The subject of the order is related to the implementation of the investment project: "Execution of the dedusting installation, desulphurisation and denitrification systems to meet the new requirements environmental protection standards in the Heat installationMunicipal House in Pabianice "and includes the execution of necessary design, construction and installation works, implementation of equipment and materials deliveries, commissioning, training and warranty tests, obtaining certificates and permits necessary to transfer the dedusting installation and desulphurisation and denitrification installations for use and performance of obligations consequentch from the granted quality guarantee and warranty for defects.

Main Site: 95-200 Pabianice, ul. Konstantynowska 62

The scope of the undertaking includes:

1. Installation of flue gas denitrification with primary methods supported by the non-catalytic method SNCR for boilers K1 and K4,

2. Construction of flue gas desulphurisation installation for boilers K1, K3 and K4,

3 Modernization of existing dust collection systems-construction of a new dust removal system for bag filters,

4 Construction of all auxiliary installations and facilities necessary for the correct operation of the Flue Gas Installation, including installation of auxiliary utilities.

Flue Gas Installation is intended to purify flue gas resulting from fuel combustion and the entire range of boiler operation ( K1, K3, K4) to guarantee maair emissions (measured on the chimney) at levels not higher than the emission limits specified in the IED Directive and the BAT conclusions.

The contractor's obligations will include, among others:

1. Implementation of Project Documentation in the scope specified in chapter 2.1.2.1 of the Functional-Utility Program, also referred to as "PFU", including the development of Executive Projects and obtainingall legally required arrangements, opinions and checks, except those held by the Employer and attached to the Functional Program (Part III of the ToR).

2. Transfer of copyrights to the completed Design Documentation in the fields of use indicated in the Model Agreement for public procurement, constituting Part II of the ToR.

3. Construction of the S Cleanse Installationfireplaces including auxiliary facilities and installations as well as land development in accordance with the requirements specified in the Functional and Functional Program.

4. Starting the whole installation (including all installed devices), providing the instruction manual along with the relevant training of the Employer's employees.

5. Obtaining all necessary decisions and permits, including permits-for use with required receipts: media gestators, chimney sweep, UDT, TDT, Sanepid, Fire Brigade, PINB.

6. Preparation of the As-built Documentation.

7. Provision of services resulting from warranty obligations and warranty for defects, and in particular the provision of services installed under the Contract for Works (including design) of facilities, equipment and installations and the implementation ofmagani by the manufacturers installed warranty equipment during the warranty period.

The subject of the orders should be implemented in accordance with:

1. Records of the Functional Program (PFU) constituting Part III to this ToR, along with appendices,

2. Provisions of the Model Agreement on public procurement, constituting Part II of the ToR.

Information clause - According to art. 13 para. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (generally the Regulation on data protection) (Journal of Laws UE L 119, 4.5.2016, page 1), hereinafter "RODO", the Contracting Authority informs that:

B) The Administrator informs that he has appointed a Data Protection Officer for the proper protection of personal data., with which you can contact the following e-mail address: iod@zec.pabianice.pl Administrator in ceof proper personal data protection has been set up by the IT System Administrator, with whom you can contact the following e-mail address: asi@zec.pabianice.pl. The contractor will fulfill the condition if it proves that he has funds or creditworthiness for at least PLN 6, 000, 000 (in words: six million zlotys) (in the case of amounts in foreign currency calculated according to the average NBP exchange rate fromThe contractor is obliged to submit together with the offer (Annex No. 1 to the ToR): a) The list of prices prepared in accordance with the formula set out in Annex 1A to the ToR.

b ) Technical and technological description prepared in accordance with the set of required information specified in Appendix No. 1B to the ToR.

C) Wykaz Guaranteed Parameters based on the form specified in Annex 1C to the ToR.

d) Declaration in the form of a single European order document (hereinafter referred to as "EAT"). The template for a single European order document is specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form for a single European order document (Dz.-Office. UE L series 2016, No. 3, page 16). The content of EAT was also specified in Annex 2 to the ToR (e) Declaration required from the contractor to fulfill the information obligations provided for in art. 13 or art. 14 RODO (within and in accordance with the formula specified in Attachment No. 6 to the Terms of Reference - Contractor, within 3 days from the date of posting on the website the information referred toin art 86 par. 5 of the PPL, shall provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in Section VIII, point 2.12, in accordance with the model constituting Annex 5 to this ToR. Along with the submission of the statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the proceedings regarding• At the request of the Ordering Party in order to confirm compliance by the Contractor with the conditions of participation in the procedure, the Contractor will be required to submit declarations or documents indicated in the Min. of Development Regulation of 26.7.2016 on the types of documents that the contracting authority may request from the contractor proceedings for granting the order (Dz.U.2016.1126 of 27.7.2016), i.e.. in relation to the economic and financial situation - indicated in -2 para. 2 points 3, and in relation to the technical and professional capacity indicated in -2 par. 4 points 1) and 10). In order to demonstrate the absence of circumstances causing exclusion from the proceedings at the request of the Awarding Entity, the Contractor should submit the documents indicated in -5 point. 1-10) of the above-mentioned Regulation. The Contracting Authority allows documents ofcorrective specified in - 7 and 8 of the above Regulation. The form and language of the submitted documents is specified in -14 -16 of the Regulation. • The required documents should be presented in the form of an original or photocopy confirmed as a true person by a person or persons authorized to represent the Contractor, except for statements, including those about whom referred to in art. 22a of the Act, subcontractors, which should be presented in the original. In the case of Contractors jointly applying for the order, copies of documents relating respectively to the Contractor or these entities are certified as true copies by the Contractor or by these entities.

The Employer will exclude from the Contractor's conduct:

1) who did not meet the conditions of participation specified in theabout the order and SIWZ.

2) who will not prove that they do not have the conditions specified in art. 24 sec. 1 item 13-23 of the PPL,

3) to which the conditions set out in art. 24 sec. 5 points 1), 2), 4) and 8) of the PPL pursuant to the procedure and on the terms set out in paragraph 7-10 of the cited article of the Act.
