IV;

5) construction of storage boxes Episode No. V;

6) construction of the power network together with the TR3 Transformer Station Episode No. VI;

7) construction of the technical network and infrastructure Episode No. VII;

8) construction of a communication and road system as well as green areas Episode No. VIII;

9) finishing and furnishing of the boiler room in the social buildingEpisode No. IX;

10) Final Tests, obtaining the occupancy permit and other documents Episode No. X;

11) Maintenance Tests Episode No. XI.

2. The plant is operated in the following hours:

1) Monday-Friday 06:00 to 22:00

2) (sporadically) Saturday 06:00 to 14:00

The Contractor with the consent of the Employer may also work outside the above working hours of the Plant. In suchh cases, the Contractor will be obliged to cover all costs resulting therefrom and incurred by the Employer related to the performance of work or obligations by third parties or employees of the Employer.

3. As part of the subject of the contract, the contractor is also required to perform all preparatory and cleaning works, maintain the back-up facilities, prepare information and planat BIOZ, organization of the construction site, organization of road traffic, provision of geodetic services, implementation of the conditions set out in the opinions of the authorities, arrangements, decisions, performance of all tests, tests and start-ups, after completion of the works to restore the area and surfaces adjacent to the building to its previous state and other activities necessary to complete the subject of the order.

NOTE: With remarksagi on restrictions on the number of characters in other parts of this notice, the Employer informs in this section that:

1. The Contractor is obliged to lodge a security deposit in the amount of PLN 920, 000.00 (say: nine hundred twenty thousand zlotys 00/100) before the deadline for submitting Offers.

2. The form of payment of the bid security shall be chosen by the Contractor from among those provided for in art. 45 item 6 of the Public Procurement Law

3. The bid bondmust secure the submitted Bid throughout the entire period of being bound by the Bid, i.e. 60 days, counting from the date of the bid submission deadline.

4. The Contractor submits the Bid by attaching to the Employer Platform:

1) the completed Bid Form (Annex 1 to IDW - Part I of the Terms of Reference) together with attachments to the Bid Form and the Technical Offer (referred to in item 12.8. IDW - Part 1 of the Terms of Reference),

2) filled outego statement (EAT), referred to in point 12.1. IDW - I part of the Terms of Reference;

3) power of attorney to represent all Contractors jointly applying for the award of the contract (if applicable),

4) power of attorney if the offer is submitted by the Contractor`s attorney;

5) the document referred to in point 13.2. IDW - I part of the Terms of Reference (if applicable);

6) proof of payment of the bid security, for whichm referred to in item 16 IDW,

- to be prepared in accordance with the principles set out in IDW.

5. A detailed description of how to prepare the Offer and how to conduct the examination and evaluation of submitted offers is included in point 18 and 23 IDW - I part of the Terms of Reference

6. The contracting authority informs that in the case of these proceedings it applies art. 24aa of the Public Procurement Law

7. In the case of Contractors jointly applyingfor the award of the contract, each of the Contractors, including partners of a civil company, are obliged to submit, on the Employer`s request, the documents or statements referred to in point III.1.2) 3.1) -7) concerning each of them.

NOTE: The Purchaser informs that in the items "Minimum level possibly required standards" due to the limited number of characters uses this item as a continuation ofsow, which should be in other sections of this announcement.

NOTE: Continuation with the minimum level of possibly required standards from point III.1.3):



About the value of construction works for each investment not less than PLN 30, 000, 000 gross, under which a valid occupancy permit was obtained, if required (the Employer requires a comment whether the occupancy permit was required);

AND

f) Sanitary robot manager with the following qualifications: min. 10 years of experience in managing sanitary works and experience as a manager of sanitary works in at least one investment with a value of not less than PLN 30, 000, 000 gross and having building qualifications to manage construction works in the installation specialty in the field ofeci, installations and equipment for heating, ventilation, gas, water supply and sewage systems without restrictions;

AND

g) Manager of electrical works having the following qualifications: min. 10 years of experience in managing electrical works and building qualifications for managing construction works in the installation specialty in the field of electrical networks, installations and equipment and epower engineering without restrictions;

AND

h) Specialist for the assembly and start-up of a dry methane fermentation technological line having the following education and qualifications: engineering education and professional experience in the waste management sector, including participation alone or in a team in the assembly and commissioning of at least one investment consisting in the construction of a fedry methane fermentation (dry matter content in the material in the chamber 20%), horizontal, continuous with piston flow, for biofraction from municipal waste with a minimum capacity of 15, 000 Mg / year ending with obtaining a valid occupancy permit, if required (Employer requires a comment permission to use was required).

