The tenderer, the subcontractor, the third party does notit must be found in the situations provided by art. 164, art. 165 and art. 167 of Law no. 98/2016 on Public Procurement.

Mode of accomplishment: Initially, the DUAE will be presented (prepared according to the standard form approved by the European Commission at URL: https://ec.europa.eu/growth/tools-databases/espd/filter )

Precisions:

DUAE Form is available to tenderers for sec(a) In the case of submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement, and this requirement will be demonstrated by the potential subcontractors. to third-party / third-party supporters, each supporter has the obligation to demonstrate the fulfillment of the requirement.the confirmation of the associates / subcontractors / third parties shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders, (b) The inclusion in one or more of the situations stipulated in art. 164, art. 165 and art. 167 of Law no. 98/2016 on Public Procurement, adraws the exclusion of the tenderer from the procedure for the award of the contract, (c) the bidder ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders shall present, at the request of the contracting authority, the supporting documents proving the fulfillment of the assumed requirements, as follows: on the lack of overdue debts at the momentl presenting them, regarding the payment of taxes, taxes and social security contributions to the state budget and to the local budget (for the registered office, the secondary offices, as well as the point (s) for which there are payment obligations) The criminal record of the economic operator and the members of the management, management or supervisory body of that-economic operator or those who have power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / constitutive act,

- Where appropriate, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurementice,

- Other editing documents, as the case may be

In case the country of origin or the country where the economic operator is established, no documents of the requested type are issued or they do not cover all the situations covered by art. 164, art. 165 and art. 167, any document deemed to be edifying by the competent authorities of that country shall be accepted.

In the case of tenderers, the documents shall be transmitted in the language in which they were issued, in a certified copy "according to the original", signed and stamped by the legal representative, accompanied by their authorized translation into Romanian. 63 paragraph (1) of Law 98/2016 on public procurement, decision-makers from DS Hunedoara (including-members of the tender evaluation committee) are: - Crisan Radu,

The bidders, associates, subcontractors and third parties will submit a statement that they do not meet the provisions of art. 60 of Law no.-98/2016. Declarations of non-compliance with the provisions of art. 60 of Law no. 98/2016 will be presented with the DUAE.

The contract may be modified under the terms of art. 221 of the Law n98 / 2016.

The communication on the outcome of the procedure will be sent to SEAP and using one of the following communication modalities: fax / e-mail / mail.

Requests for clarifications formulated by the contracting authority's evaluation committee will be transmitted bidders only through SEAP.

If for technical reasons solely related to the technical performance of the systemsthe SEAP is not able to transmit the documents electronically through SEAP, they are sent to the contracting authority within the required deadline: by e-mail (electronically signed).

The contracting authority has the right to request the tenderers, in exceptional circumstances, the expiration of the period of validity of the offer, the extension of this period. In thein the case of extending the period of validity of the offer, the period of validity of the guarantee for participation will be prolonged accordingly. The tenderer has the obligation to communicate to the contracting authority whether or not it agrees with the extension of the period of validity of the tender. The bidder who disagrees with the extension of the offer's validity period is considered to have retractedas the tender, without this losing the guarantee of participation.

The tenderer will submit a statement accepting the contractual clauses contained in the contract model in the tender documentation. If there are objections to the draft contract, namely changes / deletions of the contractual clauses or the addition of new clauses, any proposals for amendmente / completion / removal of contractual clauses will be made in writing through clarification requests. Mandatory contractual clauses may be amended and made known to all interested parties by the closing date for submission of tenders, while specific clauses may be negotiated / modified as long as they do not introduce conditions that would have allowed the award of the contract to anotheror if the change does not change the economic balance of the contract in favor of the contractor.

If the tenderer makes use of an association with other operators, third parties or subcontractors, other than the documents expressly requested in Chapter III.1. "Conditions of Participation", included in the offer will be the commitment (s) and statements of the sustained third party/ association agreement / subcontracting agreement, as appropriate, drafted in accordance with the legal provisions.
