1. The subject of the order is executionerection of the speedway stadium with facilities and infrastructure accompanying the Skałka Sports and Recreation Center in Świętochłowice 40 Bytomska Street and reconstruction and thermomodernization of the building of the "Skalka" Sports and Recreation Center building - stage I reconstruction "with obtaining a valid occupancy permit.

1 The subject of the order is the reconstructionNew speedway stadium with facilities and infrastructure accompanying the "Skalka" Sports and Recreation Center in Świętochłowice, Bytomska 40 street, and reconstruction and thermomodernization of the building of the "Skalka" Sports and Recreation Center - stage I reconstruction "with obtaining a valid occupancy permit. The subject of the order has been defined in Annex 1 to the specification of beingsorder conditions.
3. However, a detailed description of the subject of the order is included in the design documentation, robot quantities, technical specifications of performance and acceptance of construction works and industry agreements, constituting Annex 2 to the specification of relevant conditions of the order, which documents together with the description of the order should be considered together.not to the content of the provision of art. 24aa of the Act P.p. The ordering party will first evaluate the offers, and only for the contractor whose offer has been rated the most, will examine the exclusion conditions and fulfill the conditions for participation in the procedure.
The contracting authority will exclude contractors from the procedure (mandatory conditions for exclusion of the contractor). about whichreferred to in art. 24 sec. 1 item 12 - 23 of the Act of the State Treasury and in cases referred to in art. 24 sec. 5 point 1, point 2, point 4 and point 8 of the Act P.z.p. (optional conditions for the exclusion of the contractor).
The contracting party, prior to the order being awarded, will call the contractor whose offer has been best assessed, to submit in the shortened, not less than 10 days, date as of the date of the following inspectionhand or documents that confirm no grounds for exclusion: - information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the Act of the State Treasury issued not earlier than 6 months before the deadline for submitting offers,
- certificate of the competent head of the tax office confirming that the contractor is not in arrears with paying taxes, issued not earlierthan 3 months prior to the deadline for submission of bids, or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of installments due for payment or suspension in full of the execution of the decision proper organu,
- a certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the contractor has concludedagreement with the competent authority regarding the repayment of such receivables along with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension of the full implementation of the decision of the competent authority, - copy of the relevant register or central register and information on business activities, if separateThe entries require an entry in the register or records to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act P.z.p,
- the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums or - in the event of such a verdict, orb decisions - documents confirming payment of these receivables together with possible interest or fines or conclusion of a binding agreement regarding repayment of such receivables, - declaration of the contractor about the lack of a ruling against him as a preventive measure of prohibition of applying for public orders,
- declaration of the contractor on non-admission with payment of taxes and local feesreferred to in the Act of 12.1.1991 on local taxes and charges (consolidated text, Journal of Laws of 2016, item 716).
Documents confirming no grounds for exclusion submitted by the contractor who is established or place of residence outside the territory of the Republic of Poland have been specified in par. 7 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents, asthey can be requested by the contracting party from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126).
Contractors who prove that they have the funds or the ability to submit the contract in question can apply to the condition regarding the financial situation credit card in the amount not less than PLN 10, 000, 000.
In the case of joint offer, if the offer is submitted by the contractory A jointly applying for the award (consortium), the Ordering Party will consider this condition for participation in the procedure if at least one of the contractors (consortium members) proves that they independently have financial resources or creditworthiness for at least PLN 5, 000, 000 million. Creditworthiness should be understood as the ability of the economic operator to repay the drawn creditz oo along with interest on dates specified in the contract (Article 70 paragraph 1 of the Act of 29.08.1997 Banking Law (consolidated text Journal of Laws of 2016, item 1988 with later amendments). up to 3 days from the date of publication in the Public Information Bulletin of information on the opening of bids, each contractor is obliged to submit a statement on belonging to or a lack of belonging to the same capital group, submitted under the rule of art. 24 sec. 11 of the Poviat Act. According to the content of art. 144 section 1 point 1 of the Act P.z.p. The contracting authority provides for the possibility of changing the provisions of the contract in relation to the content of the offer, based on which the contractor was selected:
1) in the scope of its implementation, in the case of: a) increasing time-consuming performance of replacement work in relation to the time consumed by the robot basic covered by the subject of the contract,
b) delays in obtaining permission to use for reasons independent of the contractor.
2) in the scope of change of the construction manager and managers in the event of such events as: death, long-term illness, loss of rights, termination of the contract, failure to comply with entrusted duties - 3) in the scope of change of the amount of fundsthe due contractor in case of: a) changes in the rate of tax on goods and services, b) changes in the minimum remuneration for work determined on the basis of the provisions of the Act on minimum remuneration for work, c) changes in the rules of being subject to social insurance or health insurance; amount of social security or health insurance premium,
4) in the scope of materials, bytechnical frames, the technology of construction works execution, the manner and scope of the contract performance in the event of any part of the robot being covered by the contract subject, using different technical or technological solutions than indicated in the design documentation, resulting from identified defects of the documentation or change of state in oparciu, for which it was prepared, if the application of the proposed solutions would result in non-performance or improper performance of the subject of the contract.
5) in the amount of gross remuneration in the case of: a) the difference between the value of construction works and the value of commissioned and performed spare parts, b ) in the case of the changes referred to in point 4)
