Lot 1: Wallersdorf North Lot 2: Wallersdorf South Negotiation procedure with participation competition in accordance with Section 12 KonzVgV in conjunction with Section 14 Paragraph 2, Paragraph 3 No. 2, No. 3 VgV, Section 119 Paragraph 5 GWB (two-stage negotiation procedure) to determine a network operator for the operation of passive gigabit network infrastructure in the operator model in the advertised expansion areas in accordance with the directive "Funding to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany" of March 31, 2023 the version of the 1st amendment dated April 30, 2024 (hereinafter “Gigabit-RL 2.0”). The main basis of the procedure is the “Framework regulations of the Federal Republic of Germany to support the nationwide development of gigabit networks” dated August 1, 2024 (hereinafter "Gigabit-RR 2.0"), the guideline "Funding to support the gigabit expansion of telecommunications networks in the Federal Republic of Germany" of March 31, 2023 in the version of the 1st amendment of April 30, 2024 (hereinafter Gigabit-RL 2.0) as well as the Communication from the European Union "Guidelines on state aid for the promotion of broadband networks" of January 31, 2023 (2023/C 36/01). According to the results of market research, the addresses in the development area are underserved addresses that are eligible for funding the Gigabit RL 2.0. To this end, the concession provider plans to set up its own, passive gigabit network infrastructure in the operator model, which will remain its property, for all those determined to be eligible for funding.
