Purchase of related products and services for the modernization of the IT infrastructure and related operating mechanisms serving the integrated IT system SMIS2014 / MYSMIS2014 and its related applications to ensure efficient, continuous and continuous operationand its security.

Purchase of related products and services for the modernization of the IT infrastructure and related operating mechanisms serving the integrated computer system SMIS2014 / MYSMIS2014 and its related applications in order to ensure the efficient, continuous and secure operation of according to the specifications. According to the provisionsin force, especially H.G. no. 264/2003 regarding the establishment of actions and categories of expenses, criteria, procedures and limits for making advance payments from public funds and Law no. 500 of 11.7.2002 regarding public finances, the contracting authority can grant to the supplier an advance of 30% of the value of the public procurement contract, which he will receivethe proportional opera in the payment installments, up to (including) the time of the final payment. Also, for the implementation of the programs, projects and actions provided in art. 52 paragraph (10 ^ 1) and (11) of Law no. 500/2002, with the subsequent amendments and completions:

- actual payments are allowed during the course of the contract, under the conditions and the amounts stipulated in the contracts concluded with cthe contractors, provided that the recovery of each such payment of a share at least equal to the percentage within which the advance was granted, until its full recovery.

In accordance with the provisions of art. 163 of Law no. 98/2016, the contracting authority requests the following qualification criteria:

1) The bidders, the third-party supporters and the subcontractors must not regaseasca in the situations provided in art. 164, 165, 167 of Law no. 98/2016. The way in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, upon requestit to the contracting authority, only by the bidder ranked first.

These documents can be:

- certifying certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget, etc.). ) at the time of presentation,

- the criminal record of the economic operator and the members of the administration body, of management or supervision of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document,

- as the case may be, documents by which demonstrates that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art.171 of the Law 98/2016 on public procurement,

- other edifying documents, as the case may be;

2) The bidders, third-party supporters and subcontractors must not be found in the situations provided in art. 58-63 of Law no. 98/2016.
