The suitability is confirmed by presentation of PQ no. or provisionally by the completed "self-declaration of suitability gem. Form 124 or a single European self-declaration (EEE) with the offer.
If the offer of a non-qualified tenderer is shortlisted, the certificates given in form 124 or EEE must be submitted within 6 calendar days of the request.
Tells itself the bidder to fulfill the contract on the abilities of other companiesthe respective number in the pre-qualification list or the declarations and certificates according to Form 124 or the EEE are also to be submitted on request to these other companies. Certificates that are not in German must be accompanied by a translation into the German language.

The demand for a specific legal form acc. -6 EU Abs. 3 Nr. 2 VOB / A remains reserved for the order case. The declaration must be signed by all members of the community in a legally binding manner. It is inadmissible as a member of a consortium und at the same time make an offer as a single bidder. Bidder groups of companies in potential competition must provide an antitrust clearance certificate on request.
The composition of a consortium can not be changed in the tendering procedure (according to -- 132 and 133 GWB).
