Stations equipped with afferent chlorination facilities will be used for disinfection according to the legislation in force (in addition to that at source), drinking water from the water distribution network managed by Somes Water Company SA

Quantum of the participation guarantee, established under the law, will be RON 39 000.

For the case where the participation guarantee is constituted in another currency, for a unitary evaluation and reporting of the amount of the participation guarantee, the reference rate communicated by the NBR at the date of publication of the SEAP participation notice will be used. The validity of the participation guarantee will be at least 6 months, starting with the deadline for submitting bids. The guarantee of participation must be irrevocable and may be constituted by: bank transfer (orderthe bank's payment in favor of Somes Water Company S.A.) to account IBAN RO28RNCB0106000767440001, opened at BCR Cluj-Napoca, a guarantee instrument issued in accordance with the law by a bank or an insurance company in accordance with Form no. 1 - Warranty Letter of Participation.

Proof of the lodgement of the guarantee will be loaded into SEAP by the date and time at the latestthe deadline for submitting bids. Legal theme art. 42 of H.G. no. 394/2016. The return of the participation guarantee shall be in accordance with the provisions of art. 44 of H.G. 394 / 2016.

In the case of submitting offers in association, the participation guarantee must be made on behalf of the association and mention that it covers all members of the group of economic operators jointly.issued in a language other than Romanian will be accompanied by a certified translation in Romanian.

The guarantee of good execution will be made within 5 working days from the signing of the sectoral contract by both parties. The amount of the performance guarantee for the contract is 5% of the value of the contract without VAT. The manner of establishing the performance guarantee is in accordance with the provisions art. 46 of H.G. no. 394/2016 (Form No. 2 - Letter of Good Execution Guarantee). The return of the performance guarantee shall be in accordance with the provisions of art. 48 par. (1) of H.G. 394/2016, respectively within 14 days from the payment of the final invoice of the sectoral contract, if the contracting entity did not raise up to that date claims on it.

Clarification requests-to the awarding documentation will be addressed exclusively in the SEAP within the tender notice, and the responses to them will be also published in SEAP, in the tender notice. DUAE will be filed, as the case may be, by the third party and the subcontractor. Prior to finalizing the award procedure report, the economic operator ranked first after applying the award criterion will, at the request of the contracting entity, provide updated supporting documents demonstrating in acorresponding to the full fulfillment of all the qualification criteria, according to the information contained in the DUAE. If, following the application of the award criterion, the evaluation committee finds that two or more offers are placed first, the contracting entity will ask the economic operators for a new financial proposal and the contract will be concluded with the operatorthe economic entity whose new financial offer has the lowest price.

Insofar as requests for clarification or additional information to the awarding documentation were addressed within the deadline stipulated in the contract notice, the contracting entity will respond to these clarifications within the deadline, which is 10 days before the deadline for submitting bids
