Subject of the present a public procurement contract is the execution of a project for the construction and maintenance of a project: "Reconstruction and rehabilitation of part of the municipal road networkand in municipality Varshets - municipal road MON 1092 / III-812 / Varshets - Zanozhene - Spanchevtsi / III-812 / and municipal road MON3097 / MON1092 / Zanozhene -
Main site: Varshets and Spanchevtsi village, Varshets municipality, Montana district
The municipal road MON 1092 / III-812 / Varshets - Zanozhene - Spanchevtsi / III-812 / km 0 000 to km 6 175 2951, 32m "was developed- Division 1 from km 0 000 to km 1 001, - stretch 2 from km 2 718 to km 3 702,
- stretch 3 from km 5 235 to km 6 175.
The project envisages rehabilitation to shall be carried out in areas with a solid foundation, by two layers of asphaltic concrete - a layer of 4 cm thick asphalt concrete and an asphalt concrete binder for a 6 cm thick bottom layer of the coating. Reconstruction-will be carried out at a weak base in the sections and will include the construction of a road base with a thickness of 40 cm and an asphalt layer with a total thickness of 16 cm. The construction of a supporting wall from km 3 045 to km 3 065 is envisaged. Reconstruction of the pavements in settlements and new concrete curbs, banquet design, new trenches, Italian grooves, revision and / or replacement of-rainfall and inspection shafts where needed. A high-speed pipeline network will be constructed along the route through protected pipes and shafts. A new horizontal marking and vertical signaling is provided.
The subject of this order includes at least the following activities:
1. Execution of construction works in compliance with the requirements of Art. 169, para. 1 and 3 of the TDA, the technical specifications, the projects in the Phase "Detailed Design", the prescriptions and orders in the Order Book and the quantitative accounts, as well as the rules for the implementation of the Works and the measures for protection of the life and health of the people on the construction site. in the construction of the necessary construction products, materials, equipment, etc., in accordance with the basic construction requirementsas well as meeting the technological requirements for their incorporation. Production and / or delivery of construction parts / elements and their incorporation into the construction. Perform the necessary tests and laboratory tests
5. Preparation of all necessary construction documentation, as required by the TDA and Ordinance No. 3 of 31.07.2003, as well as other documentation required by laws and normsdocuments necessary for the performance of the contract. Preparation of construction documentation.
7. Preparation of a complete geodetic recording of the reconstructed infrastructure according to the CPRA
8. Participation in the procedure for commissioning of the construction. Troubleshooting if found during the delivery of the construction and its commissioning.. Guarantee maintenance of the construction and removal of defects within the guarantee period
The participant should be entered in the Central Professional Register of the Constructor for the execution of constructions with the following scope: construction activities according to the second group, third category, according to Ordinance 1 of 30.07.2003 for the Nomenclature of Construction Types and Art. 137 of the Territory Arrangement (the requirement applies to both of themown positions).
According to art. 60 of the PPA, foreign participants can prove their registration in analogous registers according to the legislation of the Member State in which they are established
Note: In the case of a grouping which is not a legal entity, compliance with the requirement is proved by those members of the grouping, which according to the distribution of the participation of the persons in executionof the activities provided for in the contract for the formation of the grouping are engaged in the execution of the construction
When the participant envisages the participation of subcontractors the requirement shall be proved for those subcontractors who, according to the type and share of the contract they are entrusted, Authentication: The fact is certified by reference to EEDOP, Part IV: Criteria-for the selection, section A. Applicability of the data on the CTRS entry, indicating the web address, authority or service issuing the document, the exact reference to the document and, for non-nationals, an equivalent document or a declaration or certificate issued by the competent authorities under its national law on entry of the person in the relevant professional register of the state in which he is established, the law of the state in which the person is established and carrying out his activity, the performance of the works subject to the present public procurement, accompanied by a translation into Bulgarian.
In the case of a consortium which is not a legal entity, the certification of the required requirement is carried out through filling in the relevant section in EEDOP, which is submitted by these members of the circleIf the participant provides for the participation of subcontractors, the certification of fitness is done by filling in the relevant section of EEDOP, which is presented by the subcontractor (s), who will execute the construction
Demonstration: When signing the contract, the participant selected as contractor should submit a document for registration in the TSRC, -Valid on the date of conclusion of the contract - IMPORTANT: Documents to prove compliance with the required requirement shall be submitted by the participant designated as contractor or upon request in the course of the procedure - in the cases of Art. 67, para. 5 and 6 of the PPA. Documents are also submitted to subcontractors, if any.
