Unarmed Vigilance Service, with sworn guards, on board trains and buses, and related areas of use, used by FSE for the exrailway and automotive services, tender code APP.015.2019 CIG 79073718F8.

Main Site: Provinces of Bari, Taranto and Lecce on board trains, buses and related storage areas.

Unarmed security service, with Special Security Guards on board trains and buses and related storage areas, used by FSE for railway and automotive operations, to support the activityanti-evasion carried out by company personnel tender code APP.015.2019, CIG 79073718F8.

The assignment procedure is called pursuant to Legislative Decree 50/2016 and subsequent amendments. (Code of public contracts) and of the d.P.R. 207/2010 limited to the regulations still in force pursuant to art. 216 of Legislative Decree 50/2016 and amendments for the part applicable to the so-called Special Sectors.

a) registration in a register prelevant professional (to be declared in the DGUE);

the economic operators must be in possession of a prefectural license of a private Supervisory Institute pursuant to arts. 133 and following of Title IV of the Consolidated Law on Public Security of 18.6.1931 n. 733 and subsequent amendments and to the Ministerial Decree of 1.12.2010 n. 269 and subsequent amendments, as well as the requirements set out in Annexes A, B, C, D, E, F and F1 to the advanceto DM. Functional class, dimensional levels and territorial areas:

- functional class as per art. 2, paragraph 2, letter a), of the Ministerial Decree n. 269 of 01.12.2010,

- pursuant to art. 3, paragraph 2, letters a), of the aforementioned decree,

- dimensional level: services involving the employment of security guards not lower than n. 6 and not more than n. 25 pursuant to art. 2, paragraph 2, letter b), of the Ministerial Decree269/2010,

- territorial area 3: institutions that intend to operate one or more services, of which in the aforementioned functional class, in an ultra-provincial territory, on condition that it is defined by borders coinciding at least with the entire territory of a municipality, with population up to 3 000 000 inhabitants. being a supervision to be carried out in territorial areas including provincesce of Bari, Lecce and Taranto the prefectural license must, pursuant to art. 5, paragraph 3, of the Ministerial Decree 269/2010, to be issued by the prefect of the province in which the institute has its seat, upon communication to the competent prefects for the territory;

b) decree of nomination of the prefect for the particular sworn guard; the special security guards employed in the execution of the service must:

- essin possession of the nomination decree, issued by the prefect pursuant to articles 133 and following of the R.D. 18.6.1931, n. 773 (Consolidated text of the public safety laws) and of the art. 249 and following of the relative execution regulation (R.D. 6.5.1940, n. 635), for the performance of the territorial service as identified above,

- appropriately trained and trained in accordance withart. 6 of the decree n. 154 of 15.9.2009 and of the dispositions of which of the 24.2.2015 issued by the Ministry of the Interior - Department of Public Security;

c) registration in a commercial register (CCIAA) (to be declared in the DGUE).

Economic operators, if Italian citizens or citizens of another Member State residing in Italy, they must be registered in the Chamber of Commerce register, industry, craftsmanship and agriculture or in the register of provincial commissions for crafts, or with the competent professional orders for the activity related to the subject of this announcement or for similar activities.

To the subject of another Member State not resident in Italy and proof of registration is required, in accordance with the regulations in force in the State of residence, in one of the registersprofessional or commercial as per Annex XVI to Legislative Decree 50/2016, by sworn declaration or in accordance with the regulations in force in the Member State in which it is established or by means of certification, under its own responsibility, that the certificate produced has been issued by one of the professional or commercial registers established in the country where you are resident.

NB:

1) In case of RTI isof consortium: each company belonging to the grouping must meet the requirements of points a) and c);

2) each sworn special guard must be in possession of the requisite as per point b). (to be declared in the DGUE) Average annual global turnover referred to the last n. 3 financial years available not less than EUR 800 000.00 (eight hundred euros)la / 00) excluding VAT (see Annex XVII to the Code); pursuant to art. 83, co. 5, of Legislative Decree 50/2016 and subsequent amendments, it is specified that the amount indicated above is required in order to allow the selection of a reliable operator with experience in the sector of the tender, in consideration of the importance of the security service for safety on board trains and buses and related areasin the field of railway and automotive operations. The proof of the requirement is provided, pursuant to art. 86, paragraph 4, and to XVII part I, of the Code:

- for corporations of capital through the approved budgets on the date of expiry of the deadline for the submission of tenders accompanied by the supplementary note,

- for the economic operators constituted in the form of a businessindividual or company of persons by means of the unique Model or VAT Declaration;

Where information on turnover is not available, for companies that have started the business for less than 3 years, the turnover requirements must be related to the period of activities. pursuant to art. 86, paragraph 4, of the Code, the economic operator, who for well founded reasons is not able to pre-hearing the required references can prove one's economic and financial capacity through any other document considered suitable by the contracting authority;

b) (to be declared in the DGUE) possession, pursuant to art. 83, paragraph 4, lett. c), of the Code, of the following RCT insurance coverage for a ceiling not less than EUR 5 million per claim and per year; the proof of thisrequisite and provided through the presentation of the relative policy in a certified copy during the execution of the contract;

To be admitted to the tender, the competitor must possess the requisite (final synthetic score in acronym PSF), as specified below.

The minimum acceptable value of this requirement (PSF), in order to obtain ammission to the tender, and equal to 18. To determine this requirement the competitor, on the last budget approved and deposited with the Chamber of Commerce, will have to perform the economic-financial self-assessment based on the procedure indicated above using, for comparison, the following average reference indexes (code ident. 6842): Roa (3.88%), rotation of total assets (110.25%), cashcurrent income (111.27%), fixed asset coverage (46.72%), financial autonomy (18.51%), liability liability (53.07%), bank debt (20.76%), cost elasticity (63.38%).

NB:

- the requirement referred to in point a), as divisible, can be held cumulatively by the grouping and in a majority measure by the agent,

- the requirement of cui under point b) must be owned by the economic operator as a whole,

- the requirement of point c) above must be possessed.

a) by any company belonging to the grouping in the case of RTI;

b) by the consortium in the case of consortia as per art. 45, co. 2, lett. b);

c) by the consortium or by all the consortium members in the case of consortia as per art. 45, co. 2, lett.c).

The CCNL of reference is as follows: employees of institutions and private security companies and fiduciary services of 8.3.2017.

Non-division into lots

Pursuant to art. 51, co. 1, of Legislative Decree 50/2016, it is specified that the assignment in question cannot be subdivided into lots since the intervention refers to the entire network.

The competitor, with the presentation of the offer, and aware that FSE may carry out checks on the truthfulness of declarations / certifications submitted, also by requesting documentation certifying what was declared. By way of non-exhaustive example pit will be possible to carry out checks on the declarations / certifications presented (pursuant to art. 71 of the D.P.R. 445/2000)
