The subject of the contract is the construction of a water supply and sanitary sewage system together with connections to buildings in the area of ul. Gawlaki in Zakomaster. The scope of the contract includes:

Main Site: Lesser Poland Voivodship, Tatra County, Zakopane City Commune, Gawlaki Street Area, POLAND

1. The subject of the contract is the construction of a water supply and sanitary sewage system together with connections to buildings in the area of ul. Gawlaki in Zakopane.

2. The scope of the contract includes:

a) construction of a water supply network with connections to the buildingwith a total length of

3 622.00 m including:

- 0 90 mm PE 1 812.0 m,

- 0 63 mm PE 800.0 m,

- 0 50 mm PE 210.0 m,

- 0 40 mm PE 370.0 m,

- 0 32 mm PE 430.0 m,

b) construction of a sanitary sewer network with connections to buildings with a total length of 4 485.00 m including:

- 0 200 mm PVC 3 935.0 m,

- 0 160 mm PVC 330.0 m,

- 0 110 mm PE 220.0 m,

- sewage pumping station 1 pc

Ordersthe ordering party informs that the above lengths of the water supply and sewage network result from the project documentation, determine the estimated needs of the Ordering Party during the period of the contract, not constituting an obligation for the Ordering Party to its full implementation, or the basis for the Contractor to seek compensation claims for failure to complete the entire subject of the contract.

3. the Specificthe scope and description of the subject of the contract includes:

- detailed design for the construction of the water supply and sanitary sewage system together with building connections, Annex I to the ToR,

- technical specification for the execution and acceptance of construction works (hereinafter: "STWiORB"), Annex II to the ToR .

The documentation referred to in point 3, hereinafter referred to as "project documentation" or "technical documentation" is intthe integral part of the Terms of Reference and the model contract.

4. Investment to be implemented in 2020 021. In 2020, investment to the value of PLN 1, 200, 000.00 (net).

5. Commencement date: 4.5.2020. The final date for the completion of the entire subject of the contract is 30.10.2021.

6. Important provisions related to the implementation of the subject of the contract:

a) The Contractor guarantees the implementation of the subject of the contract zgodays with the conditions specified in this ToR and the project documentation specified in point 3.4 of the ToR above.

b) The bid submitted by the Contractor must include all investment costs, including fees related to obtaining valid permits, including occupation of the road lane.

c) The offer submitted by the Contractor must include the costs of restoring the site to its original condition, restoring bituminous surfacesz o.o. along with the foundation after the work has been completed.

d) The order must be made of materials purchased and delivered at the own expense of the Contractor.

e) The building materials are to comply with SEWIK connection conditions, design documentation as well as with the technical specifications for the execution and acceptance of construction works.

f) Purchased materials must have appropriate certificates and approvals allowfor use in the construction of an external water supply and sanitary sewage system.

g) Contractors should read the tender documentation carefully and obtain reliable information on the conditions and obligations that may in any way affect the value, nature of the offer or the implementation of the contract . If the Contractor wins the tender, advertiseregarding changes in the value of the offer in the light of the Contractor's obligations set out above will not be considered.

h) The Contractor shall bear all costs related to the preparation and submission of his offer and all related documents. with direct implementation of the subject of the contract, including decisionsZakopane City Hall.

J) For the construction works provided for in the subject of the order, the Employer has a construction notification of 4.3.2019.

K) Provision of geodetic service and as-built surveying is carried out by the Contractor.

L) The Contractor is obliged to provide a guarantee for construction works for a period of 3 years and for materials and equipment in accordance with GWAmanufacturer's responsibility.

m) After the works have been carried out, the Contractor will be required to obtain written declarations of all plot owners that they do not raise any objections to the order.

Contractors who meet the conditions regarding:

1 may apply for the public procurement. Possessing the right to perform specific activities or activities, ifthe acts impose the obligation to have such powers: the Awarding Entity refrains from stipulating the requirements in this condition. 15 of the regulations.

2. Possession of knowledge and experience: The Employer deems this condition to be met if the Contractor demonstrates thatin the last 5 years before the expiry of the deadlines for submitting bids, and if the business period is shorter in that period, it has performed at least 2 construction works (separate contracts), consisting in the construction or reconstruction of the water supply and sanitary sewage system (at least 1 for each type) each with a length of at least 1 000 mb, including supporting documents thatthat these works were carried out properly.

Assessment of compliance with the abovementioned the condition will be made in accordance with the described manner of assessing the fulfillment of conditions as fulfilled / unfulfilled, based on the attestations, documents and statements described and required in point 8 of the ToR. The content of the attached documents and declarations must clearly show that the above-mentioned conditions are met by the Contractor.

