After the political crisis which rocked the Central African Republic, HE the President of the Republic, Head of State and the Government worked to put in place a National Plan of Recovery and Consolidation of Peace, the RCPCA which was presented at the round table of donors in Brussels in 2016. This Plan is designed around three pillars namely:

· Restore peace, security and reconciliation;

· Renew the social contract between the state and the population and,

· Promote economic recovery and the revival of the productive sectors.

The last pillar above is accompanied by a priority component aimed at ensuring the conditions conducive to the development of the Private Sector and employment (improved support for businesses and services, vocational training, entrepreneurship and employment). As part of this component, the Ministry of Employment has implemented the recommendations of the National Forum on Decent Work, developed the National Policy for Employment and Vocational Training to address the problem of unemployment and unemployment. underemployment in general and that of youth employment in particular.

This document identifies among the main obstacles to the creation and promotion of employment, the legislative and institutional constraints that the lifting involves the revision of certain legal texts including the Labor Code. This need has also been highlighted in the CAR Strategy for the Development and Modernization of the Labor Administration System.

Indeed, the implementation of the activities stemming from the priority component n ° 3 of pillar 3 requires an improvement of the business climate through legislative reforms, in particular the adaptation of the Labor Code to the national economic and social environment and to the demands of the international community.

This reform will also lead to better governance of labor market institutions and facilitate the implementation of the new employment and vocational training policy.

However, the revision of Collective Agreements unsuited to socio-economic realities with reference to the Prime Minister's mission letter, is urgent, including texts governing NGOs. To this is added the adoption and promulgation of the texts of application of the Labor Code. For the texts of application may come out of the Code itself or the finding of deficiency of legislation that should be regulated according to their importance.

Finally, it should be noted that Law No. 09.004 of 29 January 2009 on the Labor Code has been widely criticized because of its many weaknesses and its coexistence with the 1961 Act, which makes it difficult to apply at least concerning the labor courts.




Duties and Responsibilities

The consultant will be mandated to:

· Collect and analyze the available documentation related to the Law No. 09.004 of 29 January 2009, on the Labor Code of the Central African Republic, including relevant international labor standards including the eight fundamental conventions of the International Labor Organization, the reports of the Committee of Experts on the Application of Conventions and Recommendations, the National Policy on Employment and Vocational Training, the DWCP, the Strategy for the Development and Modernization of the Labor Administration System of the RCA etc ...;

· Collect through individual interviews or focus group the expectations of all actors of the labor administration system in relation to the new law and likely to help the consultant in the accomplishment of his mission (public authorities, partners social organizations, official bodies dealing with the Ministry of Labor and Employment, the agencies of the United Nations system, including the ILO and UNDP, etc.);

· Summarize the expectations of the various stakeholders encountered by identifying the main weaknesses of the current law;

· Propose a single project merging the two laws taking into account the expectations and observations really founded, the weaknesses noted with content adapted to the economic and social environment of the Central African Republic;

· Organize the validation workshop.

Required Skills and Experience

The consultant will have to conduct the work in close consultation with the national authorities in order to gather their observations and to identify with them the weaknesses contained in this law. It will also have to agree with the authorities concerned on the direction to be given to this piece of legislation in relation to the new employment policy and the problem of improving the business climate.

To do this, it must focus on individual interviews and focus groups conducted using data collection tools and information designed for this purpose.

The consultant will be accompanied for the duration of the investigation by an official of the Mixed Framework of Concertation for the Improvement of the Business Climate (CMCAA) appointed by the Minister, Permanent Technical Secretary, who will also make available to the consultant, a file on the expectations of the institution.

Consultant Profile:

· The consultant must hold a post-graduate diploma in labor law and preferably be a senior member of the labor administration who has held senior positions in that capacity.

· He must have a perfect command of French and good experience in the drafting of legal texts in the field of work and have led or participated in consultations at the international level.

· He must also have a real ability to work with public authorities, workers 'and employers' organizations and labor courts.

· Having worked as a consultant for the ILO could be a major asset.

· The minimum professional experience required is ten (10) years.

Duration:

The mission will take place from February to March 2019. The study must be conducted and finalized within a period not exceeding 90 days from the date of signature of the contract. It will be the subject of a national validation workshop

Evaluation criteria :

· Have a good knowledge of the problem of the working code in the Central African Republic (20 pts).

· Have at least ten (10) years of experience in the field of labor regulation in the Central African Republic with at least five (5) years of proven experience in updating work codes (20 pts).

· Have conducted at least three (3) similar previous support / consultancy missions in the field of labor regulations in accordance with ILO guidelines (20 pts).

· Justify great communication and drafting skills. (20 pts).
