Subject supplies: the subject of this contract is the supply of Bosentan 62.5 mg and 125 mg tablets.

Estimated quantity for 1 year based on 2017 consumption:

Bosentan 62.5 mg: 1800mprime

Bosentan 125 mg: 15 000 tablets

These quantities are given for information only and do not commit the contracting authority. The exact quantities will be determined by the order forms established by the contracting authority.

Duration of the contract: 3 years.

The contract may be extended once by tacit renewal for a period of 1 year, unless three months' notice is given by letter recomgiven by the contracting authority before the end of the 3-year period of the initial contract (see II.10.1).

Place of delivery: ULB Hopital Erasme- Quai Pharmacy, Route de Lennik 808 a 1070 Anderlecht.

- Les The provisions of this section apply individually to: - the bidder submitting an offer for this contract; - to all tenderers submitting-together an offer for the present contract and intend to form a group of economic operators; - to third parties whose capacity is called upon, in accordance with the provisions relating to qualitative selection.

I.6.1) Reasons of compulsory exclusion

I.6.1.1) Criminal conviction

Cfr. Part III. Section A DUME

The contracting authority excludes, at any stage of the processthe tenderer being in one of the cases referred to in Article 67 of the Law, having been the subject of a judgment handed down by a judicial authority having the force of res judicata for one of the following offenses:

1) participation in a criminal organization;

2) corruption;

3) fraud;

4) terrorist offenses or terrorist offenses;

5) money laundering;the rate or financing of terrorism;

6) child labor and other forms of human trafficking;

7) the occupation of third-country nationals on illegal residence.

The exclusions referred to in points 1) to 6) apply only to a period of 5 years from the date of judgment. The exclusion referred to in point 7) applies only for a period of five years from the end of the infracThe exclusion of the candidate also applies where the person sentenced by final judgment is a member of the administrative, management or supervisory body of the candidate or has a power of representation, decision or control within .

I.6.1.2) Social and fiscal debts

Cfr. Part III. Section B of the DUME.

The Contracting Authority excludes, at any stage of the processlasts, the candidate in the case referred to in Article 68 of the Act, not meeting his obligations to pay social security contributions and / or tax debts. However, the following situations are not excluded:

1) when the candidate owes a debt of less than 3 000 EUR or

2) When the candidate is indebted of a debt for which he has ob(3) Where the candidate can show that he has, in respect of a contracting authority or a public company, a claim or claims that are certain, due and free from any commitment with regard to third parties. These claims amount to at least an amount equal to the amount for which he is in default of payment of social debts.However, the operator gives the opportunity to any economic operator to comply with these social and fiscal obligations in the course of the procurement procedure after having noted once that the candidate or tenderer does not meet the requirements. On the basis of this finding, the Contracting Authority shall allow the economic operator a period of 5 working daysto provide proof of its regularization.

I.6.2) Reasons for optional exclusion

The contracting authority may exclude, at any stage of the procurement procedure, the tenderer who is in one of the cases referred to in Article 69 of the Law:

1) Failure to comply with the obligations applicable in the environmental, social and labor law areas;

2) ebankruptcy, liquidation, cessation of activities, judicial reorganization or having made an admission of bankruptcy or is the subject of a procedure of liquidation or judicial reorganization, or in any similar situation resulting from a procedure of the same nature existing in other national regulations;
