The subject of the order is construction works including construction of parking tracks western construction of track no. 18.17, 16, 15, switches: 23, 74, 82, 18, 24, 83, 14 together with reconstruction of the contact line and lightingas well as drainage and drainage of tracks, construction of the SO4 hall building, raw shell, reconstruction of the junction No. 51 Gate 2 along with the replacement of the fence from Łowińskiego Street in SOT Nowa Huta and construction of the hall SO4-finishing with connection to outside installations, construction track No. 5, 6, 7, 8, 9, 10, 41, 42, 43.51 switches: No. 11, 12, 20, 29, 30, 31.35, 3.36, 37, 38, 39, 72, 77, 79 - together with the reconstructioną traction network and lighting, as well as drainage and drainage of tracks, reconstruction of the SO 2 hall, including connection to installations outside buildings, construction of track No. 11, 12, 13, 14, 52, switches: No. 13, 17, 21, 22, 73, 80.81 along with the reconstruction of the overhead contact line and lighting as well as drainage and drainage of tracks at SOT Nowa Huta.

The subject of the contract will be carried out under a framework contract, after the conclusion of separate implementation contracts.

1) The first contract implementation contract, i.e. construction of parking tracks on the west side, construction of track No. 18, 17, 16, 15, switches: 23, 74, 82, 18, 24, 83, 14 together with the reconstruction of the overhead contact line and lighting as well as drainage and drainage of tracks, construction of the SO4 hall buildingnew closed, reconstruction of junction No. 51 junction II gate with replacement of the fence from the side of ul. Łowińskiego at the Tramwajow Nowa Huta Service Station in Krak-w, ul. Ujastek 12, 31-752 Krakow.

2) The second contract for the implementation of the contract, i.e. construction of the SO4 hall - finishing along with connection to outside installations, construction of track No. 5, 6, 7, 8, 9, 10, 41, 42, 43, 51 switches: no. 11, 12, 20, 29, 30, 31, 35, 36, 37, 38, 39, 72, 77, 79 - along with the reconstruction of the traction network and lighting as well as drainage and drainage of tracks, reconstruction of the SO 2 hall, including connection to installations outside buildings, construction of track No. 11, 12, 13, 14, 52 switches: No. 13, 17, 21, 22, 73, 80, 81 together with the reconstruction of the traction network and lighting as well as drainage and drainage of tracks at the Nowa Huta Tram Service Station in Krakow, ul. Ujastek 12, 31-752 Krakow.

These proceedings are treated as part of the contract related to the development of infrastructure at the Nowa Huta Streetcar Service Station.

1. Contractors who can: 1.1. are not excluded from the procurement procedure on the basis of: 1.1.1. Art. 24 paragraph 1 point 12-23 of the Public Procurement Law (i.e. Journal of Laws 2019item 1843 with later d. hereinafter the Act or the Public Procurement Law), subject to art. 133 section 4 of the Act;

1.1.2. Art. 24 paragraph 5 points 1, 2, 3, 4, 8 of the Act.

2. In order to demonstrate the lack of grounds for exclusion and fulfillment of the conditions for participation in the procedure, the Contractor is required to submit the following statements and documents:

2.1. current statement as at the date of submission of tenders, constituting a preliminary confirmationcores that are not excluded. The contractor submits the above statement in the form of the JEDZ / ESPD document;

2.2. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13 or 14 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2.3. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 21 of the PPL Act(collective entities), issued not earlier than 6 months before the deadline for submitting bids;

2.4. a certificate from the competent head of the tax office confirming that the contractor is not in arrears with taxes, issued not earlier than 3 months before the deadline for submitting bids, or another document confirming that the contractor has entered into an agreement with the competent authority afteron repayment of these receivables, together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the execution of the decision of the competent authority;

2.5. certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fundor other document confirming that the contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or another document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines, in particularzwol exemption, deferral or installment of overdue payments provided for by law or withholding in full the execution of the decision of the competent authority;

2.6. an excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or the register, to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1Act;

2.7. declarations of the contractor about the lack of a decision against him as a precautionary measure forbidding public procurement,

2.8. Contractor`s declaration that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions, or if suchyr or decisions of documents confirming payment of these debts together with any interest or fines or conclusion of a binding agreement on the repayment of these debts;

2.9. the contractor`s declaration of non-payment of taxes and local fees referred to in the Act of 12.1.1991 on local taxes and fees (i.e. Journal of Laws of 2018, item 1445 fromm.),

2.10. declarations of the contractor on belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the contractor may submit, together with a statement, documents or information confirming that links with another contractor do not lead to distortion of competition in the proceedings.

