3) not availing of the individual emergence plans pursuant to the law 18.10.2001 n. 383 and subsequent amendments and additions, or conclusion-of the period of emergence;

4) non-existence of control and connection relationships pursuant to art. 2359 of the Civil Code with other competitors in the same tender.
