Security for the fulfillment of all obligations of the contractor under the contract shall not exceed 5 per cent. Penalties (- 11)
The contractor has to pay as a contractual penalty for delay :
When exceeding the specified time limits for each completed week 0.156 v. H. of that parts of the power that can not be used. The benchmark used to calculate the contractual penalty for exceeding individual deadlines is the unusable part of the service that corresponds to the services to be provided by that date. The penalty will be 5%. H. of the contract sum (without value added tax) limited.
Convicted contractual penalties for the Verzug for non-compliance with binding intermediate dates (individual deadlines as contractual periods) shall be credited to a contractual penalty forfeited due to non-compliance with the deadline for the completion of the service.
Contractual penalty (- 18 HVTG)
