Statement regarding non-compliance with the provisions of art. 164, 165, 167 of Law no. 98/2016

Qualification condition: The bidder / associated bidder / subcontractor / third party must not-is in any of the situations provided for in art. 164, 165, 166, 167 of Law no. 98 / 2016.

Declaration on non-compliance with the provisions of art. 58 - 60 of the Law no. 98/2016 on public procurement; The bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 164, 165, 167 of Law no. 98/2016

Statement in accordance with art.60 / Law no.98 / 2016, will be prpresented by all participants together with the submission of DUAE

Mode of accomplishment:

The DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting authority, only by the tenderer-the first place in the mid-term ranking of the bid evaluation. These documents can be:

1. certificates of absence of overdue debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation; the criminal record of the economic operator and the members of the administrative bodymanagement, or supervision of the respective economic operator, or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / Constitutive Act

3. as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par.-(2), art. 171 of Public Procurement Law 98/2016

Specifications: • In case of submitting a joint offer, the requirement must be fulfilled by all the members of the association, as well as by the third party / third party supporters, the subcontractor / subcontractors, if any. which in the country of origin or in the country in which the tenderer is established no documents of the nature of the criminal record are issued, the authoritythe contracting party has the obligation to accept a declaration on its own responsibility or, if in that country there are no legal provisions relating to the declaration on its own responsibility, an authentic declaration made before a notary, an administrative or judicial authority or a professional association has the competence to do so.

Several economic operators have the right to associate with the purpose of submitting the joint offer, having the obligation to formally legalize the association only if the joint offer to declarewinning. When a group of economic operators submits the joint offer, the technical and professional capacity is demonstrated by taking into account the resources of all the group members. Should it be ascertained that the first ranked offers have equal prices, they will be requested to be re-wrapped in a closed envelope, in order to divide the bids. New prices offered can not exceedand the value initially offered. For bidders who will not submit a new bid, the value of the initial bid will be considered. The Contracting Parties have the right, during the performance of the contract, to agree to modify the clauses of the contract by an additional act only in the event of occurrence of circumstances prejudicial to their legitimate commercial interests and which do notshall be provided at the date of conclusion of the contract, according to art. 221 of the Law no. 98/2016, with subsequent modifications and additions. The contracting authority has the right to unilaterally terminate the public procurement contract during its period of validity and in the following situations stated in art. 223 par. (1) lit. a) and b) of Law no. 98/2016