3. EAT document referred to in item 2.1. Contractorany is submitted with the offer in electronic form, on the terms set out in section VI.3. point III of this notice.

4. The Awarding Entity will call the Contractor whose bid has been highest rated for submission within the designated, not shorter than 10 days, date valid as at the date of submitting the documents and statements specified in item 2.2 2.9. The document referred to in pkt 2.10., the Contractor is obliged to submit within 3 days from the date of posting on the Employer`s website information referred to in art. 86 section 5 of the Act, i.e. information from the opening of offers.

6. In the case of a commercial partnership, the disclosure of the circumstances referred to in point 2.4 may relate only to taxes whose taxable person is the company itself (certificate issuedcompany, not associates). In the case of partners of a civil law partnership, a list of circumstances referred to:

- in points 2.4, 2.8, 2.9 applies to both partners and the company itself,

- in point 2.5 applies to individual partners or for the company itself, in point 2.7 - applies to individual partners civil law partnership.

7. The Employer requests the Contractor to submit statements and documentsntow listed in points 2.2 to 2.9, regarding the entity on whose situation the contractor relies on the principles set out in art. 22a of the Public Procurement Law

1. Contractors who meet the conditions referred to in Art. 22ust. 1b points 2) of the Public Procurement Law regarding financial situation. 2. In order to confirm compliance with the conditions for participation in the proceedings, the Contractor shall be obligedto provide the following statements and documents: 2.1. a current statement as at the date of submission of tenders, constituting a preliminary confirmation that he fulfills the conditions for participation in the procedure. The contractor submits the above statement in the form of the JEDZ / ESPD document; 2.2. information from the bank or cooperative savings and credit union confirming the amount of financial resources possessed or the creditworthinesscontractor`s contract, not earlier than 1 month before the deadline for submission of bids; Note: the contractor should indicate financial resources or creditworthiness or jointly financial resources and creditworthiness in the amount specified in item 5 in Section III.1.2) of this notice. If the Contractor indicates financial resources or creditworthiness expressed in another currencyzloty, the Employer for the purposes of assessing compliance with the condition of participation in the proceedings will convert the amounts given into zlotys (with accuracy to two decimal places) at the average exchange rate announced by the National Bank of Poland on the day of publication of the announcement of this order in the Official Journal of the European Union, and if on that day not announced, according to the NBP average exchange rate table recentlyIf, for a valid reason, the Contractor cannot submit the document required by the Employer, referred to in point 2.2, the Employer allows the submission by the Contractor of another document referred to in art. 26 section 2c of the PPL Act. If the Contractor, demonstrating compliance with a condition regarding financial standing, relies on the financial capacity of other entities on the basis ofreferred to in art. 22a paragraph 1 of the Public Procurement Law, the Awarding Entity requires submitting the information referred to above (information from the bank or cooperative savings and credit union) regarding these entities; 2.3. a third party obligation to make resources available, if applicable. In order to assess whether the contractor relying on the capabilities or situation of other entities on the principles set out in Art. 22ay Public Procurement Law, it will have the necessary resources to the extent necessary for the proper performance of a public contract and an assessment of whether the relationship between the contractor and these entities guarantees real access to their resources, the Contractor together with the offer obliges these entities to provide him with the necessary resources for the purposes of the contract, i.e. which specifies in particular: a) scopes available to the contractor of the resources of another entity; b) the method of using the resources of another entity by the contractor when performing the public contract; c) the scope and duration of the participation of another entity in the performance of the public contract. 3. EAT document referred to in point 2.1. (if you rely on third party resources, an EAT document is also submitted for those entities) must be submittedtogether with the offer in electronic form, on the terms set out in Section VI.3. point. IV.1.a) of this announcement. The EAT of the entity on which the Contractor refers is to be filled in to the extent that there are no grounds for excluding the third party and to the extent that the Contractor uses the resources of the third party. The obligation referred to in point 2.3. The contractor obliged themst submit with the offer.4. The Awarding Entity will call the Contractor whose bid has been highest rated for submission within a designated period, not shorter than 10 days, valid as at the date of submission of the documents and statements referred to in point 2.2 and in Section III.1.1). point. 2.2 2.9.

