The subject of the order is the construction of the Museum of Underwater Archeology and Fisheries in Łeba, in the scope enabling:

Main Site: Łeba, POLAND.

1. The subject of the order is the construction of the Museum of Underwater Archeology and Fisheries Archeology in Łeba, to the extent enabling:

1.1 to obtain, in accordance with the provisions of the Construction Law, permits for useand

1.2 using the building as intended.

2. The subject of the orders also includes the execution of the preceding works, consisting in the disassembly of existing buildings on the construction site, as well as the execution of the plot land development and the implementation of the necessary installation connections.

3. A detailed description of the subject of the order is contained in Part III of the ToR.

4. IfThe ordering party indicated the origin (brand, mark, producer, supplier) of materials or standards, approvals, specifications and systems referred to in art. 30 of the Public Procurement Law, the Employer allows the use of materials or equivalent solutions, provided that they guarantee the implementation of the robot in accordance with the documentation comprising the description of the objectand ensure obtaining technical parameters not worse than those assumed in the above-mentioned documents. If the Contractor wants to change any of the products or materials indicated in the design documentation, the Contractor should prove the equivalence of the proposed product or material in relation to the one indicated in the project documentation and obtain the relevant written consentan appropriate inspector of investor's supervision and the Employer.

5. In the scope of products, materials and devices to be used during the implementation of this order, the provisions contained in the Technical Specifications for Construction and Acceptance of Construction Works are also valid. Contractors may participate in the proceedings, for which there are no grounds for exclusion from the proceedings under Art. 24 sec. 1 item 13-23 of the Act, excluding the premises specified in art. 24 sec. 1 point 13 lit. d and point 14 of the Act on crime referred to in art. 24 sec. 1 point 13 lit. d of the Act (premises for mandatory exclusion) and in art. 24 sec. 5 points 1, 5 and 6 of the Act (conditions for optional exclusion) and fulfilling the conditions for participation in the proceedings set out in item 8.2. I SIWZ.

2. According to art. 22 par. 1b of the Act, the Contestants who meet the conditions set out by the Employer, regarding: - Competence or entitlements to conduct a specific professional activity may apply for awarding the Contract, if it results from separate regulations,

- Economic or financial situation,

- Technical capacity or professional.

3. The Awarding Entity did not specify the condition in the proceedings in questionparticipate in the proceedings regarding: competences or entitlements to conduct a specific professional activity, if it results from separate provisions.

4. The Procurer will exclude the Contractor from the proceedings for the award of the contract to which any of the conditions specified in art. 24 sec. 1 item 13-23 of the Act, excluding the premises specified in art. 24 sec. 1 point 13 lit. d) and paragraph 14 Lipsin the area of an offense referred to in Article 24 sec. 1 point 13 lit. d) of the Act and in art. 24 sec. 5 points 1, 5 and 6 of the Act

5. Contractor, within 3 days from the date of posting on the website the information referred to in 86 par. 5 of the Act, provides the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 Ujoints. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the proceedings. In order to demonstrate that there are no grounds for exclusion from the proceedings and to confirm that the conditions for participation in the procedure have been met, each of the Contractors shall submit a Single Document, an example of which is attached as Annex 4 to Part. And SIWZ. In to the targeton confirmation of meeting the conditions for participation in the proceedings, the Contracting Party informs that the Contractor may limit himself to a general statement regarding all eligibility criteria by completing the α section in part IV and does not have to fill in any of the other sections in Part IV of the Single Document. In the case of joint application for contractors, the Single Documentis submitted by each of the contractors jointly applying for the order.

8. The contracting party, prior to the order being awarded, will call the contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting statements or documents confirming the circumstances referred to in the Single Document.

9. For full information on temat the terms of participation in the proceedings, grounds for exclusion and a full list of statements and documents confirming compliance with the conditions for participation in the proceedings and no grounds for exclusion, due to the limited number of signs possible to be included in this announcement, please refer to the chapters of Part I of the ToR number: 8, 9 and 10.

10. The Contractor is not obliged to submit the axisconfirmations or documents confirming the circumstances referred to in art. 25 para. 1 point 1 and 3 of the Act, if the orderer has statements or documents related to that contractor or can obtain them through free and publicly available databases, in particular public registers as defined in the Act of 17.2.2005 on computerization of entities performing public tasks(Journal of Laws of 2014 item 1114 and of 2016 item 352).

