Competitors may participate in this tender procedure:

a) who do not pay in the grounds for exclusion listed in art. 80 of Legislative Decree 50/2016;

b) that do not fall into the cases of exclusion pursuant to Law no. 383/2001 and s.m.i.;

c) that are not in the conditions referred to in art. 53, paragraph 16 ter, of Legislative Decree of2001, n. 165;

d) that are not in any other case of exclusion provided for by the current legislation on public contracts; e) be registered in the Register of Companies of the Chamber of Commerce, Industry, Craft and Agriculture (CCIAA) competent and must exercise a activity consistent with that of the two specific sectors covered by this agreement; this requirement must result from the visura ordinaria of the Chamber of Commerce;

f) be registered in the National Register of Environmental Managers in Category 1;

g) be registered, pursuant to and by effect of Law no. 190/2012 and ss.mm.ii. in the competent Prefecture.

The contracting authority, pursuant to art. 95, paragraph 12, of Legislative Decree no. 50/2016 may decide not to award the tender if no offer is convenient or suitable in relation to the subject of the contract. The contracting authority reserves, at its discretion, at any timethe right to cancel / revoke the tender or not to award or revoke the awarding of the tender, without the competitors having any rights or expectations whatsoever. The contracting authority reserves the right to award each lot also in presence of a single offer provided that it is considered valid and appropriate at the sole discretion of ASIA Napoli SpA

ASIA Napoli SpA-adheres to the protocol of legalization signed by the Prefecture of Naples with the Municipality of Naples. The text of the protocol, available on the website www.asianapoli.it is an integral and substantial part of this announcement. The contracting authority shall exclude from the tender, declare the forfeiture of the award or terminate the contract with respect to the companies for which the prefectanti-mafia information with an interdictory value.

Pursuant to art. 76 of Legislative Decree 50/16 each competitor has the obligation to indicate, at the time of submission of the offer, the domicile elected, the PEC and the fax number to which they can send the communications relating to this tender procedure. .

As far as payments are concerned, the art. 3 of the law n. 136/2010 e-subsequent amendments on the subject of traceability of financial flows.

The competitor is also required to make a payment of 500.00 EUR within the deadline for submission of the offer and in accordance with the provisions of the ANAC and the tender regulations. for the following IGC: 7659666C55.