I. Information about contractors having their registered office or place of residence outside the territory of the Republic of PolandPoland 1. If the contractor has his registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Section III.1.1) above, he shall submit: 1.1. in the case of the document referred to in Section III.1.1). point. 2.2., 2.3 information from the relevant register or, in the absence of such a register, another equivalent document issued by a competent judicial authorityy or administrative country in which the contractor has its registered office or place of residence or place of residence has a person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13, 14 and 21 of the PPL Act; 1.2. in the case of documents referred to in Section III.1.1) point 2.4., 2.5, 2.6 shall submit a document or documents issued in the country in which the contractor is established or hassce of residence, confirming accordingly that: a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines, in particular he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in fulland implementation of the decision of the competent authority,

b) its liquidation has not been opened or its bankruptcy has been declared. 2. Documents referred to in item 1.2 b) above should be issued not earlier than 6 months before the deadline for submission of tenders. Documents referred to in item 1.2 a) above should be issued not earlier than 3 months before the deadline for submitting bids. 3. If in the countryin which the contractor has its registered office or place of residence or place of residence has the person to whom the document relates, no documents referred to in point 1 are replaced by a document containing a statement of the contractor, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, made by a notary public ord a judicial, administrative or professional or economic self-government body competent for the registered office or place of residence of the contractor or the place of residence of that person. The resolution referred to in point 2 shall apply accordingly. 4. In the event of doubt as to the content of a document submitted by the contractor, the contracting authority may contact the competent authorities of the country concerned into whom the contractor has its registered office or place of residence or place of residence has the person to whom the document relates, to provide the necessary information regarding this document.

II. Information on the manner of communication between the Employer and the Contractors

1. Communication takes place via the Purchaser`s purchasing platform https://mpkkrakow-pzp.logintrade.net/rejestracja/ustawowe.html It is allowed tocorrespondence via e-mail, excluding the submission of tenders.

2. Persons authorized to communicate with contractors: Mr. Elżbieta Cieślik, e-mail: zamycji @ mpk.krakow.pl,

III. Detailed information on how the contracting authority communicates with contractors, submitting statements and documents, how to prepare the offer, and the forms of statements and documentsthe sections were defined in the ToR. Basic information below:

1. The Contractor is obliged to submit along with the offer:

a) the Single European Order Document (EAT), the Contractor is obliged to submit under pain of nullity in an electronic form signed by a qualified electronic signature;

b) the obligation of a third party to make resources available, the contractor is obliged to submitelectronic form signed with a qualified electronic signature signed by the entity, the resources referred to by the contractor or an electronically certified copy of the document.

2. The offer should be submitted in the original.

3. Documents made in a foreign language are submitted together with a translation into Polish.

4. Power of attorney if it concerns the power of attorney to sign the offer, issued dfor the contractor or contractors jointly applying for the award of the contract must be submitted in electronic form in the original or notarized copy of the document with a qualified electronic signature.

In the case of a power of attorney submitted in a language other than Polish, it should be submitted together with a translation into Polish.

5. In the event of submitting an offer by the Contractoro jointly applying for the contract power of attorney to represent all contractors jointly applying for the contract. A proxy may be appointed to represent contractors in proceedings or to represent in proceedings and to conclude a contract.

6. The documents or statements shall be submitted in the original in the form of an electronic document or in electronic forma copy of the document or statement certified as true to the original.

7. Confirmation of compliance with the original is made by the contractor, entity whose capacity or situation relies on the contractor, contractors jointly applying for the award of the public contract or subcontractor, in the scope of documents or declarations which affect each of them.

IV. Deadline for binding offerreferred to in section IV.2.6 of this notice is 60 days.

V. In accordance with art. 24aa of the Public Procurement Law, the Employer may first evaluate the offers, and then examine whether the Contractor whose tender has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.