3. Possessing the appropriate technical potential and persons capable of performing the contract: This condition shall be deemed fulfilled by the Employer if the Contractor demonstrates that he has at his disposal a construction manager possessing building qualifications to manage construction works for the construction of the water supply and sanitary sewage system or the corresponding authorizations issued on the basis of previously applicableprovisions

Assessment of compliance with the abovementioned the condition will be made in accordance with the described manner of assessing the fulfillment of conditions as fulfilled / unfulfilled, based on the attestations, documents and statements described and required in point 8 of the ToR. The content of the attached documents and declarations must clearly show that the above-mentioned conditions are met by the Contractor.

4. Economics situationFinancial and financial condition: The above condition will be met by the Employer if the Contractor demonstrates that he is insured against civil liability in the scope of conducted business activity, including the subject of the order, for a guarantee sum of not less than

PLN 1, 000, 000.00 (in words: one million zlotys) and 00/100). The assessment of compliance with the above conditions will be made in accordance with the method describedassessing the fulfillment of conditions as fulfilled / unfulfilled, based on the attestations, documents and statements described and required in point 8 of the ToR. The content of the attached documents and declarations must clearly show that the above-mentioned conditions are met by the Contractor.

Contractors who are not subject to exclusion from the award procedure may apply for the orderorders based on art. 17 of the SEWIK sectoral procurement regulations.

Economic and financial situation:

The above condition is considered by the Purchaser if the Contractor demonstrates that he is insured against civil liability in the scope of conducted business activity, including the subject of the order, for a guarantee sum of not less than 1, 000, 000, PLN 00 (in words: one millionzlotys and 00/100).

Assessment of compliance with the abovementioned conditions will be made in accordance with the described manner of assessing the fulfillment of conditions as fulfilled / unfulfilled, based on the attestations, documents and statements described and required in point 8 of the ToR. The content of the attached documents and declarations must clearly show that the above-mentioned conditions are met by the Contractor.

1. Procedure, which this document applies to is marked with the sign: 1S / Gawlaki / 2020. Contractors should in all contacts with the Employer refer to the above designation.

2. The public procurement procedure is conducted in an open tender with an estimated value not exceeding the amounts specified in the provisions issued on the basis of art. 11 paragraph 8 of the Act ofa 29.1.2004 Public Procurement Law (i.e. Journal of Laws of 2019, item 1843, as amended, hereinafter referred to as: "Pzp Act") based on the provisions of the SEWiK sectoral procurement regulations.

3. Before submitting offers The Contractor should read the regulations for awarding sectoral contracts in force at SEWiK.

5. The Specification of the Essential Terms of the Order together with the attachments constitutes a complete document which is obligatory for the Contractor and the Employer throughout the entire procedure.

6. In matters not covered by this ToR, the relevant provisions specified in the SEWiK sectoral procurement regulations and the Act of 23.4.1964 shall apply.Civil Code (i.e. Journal of Laws of 2019, item 1145, as amended, hereinafter the "Civil Code").

7. The proceedings are conducted in Polish. The offer and other documents in the proceedings shall be submitted in Polish, unless the Specification of the Essential Terms of the Order provides otherwise Documents drawn up in a foreign language shall be submitted together with a translation into Polish.

8. The Purchaser informs that wheneverthe subject of the order specified in the Terms of Reference, design documentation and STWiORB is described by indicating the trademark, patent or origin. The Employer allows equivalent solutions, i.e. having features, technical and operational parameters, application, not worse than those described in the Terms of Reference, design documentation and STWiORB. Demonstration of the equivalence of the offered item lies with the ExecutorWCY. In a situation where the Contractor intends to use equivalent materials or devices, it is obliged to attach to the offer a list of offered equivalents together with characteristics and documents confirming the same or better quality, e.g. quality specifications, quality control certificates, certificates, etc., which they confirm in a non-fraudulent manner. doubt proposed equivalence hasmaterials or devices.

9. The Employer requires employment throughout the duration of the contract by the Contractor or subcontractor under an employment contract within the meaning of the provisions of the Act of 26.6.1974 Labor Code (i.e. Journal of Laws of 2019, item 1040, as amended, hereinafter : "KP") persons performing the activities of heavy equipment or construction equipment operators and persons performing installation works andassociated with the construction of the water supply and sewage system.

10. The contractor will be bound by the offer for a period of 45 days. The offer validity period begins with the submission deadline (Article 48 of the Regulations).
