Declaration regarding non-compliance with the provisions of art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement. Mode of accomplishment: the DUAE will be presented (prepared according to the standard form approved by the European Commission at-URL: https://ec.europa.eu/growth/tools-databases/espd/filter). Specifications: The DUAE Form is made available to bidders in the Documentation and Clarification section.

(A) Incorporation in one or more of the situations referred to in art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement entails the exclusion of the tenderer from the procedure for awarding the contract,

(b) The tenderer ranked first in the ranking drawn up at the completion of the evaluation of the tenders shall present, at the request of the contracting authority, the supporting documents proving the fulfillment of the assumed requirements, as follows: certificate of absence of outstanding debts at the time of their presentation, payment of taxes, taxes and contributions tosocial security to the state budget and to the local budget (for the registered office, the secondary offices, as well as the point / work points for which there are payment obligations) to be submitted following the request of the contracting authority addressed to the first ranked bidder intermediate. If in the country of origin or in the country where the economic operator is established it is notthey issue documents of the type requested or they do not cover all the situations covered by art. 164, art. 165 and art. 167, any document deemed to be edifying, issued by the competent authorities of that country, shall be accepted. In the case of bidders foreign legal / physical persons, the documents will be transmitted in the language in which they were issued, in a copy certified "according to the original", signed andstamped by the legal representative, accompanied by a certified translation in Romanian. In the sense of the provisions of art. 63 par. (1) of the Law no. 98/2016 on public procurement, decision-makers from D.S. The tenderer / candidate has the obligation to be legally registered and have the right to market the products requested by this documentation. The subject matter of the contract must have a correspondent in the CAEN code of the certifying certificate issued by O.NR.C. - Mandatory document: Certificate issued by the Trade Register Office. The information contained in this documentbe valid / valid on the date of submission. Initially, bidders will complete the DUAE statement. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by O.NR.C. or, in the case of foreign tenderers, equivalent documents issued in the country of residence are to be submitted, at the request of the contracting authority, only forthe bidder ranked first in the intermediate rankings drawn up to complete the bid evaluation.
