Prequalifications are invited for Procurement of Legal Advisors for Negotiation of Key Project agreements for Gas, Coal, Solar (and other renewable energy) Independent Power Producers (IPPs)

Interested bidders who wish to participate in the procurement process of the above-listed
projects must submit to NBET the following documents:
(i) Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC 2 and 7. Business Name is also acceptable for Consultancy Services;
(ii) Evidence of Company-s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all the Partners in case of Business Name) for the last three (3) years (2018, 2019 and 2020) expiring on 31st December, 2021;
(iii) Evidence of Pension Clearance Certificate expiring on 31st December 2021;
(iv) Evidence of Industrial Training Fund (ITF) Compliance Certificate expiring on 31st December 2021.
(v) Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate expiring on 31st December, 2021;
(vi) Evidence of Interim Registration Report (IRR) expiring on 31st December 2021 or valid Certificate issued by the BPP
(vii) Sworn affidavit:
• Disclosing whether or not any officer of the relevant committees of the Nigerian Bulk Electricity Trading Pic (NBET) or the BPP is a former or present director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• That the company is not in receivership or about to be in receivership or is a replacement for a hitherto tax defaulting company; and
• That no company-s director has been convicted in any country for any offence relating to fraud or financial impropriety;
(viii) Company-s Audited Accounts for the last three (3) years (2018, 2019 and 2020) duly stamped by a registered auditor.
(ix) Reference Letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
(x) Verifiable evidence (award letters, contract agreements, valuation/job completion certificates etc.) of having carried out three (3) similar assignments of the same nature during the past five (5) years.
(xi) Company-s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON eta.;
(xii) Consultancy Services: Evidence of Firm-s current registration with relevant regulatory professional body(ies) such as Nigeria Bar Association, ICAN, ANAN, NEMSA, ;
(xiii) A1: Only companies included in the National Automotive Design and Development Council-s approved list of local manufacturers of vehicles or their authorised representatives should bid for the vehicles;
(xiv) A7 &. C8: Evidence of current registration / accreditation with Computer Professionals Registration Council of Nigeria and National Information Technology Development Agency (NITDA);
(xv) C1, C2, C3 8iC6: Evidence of Practice Licence issued by Body of Benchers;
(xvi) C4: Evidence of current registration with Financial Reporting Council of Nigeria;
(xvii) C4: Evidence of Practice Licence issued by ICAN, ANAN or other relevant regulatory professional body(ies);
(xviii) D4: Please note that the photography services required are those of a photo documentation specialist and event photography
(xiv) All documents for submission must be transmitted with a covering/forwarding letter under the company/firm-s letterhead bearing amongst others; the Registration Number (RC) as issued by the CAC; Contact Address; Telephone Number (preferably a GSM/Mobile Number); an email address.

Notice:
(i) Bidders should not bid for more than one (1) Lot;
(ii) NBET reserves the right to verify the authenticity of any claims made on the documents) submitted.
(iii) Failure to comply with the instructions to provide relevant document(s) will result in disqualification
(iv) Submission of false documents is an offence and would lead to disqualification and prosecution
(v) Bids must be in English Language and signed by an official authorised by the bidder;
(vi) Bids submitted after the deadline for submission would be returned un-opened;
(vii) All costs will be borne by the bidders;
(viii) Presence of bidders/representatives and members of the public shall not be required during the bid opening ceremony in compliance with COVID-19 Guidelines. The Bids Opening will be covered by video recording (link will be sent to bidders) with the presence of two (2) representatives of private sector professional bodies and Civil Society Organisation in the areas of Anti-Corruption/Transparency;
(ix) Bidders can submit through Post (Courier Services);
(x) Pre-qualification: Only pre-qualified bidders at technical evaluation will be invited at a later date for collection of tender documents;
(xi) Services: Only shortlisted firms will be invited at a later date for collection of Request for Proposals;
(xii) NBET is not bound to pre-qualify/shortlist any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
