The subject of the order is the delivery of 2 (two) brand-new identical turbojet aircraft with a pressure cabin and a built-in medical cabin, for a specialized emergency medical and sanitary transport team, meeting the requirements of the Regulation of the European Union Commission No. 748/2012 of 3.8.2012, as amended, establishing implementing regulations for the certification of aircraft and related products, parts and accessories in the field of airworthiness for flight and environmental protection and regarding certypification of design and production organizations. The delivered planes will be designed to perform tasks by a specialist emergency medical and sanitary transport team during the day and at night, in full and limited visibility conditions and in flight conditions according to IFR regulations.

I.

Purchase of 2 (two) brand-new identical turbojet aircraft for the specialized medical rescue and sanitary transport team.

II.

Subject requirements for the offer (permits and / or certificates required) and / or certificates):

Pursuant to - 13 para. 1 point 3 of the Regulation of the Minister of Development of 26.7.2016 on types of documentsin which the contracting authority may request from the contractor in the procurement procedure - OJ of 27.7.2016, item 1126, in connection with the ordinance of the Minister of Entrepreneurship and Technology of October 16, 2018 amending the ordinance on the types of documents that the Employer may request from the Contractor in the procurement procedure - Journal of Laws of 17.10.2018, item 1993, in cTo confirm that the offered deliveries meet the requirements specified by the Employer, the Contractor is obliged to confirm with an appropriate document, i.e. submit with the offer (subject conditions):

1. Offered "Required parameters", completed and signed Annex 2 to the ToR.

2. A copy of the type certificate issued by the European Aviation Safety Agency (hereinafter EASA) offeredmolotek with current changes as at the date of the offer.

3. A copy of the data sheet for the type certificate (EASA) of the offered aircraft with the current changes as at the date of the offer.

4. A copy of the type certificate (EASA) of the engine offered with the aircraft, as amended at the date of the offer.

5. A copy of the data sheet for the type-certificate (EASA) of the engine offered with the aircraft, as amendedon the day of submitting the offer.

6. A copy of the noise data sheet (EASA) of the offered aircraft with the current changes as at the date of the offer.

7. A copy of the Flight Manual (AFM) together with supplements regarding the airplane configuration offered.

The documents referred to above are submitted in the original in the form of an electronic document or in an electronic copy of the document or statementa certified as true to the original, bearing a qualified electronic signature.

Documents drawn up in a foreign language shall be submitted together with a translation into Polish.

The Awarding Entity shall accept the documents referred to above, drawn up in English, with the exception of point 1, Annex 2 to SIWZ - "Required parameters" are offered.

The Employer does not specify the detailed conditions including zThe contractor should be insured against civil liability in the scope of conducted activity related to the subject of the contract for a guarantee sum in an annual period of not less than: PLN 10, 000, 000.00 (in words: PLN ten million 00/100).

I.

W to demonstrate that there are no grounds for exclusion from the procurement procedure in the circumstances referred to in art. 24 paragraph 1 orand art. 24 paragraph 5 points 1, 2, 3, 4 of the Public Procurement Law, the Employer requires the documents referred to in - 5 points 1, 4, 5, 6, 10 in connection with - 7 para. 1 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the Employer may request from the Contractor in the contract award procedure.set out in the ToR, by the deadline for submitting bids set out in the ToR. The contracting authority allows any form of payment of the bid security - in accordance with art. 45 item 6 of the Public Procurement Law

III.

The Employer provides for the use of "reverse" procedure in accordance with Article 24aa of the Public Procurement Law

The Employer does not provide for supplementary orders referred to in Article 67 paragraph 1 item 6 and 7 and Article 134 paragraph 6 item 3 of the Public Procurement Law.

With reference to Section IV.2.6): "The minimum period during which the bidder will be bound by the offer" The Employer informs that 90 days should be taken in 3 (three months).

IV.

The Employer does not foresee the application of the provisions of Article 29 para. 4 point 1 of the Public Procurement Law

V.

Pursuant to Article 93 (1a) of the Public Procurement Law, the Awarding Entity provides for the possibility of canceling the public procurement procedure, if the funds arewhich the Awarding Entity intended to allocate for financing all or part of the order, were not granted to him. EU) 2016/679 of 27.4.2016 (hereinafter GDPR), has implemented adequate security measuresto the risks identified by them and giving the guarantee of proper protection of personal data provided in the course of the proceedings. Detailed information clause from art. 13 GDPR is contained in the ToR.