Period of experience withAvodowa is counted from the day of obtaining the rights to the day of submitting the bids.

Persons referred to in points III.1.3) 1.2) b) -e) and III.1.1) f) -g) announcements should have building qualifications in accordance with the Act of on July 7, 1994, the Construction Law (i.e.are the rights or the relevant valid construction licenses that have been issued on the basis of relevant provisions in force in the country in which the Contractor has its registered office or place of residence, recognized by the competent authority in accordance with applicable law, in particular in accordance with the Act of 22 December 2015 on the principles of recognition of professional qualifications acquired inin member states of the European Union (i.e. Journal of Laws of 2020, item 220) or in accordance with the Act of 15 December 2000 on professional self-governments of architects and construction engineers (i.e. Journal of Laws of 2019, item 1117

ATTENTION: The fulfillment of the condition described in points III.1.3) and III.1.1) of the announcement will be made after demonstration of the joint fulfillment of the conditions described in point III.1.3) 1.1) lit. a) d), III.1.3). 1.2) a)e) and III.1.1) f) -h) of the announcement, subject to point 14.2 of IDW. The Employer allows that in order to demonstrate compliance with the abovementioned of the condition, the Contractor indicated the same order in the relevant scope (i.e. within individual letters in which the content of the condition in terms of technical and professional ability was included). At the same time, the Employer informs that in a situation where the Contractor to demonstrate compliance with the conditionnkow referred to in point III.1.3) 1.1), will present orders implemented in the "design and build" formula, the Employer as the date of the contract, both for design documentation and for construction works covered by one contract in the "design and build" formula, will accept the date of final acceptance of the entire orders.

1. For meeting the conditions of participation in the proceedings in the field of situationsand economic or financial, the Employer will recognize the Contractor who shows that he has achieved net income from basic activities in the amount of not less than PLN 30, 000, 000.00 annually in the last 3 financial years, and if the period of conducting business is shorter in that period.

NOTE : Due to restrictions on the number of characters in other parts of this notice, the Employer informs in itof this section:

2. In order to confirm the fulfillment of the conditions for participation in the procedure, the Contractor shall be obliged to submit the following statements and documents: III.1.3) 1.1) offers specimen lists (the scope of information required) are attachments to IDW;

2) evidence ofwhether works listed in the list of works referred to in point III.1.2) 2.1) the offers were duly made, in particular information on whether the works were carried out in accordance with the construction law and properly completed;

Evidence determining whether the services listed in the list of services performed referred to in point III.1.2) 2.1) the offers were made onYou are lying. The evidence referred to are references or other documents issued by the entity for which the works or services were performed, respectively, and if, for a justified reason of an objective nature, the Contractor is unable to obtain these documents, the Contractor`s statement;

3) list of persons, referred by the Contractor to implement a public contract, satisfyingconditions referred to in point III.1.3) 1.2) a) -e) and III.1.1) of the announcement, the specimen list is attached to the IDW;

4) the financial statements or part thereof, where the preparation of the report is required by the law of the country in which the Contractor has its registered office or place of residence, and if it is subject to examination by a certified auditor in accordance with accounting regulations, also a relevant place of residenceand with an opinion on the audited report or part thereof, and in the case of Contractors not required to prepare a financial statement, other documents specifying the revenue referred to in point III.1.2) 1. of this announcement.

3. In order to confirm that there are no grounds for excluding the Contractor from participation in the procedure, the Contractor must submit the following only upon request of the Employere declarations and documents:

1) Copy from the relevant register or from the central register and information on business activities referred to in point 12.6.1) IDW;

2) Information from the KRK, referred to in point 12.6.2) IDW;

3) Declaration of the Contractor on the lack of issuing a final court judgment against him or the final administrative decision on arrears in the payment of taxes, fees or insurance premiumssocial or health care referred to in point 12.6.3) IDW;

4) The Contractor`s statement on the lack of a decision against him as a preventive measure prohibiting him from applying for public contracts;

5) The certificate of the competent head of the tax office confirming that the Contractor is not in arrears with tax payments referred to in point 12.6.5) IDW;

6) Certification of the competent field unitof the Social Insurance Institution (ZUS) or KRUS (Social Insurance Institution) or another document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions referred to in point 12.6.6) IDW;

7) Declaration of the Contractor on non-payment of local taxes and fees, referred to in the Act of 12 January 1991 on local taxes and fees.

