This contract consists in the assignment the design, development and provision of training courses on health and safety at work, amenvironmental and quality.

Main Site: Entire national territory.

This contract consists in entrusting the planning, development and provision of training courses on health and safety at work, environment and quality. carrying out approximately n. 150 (one hundred and fifty) annual training days pertaining to the aforementioned field.

The economic operatoras well as any auxiliary company and any sub-contractors must be in possession of the following general order requirements as per art. 80 of Legislative Decree 50 / 2016.

2) Trenitalia will verify the actual existence of the requirements referred to in paragraph III.1) with regard to the best bidder; in case of a negative result, Trenitalia will proceed to its exclusion fromthe tender, the forfeiture of the provisional deposit as well as the notification to the ANAC and the awarding in favor of the first of the following competitors in the ranking, subjected to positive checks;

3) Trenitalia reserves the right to verify the effective existence of the requisites as per the previous paragraph III.1) also in relation to other bidders; in case ofnegative outcome, Trenitalia will proceed to their exclusion from the tender, to the forfeiture of the provisional security and to the ANAC report;

4) before the awarding, Trenitalia reserves the right to proceed with the verification and possible exclusion of abnormally low tenders as per art. 97 of Legislative Decree 50/2016;

5) Trenitalia reserves the right to interrupt or cancel the race at any time in basand evaluations of its own exclusive competence without the competitors having any rights or expectations whatsoever;

6) Trenitalia reserves the right to proceed with the awarding even in the presence of a single valid offer;

7) in case of termination of the contract due to non-compliance the trustee, or his bankruptcy, Trenitalia reserves the right to ask the second classified for the purpose of sthypothesizing a new contract for the continuation of the services, under the same conditions already proposed at the time of the offer; similar faculty Trenitalia reserves itself in the event of bankruptcy, resolution or waiver of the second; the above until the list of validly formulated offers is exhausted;

8) Trenitalia reserves the right to exclude competitors for whom, according to theirfor evaluation, there is no adequate professional reliability as they have been incurred in the last three years:

i) in the resolution for non-fulfillment of contracts for works, services and supplies entrusted by contracting stations of Trenitalia or other FSI group companies;

ii) in the failure to take delivery, by his own fact and fault, of works, supplies or services entrusted by Trenitalia or by another FSI group company;

iii) in the declared non-tested works, services and supplies covered by a contract with Trenitalia or another company of the FSI group;

iv) in the violation, during the execution of previous contracts or during the participation in previous tender procedures, of one of the rules contained in the Group Code of EthicsFSI, ascertained by Trenitalia with all means of proof;

9) Trenitalia reserves the right to exclude offers presented by RTI consisting of 2 or more economic operators that individually possess the financial and technical requirements for participation if an analysis of the structure and dynamics of the market concerned or any other element, detects a precise anticompetitive willoncorrenziale of the companies involved;

11) this announcement and published in GUUE, GURI, on the website of the Ministry of Infrastructures and Transport www.serviziocontrattipubblici.it, on www.acquistionline.trenitalia.it and on the newspapers: La Repubblica, Il Corriere della Sera;

14) the contract that regulates the contract subject of this procedure does not contain the compromissor clauseia;

15) the person responsible for the proceeding of the present tender procedure and responsible for the Purchasing, Industrial, Staff and Marketing Department.