Participants in the procurement should be insured for the risk of "Professional-responsibility of the builder "according to Article 171 of the TDA or equivalent, with coverage corresponding to the volume and nature of the contract resulting from a statutory act (the objects subject to the contract are the second group, the third category of construction according to Article 137, paragraph 1, item 3, letter "a" of the TDA) - (the requirement applies to both lots)
Authentication: To certify the requirednot the participants fill in the data (sum insured, web site, authority or service issuing the document, exact reference to the document) in EEDOP, Part IV: Selection Criteria, section, B. Economic and Financial Condition, item 5, for Valid professional liability insurance under Article 171, paragraph 1 of the Territory Management Act, at the limit of liability, according to Article 5, paragraph 2 of the Ordinance on the terms and conditions for-compulsory insurance in design and construction or equivalent document (for non-residents). The professional activity of the insurance policies must correspond to the subject of the contract (the objects, subject of the contract are the second group, the third category of constructions according to Article 137, paragraph 1, item 3, letter a) of the TDA). : When signing the contract, the participant selected for andthe contractor shall provide a certified copy of an updated / valid insurance policy or equivalent document (for non-residents) as stated in the EEDOP and if the policy expires by the date of signing the contract - and a certified copy of the new insurance policy .
Note: In the case of a grouping, compliance with the above requirement may be madeto be insured by one or more of the partners in the grouping according to the distribution of the participation of the persons in the implementation of the activities provided for in the contract for the formation of the grouping in relation to the construction activities ..
When the participant envisages the participation of subcontractors the requirement is proved for these subcontractors, which according to the type and share of the order,  Where, for a good reason, the participant is unable to provide the documents requested by the contracting authority, he can prove his economic and financial standing by means of any other document that the contracting authority accepts. IMPORTANT: Documents demonstrating compliance with the required requirement are providedby the participant designated as contractor or upon request in the course of the procedure - in the cases of Art. 67, para. 5 and 6 of the PPA. Documents shall also be submitted to subcontractors and third parties, if any.
A participant meeting the conditions of Art. 10, para. 1 of the Public Procurement Act and the requirements of the Contracting Authority. The assignor removes from participation a participant for whom the grounds are availableunder Art. 54, para. 1 of the Public Procurement Act and Art. 55, para. 1, items 1, 3, 4 and 5 of the Public Procurement Act, the conditions under Art. 107 of the Public Procurement Act, as well as the circumstances under Art. 3, item 8 of ЗИФОДРУПДРКЛТДС, unless the exceptions under Art. 4 of the same law. The Contracting Authority shall not remove from the procedure a participant on the grounds of Art.55, para. 1, item 1 of the Public Procurement Act, if it is proved that the latter has not ceased its activity and is able to execute the orderunder the applicable national rules for the continuation of business in the country in which it is established. The grounds for removal shall be applied until the expiration of the terms under Art. 57, para. 3 of the PPA. Where a participant is a grouping of natural and / or legal persons, the grounds for exclusion are also applicable to each member of the grouping. Where a participant provides for the use of subcontractors orand refers to the capacity of third parties under Art. 65, para. 1 of the PPA, the grounds for elimination shall also apply to subcontractors and third parties. Related parties within the meaning of -2, item 45 of the LP of the Public Procurement Act can not be independent participants in the present procedure. 67, para. 1 of the Public Procurement Act, the tenderer declares, when submitting the tender, the absence of the grounds for removal and compliance with crselection criteria by presenting the EEDOP, and the documents are submitted under the conditions of Art. 67, para. 5 and para. 6 of the PPA.
The Contracting Authority shall require the participants to declare that their offers have been prepared in compliance with the obligations related to taxes and social security, environmental protection, employment protection and working conditions in force in the Republic of Bulgaria. Important! The unforeseen expenses will be incurred only if it is proved necessary and after the amendment of the concluded public procurement contract with the selected contractor under the conditions and by the order of art. 116 of the Public Procurement Act.