4. To confirm that the item offeredof the contract corresponds to the requirements specified by the Employer, the Contractor shall be obliged only to submit the catalog (technical) cards of the manufacturer of the offered Device for all Devices indicated in the List of Devices in Annex 2 to the Bid Form. Contractors who can apply for the contract who:

1) are not subject to exclusion;

2) fulfillconditions of participation in the proceedings.

2. The Contractor is excluded from the contract award procedure in relation to which any of the circumstances referred to in art. 24 paragraph 1 Pzp.

3. In addition, pursuant to art. 24 paragraph 5 point 1), point 4) and point 8) of the Public Procurement Law, the Contractor shall be excluded from the contract award procedure:

1) in relation to which liquidation was opened, in accordance withthe arrangement rooted by the court in restructuring proceedings provides for satisfaction of creditors by the liquidation of its assets or the court ordered the liquidation of its assets pursuant to art. 332 paragraph 1 of the Act of 15 May 2015 Restructuring Law (i.e., Journal of Laws of 2019, item 243 as amended) or whose bankruptcy was announced, with the exception of the Contractor who after the declaration of bankruptcy entered intoruled by a final court decision, if the arrangement does not provide for satisfaction of creditors by the liquidation of the assets of the bankrupt, unless the court ordered the liquidation of his assets under art. 366 section 1 of the Act of February 28, 2003 on the Bankruptcy Law (Journal of Laws of 2019, item 498, as amended);

2) which, for reasons attributable to him, he did not or did not properly perform to a significant extent earlythis public procurement contract or concession contract concluded with the contracting authority referred to in Article 3 clause 1 item 1-4 of the Public Procurement Law, which led to the termination of the contract or the award of damages;

3) which has violated the obligations regarding taxes, fees or social security or health insurance contributions, which the Employer is able to prove by means of appropriate evidenceh, except in the case referred to in art. 24 paragraph 1 item 15 of the Public Procurement Law, unless the Contractor has made the payments of taxes, fees or social security or health insurance contributions together with interest or fines or has concluded a binding agreement on the repayment of these debts.

4. The Contractor, within 3 days of posting on the website (Platform of the Employer) information aboutj referred to in art. 86 section 5 of the Public Procurement Law, provides the Employer with a declaration of belonging or not belonging to the same capital group with the Contractors who submitted separate offers in the proceedings. In the case of belonging to the same capital group, the Contractor may submit, together with the declaration, documents or information (evidence) confirming that links with another Contractor, whichput up an offer they do not lead to distortion of competition in the procurement procedure.

5. The Contractor is obliged to attach to the offer a current statement as at the date of submission of tenders, constituting a preliminary confirmation that the Contractor:

1) is not subject to exclusion;

2) meets the conditions for participation in the procedure.

The declaration referred to above the Contractor is required to submit in the form of a Uniform EUropean Order Document (EAT), drawn up under pain of nullity in electronic form, bearing a qualified electronic signature, in accordance with the standard form template set out in the European Commission implementing regulation issued on the basis of art. 59 clause 2 of Directive 2014/24 / EU. EAT is submitted by the Contractor, Contractors jointly applying for the award of the contracta or in the case of relying on the capabilities of third parties - the Contractor submits the EAT form for each of these entities.

6. If the documents confirming the fulfillment of the conditions for participation in the proceedings contain values in a currency other than PLN, they will be converted into PLN at the average exchange rate of the National Bank of Poland of the given currency from the date of publication in the Official Journal of the EU.about the contract regarding the procedure. When on the day of placing the abovementioned announcement The National Bank of Poland does not announce the average exchange rate of a given currency, the basis for conversion is the average exchange rate of a given currency announced by the National Bank of Poland on the last day before the date of placing the announcement in the Official Journal of the European Union