1. The Contractor will fulfill the condition if he proves that: - he is insured against civil liability in the scope of conducted activity related to the subject of the order for a guarantee sum not less than PLN 5, 000, 000.00.

2. To confirm compliance with the condition of participation in the proceedings, please submit: - supporting documentsthat the contractor is insured against civil liability in the scope of conducted activity related to the subject of the order for the guarantee sum determined by the ordering party.

Information on documents and statements submitted by foreign entities

1. If the contractor is established or resides outside the territory of the Republic of Poland, instead of the documents listed inpoint 9.8.1. 9.8.4. part. I SIWZ submits documents according to - 7 of the Ordinance of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the proceedings for the award of the contract (Journal of Laws, item 1126 as amended), ie: - information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or admiThe country in which the contractor has its registered office or place of residence or place of residence is the person concerned by information or a document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the Act (with the exclusion of the premises contained in Article 24 paragraph 1 item 13d of the Act) and paragraph 5 points 5 and 6 of the Act,

- a document or documents issued in the country in which the contractor has its registered office or placeresidence, confirming, respectively, that its liquidation has not been opened or that bankruptcy has been declared. Documents referred to in point 9.9.1., 9.9.2. part. And SIWZ, should be issued no earlier than 6 months before the deadline for submission of tenders. If the country in which the contractor has its registered office or place of residence or place of residence has the person to whom the document relates, it does not appeardocuments referred to in point 9.9.1. and 9.9.2.cz. I SIWZ shall be replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document concerned, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authorityto the seat or place of residence of the contractor or place of residence of that person. Time limits in paragraph 9.10. part. I SIWZ shall apply accordingly.

4. Contractor established on the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is covered by the document specified in point 9.8.1. 9.8.3. part. I SIWZ, consists of a document, referred to in point 9.9.1. to the extent specified in art. 24 sec. 1 point 13 (excluding the premises contained in Article 24 paragraph 1 items 13 d) and 21 and par. 5 point 6 of the Act. If there is no such document in the country in which the person has a place of residence, no such documents are issued, it is replaced by a document containing a statement of that person made before the notary or before the authorityadministrative or professional self-regulatory or economic authority competent for the place of residence of that person. The document should be issued not earlier than 6 months before the deadline for submission of tenders. The contracting authority may at any stage of the procedure call for contractors to submit all or some declarations or documents confirming that they are not subject toexclusion, meet the conditions for participation in the proceedings, and if there are reasonable grounds to consider that the previously submitted statements or documents are no longer valid, to submit valid statements or documents. Order mode: unlimited tender.

2. The Contracting Authority provides for the possibility referred to in art. 24 aa paragraph 1 of the Public Procurement Law (Pzp).

3. Whereverin the content of the advertisement, the terms "Act" or "PZP Act" should be understood - the Act of 29.1.2004 Public Procurement Law (ie OJ 2015, item 2164, as amended), - 4. Each Contractor is obliged to secure his offer with a bid bond in the amount of PLN 250, 000.00.

5. The Contractor is obliged to attach to the offer a statement, valid as of the day of submitting the offers, that the Contractor: a) is not subject toand exclusion; b) meets the conditions for participation in the proceedings; in the form of a Single European Order Document (EAT). The Contracting Authority informs that on the website: https://www.uzp.gov.pl/baza-wiedzy/jednolity-europejski-dokument-zamowienia, there are: - Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down the standard form for the Single European Dockment Orders, - Instructions for completing the EED / ESPD, Editable version of the Uniform European Order Document (EAT), - Electronic filling tool JEDZ / ESPD.

6. Criteria for the evaluation of offers (weight of individual criteria, identical in all parts of the order):

- Price - 60% weight,

- Guarantee period and warranty - 40% weight.

7. The Contracting Authority does not provide for the conclusion of a framework agreement.

8. The ordering party does not plan to establish a dynamic purchasing system

9. The Awarding Entity does not provide for the selection of the most advantageous offer by using an electronic auction.

10. The Awarding Entity does not provide for grantingorders referred to in art. 67 sec. 1 point 6) of the Act - 11. 12. Due to the characteristics of the order based on art. 9a paragraph 2 Public Procurement Law, submission of the offer should be preceded by a Contractor's local vision.
