Subject scopeat the request, the construction works include reconstruction, refurbishment, construction of new elements of the football and speedway stadium in order to restore the basic stadium functions and improve energy efficiency in public infrastructure.
Main Site: Świętochłowice.
The subject of the order includes in particular:
1. execution of demolition robots and high greenery fragmentsj
2. repair of the track and field,
3. replacement of paved surfaces,
4. renovation of the stands,
5. reconstruction and thermomodernization of the building of the "Skalka" Sports and Recreation Center headquarters,
6th construction of new buildings, other facilities and land development elements,
construction of the network and installations related to the functioning of the stadium.
The subject of the orders is specified in the AnnexNo. 1 to the specification of essential terms of orders, while a detailed description of the subject of the order is included in the design documentation, robot's bill, technical specifications for the performance and acceptance of construction works and industry arrangements, constituting Annex No. 2 to the specification of essential conditions of the order, which are the documents together with the description of the subject of the order should be openedAttach the total.
The ordering party requires employment by the contractor or subcontractor on the basis of an employment contract, within the meaning of the provisions of the Act of 26.6.1974. Labor Code (consolidated text Journal of Laws of 2016, item 1666 with later amendments .) persons performing the following activities necessary to carry out the subject of the order during the execution, which is a risk of security and safety hazardspeople:
1) performing earthworks related to moving or compacting the soil,
2) working in trenches,
3) working at a height above 1.0 m,
4) demolition works, including making holes in existing construction elements of buildings,
5) assembly, disassembly and maintenance of scaffolding,
6) works carried out with the use of cranes and winches,
7) works carried out under or nearwater power lines, at a distance counted horizontally from the outer wires, smaller than:
a) 3.0 m - for lines with rated voltage not exceeding 1 kV,
b) 5.0 m - for lines with rated voltage above 1 kV, but not exceeding 15 kV,
c) 10.0 m - for lines with rated voltage above 15 kV, but not exceeding 30 kV,
8) construction works wherethere are actions of chemical substances threatening the safety and health of people,
9) works carried out at temperatures below -10C,
10) construction works carried out in wells,
11) construction works carried out during assembly and disassembly of heavy prefabricated elements - works whose mass exceeds 1, 0 t.
The ordering party will require the contractor to grant the robots for completed workswarranty and warranty for a period of 60 months, and for built-in materials, equipment, devices and equipment warranty supplier / manufacturer, counting from the date of final acceptance of the subject of the order, with the reservation that the structured cabling system should be covered by a 25-year system guarantee issued by the cabling manufacturer, and cabinets of structural installations should have a minimum guarantee of 60 mE-mail: Documents and statements that the contractor will be required to submit at the request of the Employer (applies only to the contractor whose offer has been rated the highest).
1) Pursuant to the provision of art. 24aa of the Public Procurement Law, the Awarding Entity will first evaluate the tenders submitted, and only for the contractor whose tender has been rated the most, will examine the premises for exclusion fromparticipation in the proceedings and meeting the conditions for participation in the proceedings. - Documents confirming no grounds for excluding the contractor from participation in the proceedings: - information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids,
- certificate of the competent head of the office of the treasuryego confirming that the contractor is not in default of paying taxes, issued no earlier than 3 months before the deadline for submission of bids, or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of these receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or distributionNo payment of overdue payments or suspension in full of the decision of the competent authority, - a certificate from the relevant organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions than 3 months before-expiry of the deadline for submission of tenders, or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of such receivables, including any interest or fines, in particular obtained legally permissible, postponement or installment payment of overdue payments or suspension in full of the implementation of the decision authority,
- a copy from the relevant register-or from central records and business information, if separate regulations require an entry in the register or records to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Public Procurement Law Act,
- the contractor's statement that he has not been the subject of a final court judgment or final administrative decision on default in the payment of taxes, fees or contributions-for social security or health insurance, or - in the event of such a verdict or decision - documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement on repayment of these debts, - declaration of the contractor about the lack of a ruling against him as a precautionary measure applying for public orders- contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (consolidated text Journal of Laws of 2016, item 716). If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to above, the Contractor shall submit the documents specified in par. 7 will be resolvedthe Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the procurement procedure. - The contracting authority shall call the contractor whose tender has been best assessed to submit in the designated, no shorter than 10 days of time, valid as of the date of submission of the following statements or documents, which afterthey claim fulfillment of the conditions of participation in the proceedings: - information of the bank or cooperative savings and credit fund confirming the amount of funds owned or creditworthiness of the contractor in the period not earlier than one month before the deadline for submission of tenders. 144 section 1 point 1 of the Public Procurement Law, the Contracting Authority provides for the possibility of changing the provisions-contract concluded in relation to the content of the offer, on the basis of which the contractor was selected:
1) in terms of its performance, in the case of: a) increasing time-consuming performance of replacement work in relation to the time-consuming primary robot covered by the subject of the contract, in obtaining a use permit for reasons independent of the contractor,
2) in the scope of change of the osob in the positions of the construction manager and managers of the robot in the event of inability to perform the activities entrusted to them in the event of: death, long-term illness, loss of rights, termination of the contract or failure of those persons to perform their duties,
3) changes in the remuneration due to the contractor, in the case of: a) pond changesk of the tax on goods and services,
b) changes in the minimum remuneration for work determined on the basis of the provisions of the Act on minimum remuneration for work, - c) changes in the rules of being subject to social insurance or health insurance or the rate of social or health insurance premium,
4 ) in the field of materials, technical parameters, construction technology, building robotin the case of the necessity to execute any part of the robot covered by the subject of the order, using different technical or technological solutions than indicated in the design documentation and resulting from the identified defects of this documentation or change of legal status based on which prepared if the application ofthe solutions seen were threatened with non-performance or improper performance of the subject matter of the order.
5) in the scope of changes in the remuneration due to the contractor in the event of: a) differences between the value of construction works and the value of works ordered and performed, b) in the case of changes specified in point 4).
Within 3 days from the date of publication in the Publi Information Bulletininformation on the opening of tenders, each contractor is obliged to submit a declaration on belonging to or a lack of belonging to the same capital group, submitted pursuant to art. 24 sec. 11 of Public Procurement Law
2) In the case when the offer is submitted by several entities acting jointly (consortium), the declaration is submitted by each contractor separately.
3) The declaration should be submitted on the basis ofpublished in the Public Information Bulletin information on the opening of offers (summary list of open offers) containing, among others, list of contractors who submitted bids on time (model of declaration is attached as Annex 6 of the specification).
