With its resolution of November 12, 2019 "Act prudently! - Adapt funeral regulations to the needs of society" (Drs. 18/4711), the Bavarian state parliament saw different needs for adjustments in the funeral sector and informed the state government, among other things. a. gave up introducing "[...] a compulsory second medical examination before cremations [...]". The task of the second post-mortem examination before cremations is assigned to the health department, within its local area of responsibility The crematorium in question is located (Section 17 Paragraph 4 Sentence 2 of the Funeral Ordinance [BestV] in the version valid from April 1, 2025). The respective health authority can carry out the sovereign task of the second post-mortem examination Serve third parties (Section 17 Paragraph 4 Sentence 3 BestV in the version valid from April 1, 2025). The contractor (AN) undertakes to provide all services in connection with the implementation of the second medical postmortem before cremations provide. In order to ensure a high quality of the second postmortem examination, according to Section 17 Paragraph 4 Sentence 4 BestV in the version valid from April 1, 2025 i.
